City Council Ordinance 428CITY OF MONTICELLO, MINNESOTA WRIGHT COUNTY ORDINANCE NO. 428 AN ORDINANCE AMENDING SECTION 3-51).9 (0) OF THE MONTICELLO ZONING ORDINANCE. The City Council of the City of Monticello hereby ordains: Section 1: Title 10 Section 3-5 [D] 9(o) is hereby amended as follows: (o) CURBING AND LANDSCAPING: Except for single, two-family, and townhouse, all open off-street parking shall have a perimeter curb barrier around the entire parking lot, said curb barrier shall not be closer than six (6) feet to any lot line as measured from the lot line to the face of the curb. In addition, no parking area may be located upon a public drainage and/or utility easement adjoining a public street. Grass, plantings, or surfacing material shall be provided in all areas bordering the parking area. An exception to the setback requirement shall be granted in Business Districts where adjoining business provide for private cross access between parking lots. In such cases, driveway curb cuts up to 24 feet in width shall be permitted. Adjoining business properties may share full parking access of more than 24 feet with no curb barrier by Conditional Use Permit provided that: 1. The required landscaping and island areas within the shared parking lot meet the combined minimum as required by this Ordinance. 2. The parking lot meets the required setback at the perimeter of the parcels in questions. 3. The curb cut access locations to the parking lot(s) are approved by the City Engineer. 4. A shared access and maintenance agreement is provided by the property owners and recorded against all subject properties. Section 2: This Ordinance shall take effect and be in full force from and after its passage and publication. Adopted by the Monticello City Council this 22"d day of August, 2005.
