City Council Resolution 2005-03CITY OF MONTICELLO RESOLUTION NO. 2005-3 WHEREAS, The City of Monticello, as the authority issuing retail liquor licenses within the City, has the power to levy certain civil penalties against license holders for various violations of law, pursuant to Minnesota Statutes, Section 340A.415; and WHEREAS, The Minnesota Department of Public Safety through an Agreement has performed compliance checks, during which liquor license holders are checked to make certain that they do not sell alcoholic beverages to minors; and WHEREAS, The terms of said Agreement require that establishments selling to minors be assessed certain minimum penalties; and WHEREAS, The City Council of Monticello desires to reduce access to alcohol by minors and also desires to adopt a policy setting out civil penalties to be assessed against license holders who fail the compliance checks and sell alcoholic beverages to minors; NOW, THEREFORE BE IT RESOL VED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: That any liquor licensee selling alcoholic beverages to a minor shall be assessed the following civil penalties: 1St Violation $750 administrative fine 2nd Violation within 2 years $1,000 administrative fine rd Violation within 2 years Maximum monetary fine allowed by statute 2. That no suspension or revocation shall take effect until the licensee has had the opportunity for a hearing regarding the violation. 3. That the City of Monticello may waive or modify the civil penalties set out in this policy if it finds good cause to do so, if it makes findings as to the reasons for doing so, and if doing so does not violate the terms of any grant Agreement with the State of Minnesota.
