City Council Resolution 2000-69RESOLUTION NO. 2000-69 RESOLUTION DECLARING COST TO BE ASSESSED, ORDERING PREPARATION OF PROPOSED ASSESSMENT AND SETTING HEARING ON PROPOSED ASSESSMENT CSAH 75 IMPROVEMENT PROJECT NO. 98-17C WHEREAS, costs have been determined for the improvement of County State Aid Highway (CSAH) 75 from Hennepin Street to the CSAH 39/18 intersection by the construction of streets, utilities and appurtenant improvements and the contract price for such improvement is $1,982,114.40 and the expenses incurred or to be incurred in the making of such improvement amount to $554,992.03 so that the total cost of the improvement will be $2,327,310.71. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: The portion of the cost of such improvement to be paid by the City is hereby declared to be $503,263.57 and the portion of the cost to be assessed against benefitted property owners is declared to be $411,144.43. 2. Assessments shall be payable in equal annual installments extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January, 2002 and shall bear interest at the rate of 7.0% per annum from the date of the adoption of the assessment resolution. 3. The City Administrator with the assistance of the City Engineer, shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and the City Administrator shall file a copy of such proposed assessment in his office for public inspection. 4. The City Administrator upon the completion of such proposed assessment, notify the City Council thereof. 5. A hearing shall be held on the 23" day of October, 2000 in the City Hall at 7 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affect by such improvement will be given an opportunity to be heard with reference to such assessment. 6. The City Administrator is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 7. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may at any time thereafter, pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 3 l of the succeeding year. Adopted by the Monticello City Council this 25" day of September, 2000.
