JOINT RESOLUTION OF THE CITY OF MONTICELLO
AND THE TOWNSHIP OF MONTICELLO AMENDING
THAT CERTAIN ORDERLY ANNEXATION AGREEMENT
DATED MARCH 5, 1998 BETWEEN THE TOWN OF
MONTICELLO AND THE CITY OF MONTICELLO
WHEREAS, the City of Monticello ("City") and the Township of Monticello
("Township") in cooperation with the Wright County Board ("County" or "County Board")
entered into an Orderly Annexation Agreement (``Agreement") on March 5, 1998 allowing
for the orderly annexation of certain property, pursuant to Minnesota Statute § 414.032,
Subdivision 1; and
WHEREAS, the County Board has cooperated and'assisted in the administration of
the Agreement according to the terms of the Agreement; and
WHEREAS, the parties desire to amend the Agreement; and
NOW, THEREFORE, BE IT RESOLVED by the City of Monticello, Wright
County, Minnesota, the Township of Monticello, Wright County, Minnesota, and the
County of Wright, Minnesota, that the Agreement is hereby amended as follows:
1. This amendment shall amend the Agreement as stated herein and all parties to this
amendment shall be bound by this amendment the same as if said amendment had
been incorporated into the text of the Agreement.
2. The City, Township and County Board hereby add the following paragraph to the.
existing Agreement:
16. Any property acquired as the result of such joint or cooperative exercise of
powers, and any surplus monies remaining with the Planning Board upon the
termination of the Planning Board shall be returned to the City, Township and County
in proportion to their respective contributions.
3. Upon approval by the respective governing bodies of the City, Township, and County
Board, this joint resolution and agreement shall confer jurisdiction upon the Office of
Strategic and Long -Range Planning ("State Planning") as successor to the Minnesota
Municipal Board so as to accomplish the orderly annexation of the lands described in
the Agreement in accordance with the Agreement.
4. Having provided for all of the conditions of its annexation within this document and the
Agreement, the parties to this agreement agree that no consideration by State Planning is
necessary.
5. The City, Township and County mutually state that no alteration by State Planning to
the OAA boundaries as described in the Agreement is appropriate or permitted.
