City Council Resolution 2001-70RESOLUTION NO. 2001-70
VACATING RIGHT-OF-WAY EASEMENT
WHEREAS, the Monticello City Council has determined to vacate a permanent right-of-
way easement in favor of the City of Monticello evidenced by a Quit Claim Deed dated
August 2, 1999, and recorded August 13, 1999, as Document No. 686931 in the Wright County
Recorder's office, and legally described in the attached Exhibit A; and
WHEREAS, the Monticello City Council held a public hearing at 7 p.m. on
October 22 , 2001, at the Monticello City Hall after proper published and posted notice
given by the City Clerk/Administrator on October 11 , 2001 and October 18 , 2001, and all
interested persons were given an opportunity to be heard, and
WHEREAS, the City Council believes it is in the City of Monticello's best interest to
vacate the permanent right-of-way easement; and
WHEREAS, four-fifths (4/5) of all City Council members concur in this resolution,
NOW, THEREFORE, the Monticello City Council resolves as follows:
1. The Monticello City Council vacates the right-of-way easement legally described
in the attached Exhibit A.

EXHIBIT A
Legal Description
A permanent easement for right-of-way purposes over, under and across that part of Lot 2, Block
1, SHINGOBEE SUBDIVISION, according to the recorded plat thereof, Wright County,
Minnesota, lying southerly of a line drawn easterly from a point on the westerly line of said Lot
distant 9.56 feet northeasterly from the most westerly corner of said Lot 2 to a point on the
southerly line of said Lot 2 distant 23.32 feet easterly from said most westerly corner of Lot 2.
