ACCEPTING IMPROVEMENTS
BRIAR OAKES STORM POND RESTORATION
PROJECT NO.2003-IIC
WHEREAS, under Improvement Project No. 2003-11 C the City provided for the restoration of the
slopes of the storm water pong to meet the minimum 4:1 grade and restore vegetation and other
appurtenant work for the storm water pond located in the northeast corner of the Briar Oakes 2nd
Addition between Briar Oakes Drive and Briar Oakes Boulevard, and
WHEREAS, the City Engineer has inspected the work constructed completed under this project and
finds it to be in conformance with the approved plans and specifications for the same,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MONTICELLO, that the improvements constructed under Improvement Project No. 2003-11C are
hereby accepted by the City of Monticello contingent upon the contractor submitting the following:
* Satisfactory showing that the contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding state income tax.
* Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured.
* Consent of Surety to Final Payment certification from the contractor's surety.
* Two year maintenance bond.
Adopted by the Monticello City Council this 23rd day of August, 2004.
