RESOLUTION NO. 2004-43
RESOLUTION ISSUING A NEGATIVE DECLARATION OF NEED
WAL-MART
WHEREAS, the preparation of the Wal-Mart EAW and comments received on the EAW
have generated information adequate to determine whether the proposed retail
development has the potential for significant environmental impacts; and
WHEREAS, the EAW has identified areas where the potential for significant
environmental effects exist, but appropriate measures have or will be incorporated into
the project plan/or permits to reasonably mitigate these impacts; and
WHEREAS, the Wal-Mart development project is expected to comply with the City of
Monticello and review agency standards; and
WHEREAS, based on the criteria established in Minnesota R.4410.1700, the project does
not have the potential for significant environmental effects; and
WHEREAS, based on Findings of Fact and Conclusions, the project does not have
potential for significant environmental impacts,
NOW THEREFORE, BE IT RESOLVED that the City of Monticello has determined that
an Environmental Impact Statement is not required.
Adopted by the Monticello City Council this 14`x' day of June, 2004.
