City Council Resolution 2004-86CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2004-86 RESOLUTION DECLARING COST TO BE ASSESSED AND SETTING PUBLIC HEARING DATE PROJECT NO. 2004-6C 2004 CORE STREET PROJECT WHEREAS, a contract has been let for the improvement of the improvement of the following streets: Fairway Drive, Club View Drive, Bunker Circle, Center Circle, Sandtrap Circle, Eagle Circle, Kampa Circle, Meadow Oak Avenue, Meadow Oak Lane, Oakview Lane, Meadow Oak Drive, Sandberg Road from Chelsea Road to Oakwood Drive and School Boulevard from TH 25 to Fenning Avenue by street reclamation and reconstruction, curb and gutter repair and replacement where needed and all other necessary appurtenant work and the contract price for improvement is $946,306.50 and the expenses incurred or to be incurred in the making of such improvement amount to $264,966 so that the total amount of the improvement will be $1,211,273.. NOW THEREFORE, BE IT HEREBY RESOL VED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $703,404 and the portion of the cost to be assessed against benefitted property is declared to be $507,869. 2. Assessments shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January, 2005 and shall bear interest at the rate of 5.5% percent per annum form the date of the adoption of the assessment resolution. 3. The City Clerk with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall filed a copy of such proposed assessment in his office for public inspection. 4. A hearing on the proposed assessment shall be held on November 8, 2004 in the City Hall at 7 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 5. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall stated in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 6. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The property o\vner may at any time thereafter, pay to the City, the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is ma(' e. Such payment must be made before November 15 or interest will be charged through December 31, of the succeeding year. Adopted by the Monticello City Council this 25 I day of October, 2004.
