MINNESOTA
A regular meeting of the City Council of the City of Monticello, Minnesota, was
called to order by Mayor William Fair at 7 p.m. in the council chambers of the
Monticello City Hall, Monticello, Minnesota, on August 25, 1997. The following
Council members were present: William Fair, Roger Carlson, Brian Stumpf, Clint
Herbst; the following Council members were absent: Bruce Thielen.
A motion to adopt the following resolution was made by Roger Carlson and
seconded by Brian Stumpf.
RESOLUTION 97-44
RESOLUTION AUTHORIZING CONDEMNATION
OF PROPERTY FOR HIGHWAY 25 IMPROVEMENT
WHEREAS, the City of Monticello and the Minnesota Department of
Transportation (MN/DOT) have entered into an agreement for the improvement of
Highway 25; and
WHEREAS, the aforementioned agreement requires the City to acquire such right-
of-way as may be necessary to improve Highway 25; and
WHEREAS, it has come to the attention of the City Council of the City of Monticello
that the property described on Exhibit A attached hereto is necessary for the
upgrade and improvement of Highway 25; and
WHEREAS, the City has determined that the improvement of Highway 25 is for a
public purpose;
NOW, THEREFORE, it is hereby resolved:
1. The City staff, including the City Attorney and such other staff as may be
necessary, is hereby directed to proceed with the acquisition of the property
attached as Exhibit A; and
2. Acquisition of the property described in Exhibit A is for a public purpose and
in furtherance of a public purpose, namely the upgrade and improvement of
Highway 25 through the City of Monticello; and

The City shall proceed by quick take if, in the reasonable judgment of the
City Attorney and City Administrator, such procedure is reasonably
necessary for the timely completion of the Highway 25 improvement project.
The following Council members voted in favor: William Fair, Roger Carlson, Brian
Stumpf, Clint Herbst. The following Council members voted against: None. The
following Council members were absent: Bruce Thielen. Whereupon the motion
was declared duly passed and executed.
