CITY OF MONTICELLO ~~

WHEREAS, the State of Minnesota, Department of Transportation, proposes to make
improvements to Trunk Highway No. 25 from Kjellberg Trailer Court entrance to the I-94
south ramp terminal and on Chelsea Road from Cedar Street to Sandberg Road within the
corporate city limits; and
WHEREAS, MN/DOT, in conjunction with the CITY, has determined that it is in the best
interest of MN/DOT and the CITY to construct the highway improvement project; and
WHEREAS, MN/DOT has scheduled this highway project for a proposed 19981etting and
requires the CITY's assistance to meet this letting date; and
WHEREAS, MN/DOT and the CITY are empowered to enter into Joint Powers agreements
pursuant to Minnesota Statutes, Section 471.59, subdivision 10 (1994);
WHEREAS, MN/DOT, in conjunction with the CITY, has further determined that the CITY
will acquire private property needed to construct the highway improvement project.
NOW, THEREFORE, BE IT RESOLVED that the City of Monticello, Minnesota, enter into a
joint powers agreement with the State of Minnesota, Department of'I~ansportation, to
provide for the City to manage and initiate the acquisition through direct purchase of private
property and perform real estate work tasks necessary to acquire needed property, including
but not limited to title work, appraisal, surveying, and legal description, and for MN/DOT to
reimburse the City for costs associated with the acquisition of properties and all services
provided pursuant to this agreement not to exceed $300,000.00.
