This ordinance provides for the application, administration, and enforcement of the Minnesota State Building Code by regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in the city of Monticello; provides for the issuance of permits and collection of fees thereof, provides penalties for violation thereof; repeals all ordinances and parts of ordinances that conflict therewith. 4-1-2: BUILDING CODE: The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B.59 to 16B.75, is hereby adopted as the building code for this jurisdiction. Such code, its supplements, amendments, additions, addenda, alterations, subtractions, and revisions as currently adopted and which may in the future be adopted and incorporated as part of the code, is hereby confirmed as the building code of the City of Monticello and hereby incorporated in this ordinance as if fully set out herein. The code shall be enforced within the incorporated limits ofthe City of Monticello, and any extra -territorial limits permitted by Minnesota Statute 1613.62, subdivision 1, when so established by this ordinance. , )rated, designated under a joint Powers Agreement entered into by the eity o Monticello and any other township /village /city kounty-. The code enforcement agency of this municipality is called the department of the eity I Monticello is called the Building eo Building Inspections Department. A Minnesota Certified Building Official must be appointed by the City Council of the City of Monticello to administer the code (Minnesota Statute 1613.65). 4-1-4: PERMITS AND FEES: (A) The issuance of permits and the collection of fees shall be as authorized in Minnesota Statute 1613.62, subdivision 1, and as provided for in chapter 1 ofthe 1994 1997 Uniform Building Code and Minnesota rules parts 1305.0106 and 1305.0107. (B) Permit fees assessed for work governed by this code shall be established by the City Council. (C) Surcharge: A surcharge fee shall be collected on all permits issued for work governed by this code in accordance with Minnesota Statute 1613.70. 4-1-5: FIRE ZONE DISTRICTS: All areas within the city of Monticello shall be in Fire Zone #3 . 4-1-6: VIOLATIONS AND PENALTIES: A violation of the code is a misdemeanor (Minnesota Statute 1613.69). 4-1-7: EFFECTIVE DATE OF ORDINANCE: The effective date of this ordinance shall be upon publication. 4-1-8: Prior to the installation by any person, corporation, or public agency, of a system of plumbing that serves any considerable number of persons, or any plumbing system that shall affect the public health in any manner, complete plans and specifications, together with any additional information that the Building Official may require, shall be submitted in duplicate and approved by the Building Official. The appraisal of the Building Official shall reflect the degree to which these plans and specifications affect the public health and conform to the provisions of the Minnesota Plumbing Code. No constructions shall proceed except in accordance with the approved plans. Any alteration or extension of an existing plumbing system shall be subject to these same requirements. Every provision contained in this code, except as modified or amended by this ordinance, is hereby adopted and made a part of this ordinance as if fully set forth herein. 5-1-2 ENFORCEMENT: (A) The Chief of the Fire Department serving the City or the his representative authorized by him the Chief shall enforce the provisions of this ordinance. (B) The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department may recommend the employment of technical inspectors who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and nonmembers of the Fire Department, and appointments made after examination shall be for an indefinite term with removal only for cause. 5-1-3: DEFINITIONS: (A) Wherever the word "jurisdiction" is used in the Minnesota Uniform State Fire Code, it shall be held to mean the City of Monticello. (B) Wherever the term "Corporation Counsel" is used in the Minnesota Uniform Fire Code, it shall be held to mean the attorney for the City of Monticello. .. - - ON -, - - - - : : :..:. : :.• : :1 1- .-- 11111 P III Po-Mrwm I MOM .. .. . �Q. \•W Pil��■MW-11Ill L%-WA�l�D]�l�WJL_W1WWAWJ��i�LMJ•M�A7�•O"WO80 •ice -WE :••: • •- -: i : -.T ; - ; - • : --lill--- ••; -- �. - - ; 5-1-9: PENALTIES: (A) Any person who shall violate any of the provisions of this code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction within the time fixed herein shall severally for each and every such violation and noncompliance respectively be guilty of a misdemeanor punishable by a fine of not exceeding $300 and b The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense. (B) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. 5-1-10: REPEAL OF CONFLICTING ORDINANCES: All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed.
