City Council Resolution 1997-18RESOLUTION 97-18 RESOLUTION ACCEPTING PETITION, ORDERING PREPARATION OF FEASIBILITY STUDY, ACCEPTING FEASIBILITY STUDY, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS KLEIN FARMS 4TH ADDITION (ALSO KNOWN AS KLEIN FARMS 3RD ADDITION, PHASE II) BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. A certain petition requesting the improvement of Klein Farms 4th residential subdivision (also known as HIein Farms 3rd Addition, phase II), said improvement consists of road, sanitary sewer, water, and storm sewer improvements, filed with the Council on May 27, 1997, is hereby declared to be signed by 100% of the owners of property affected thereby. This declaration is made in conformity to Minnesota Statutes, Section 429.035. 2. The petition is hereby referred to Bret Weiss of WSB & Associates, Inc., and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended. WHEREAS, pursuant to a resolution of the Council adopted May 27, 1997, a report has been prepared by Bret Weiss of WSB & Associates, Inc., with reference to the improvement of the HIein Farms 4th residential subdivision, and this report was received by the Council on May 27, 1997; and WHEREAS, the report provides information regarding whether the proposed project is necessary, cost-effective, and feasible; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: Bret Weiss of WSB & Associates, Inc., is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvement contingent on the developer (Anthony Emmerich) providing deposits equal to the cost to prepare plans and specifications.
