City Council Resolution 1994-27BRESOLUTION 94- 27B RESOLUTION OF EASEMENT VACATION Following a public hearing held on the 25th of July, 1994, at 7 p.m., at the Monticello City Hall, the City Council for the City of Monticello considered the vacation of 900 sq ft of easement located in the formerly vacated right-of-way known as Cedar Street. Said vacation of the City's easement rights is contained in that parcel of property described as follows: Parcel A --That part of the Drainage and Utility Easement over the southeasterly 60.00 feet of Lot 3, Block 1, MONTICELLO I-94 TRI PLAZA, according to the recorded plat thereof, Wright County, Minnesota, lying northwesterly of the southeasterly 45.00 feet of said Lot 3. Following discussion, the Monticello City Council voted unanimously in favor of vacating the City's easement rights to Parcel A above. NOW, THEREFORE, in consideration of entering into an agreement accepting future liability for future costs associated with replacing site improvements impacted by future city improvements constructed in the remaining easement area, the City of Monticello, Grantor, hereby releases forever and quit claims to Grantee, and to his successors and assigns, all the right, title, interest, estate, claim and demand, both at law and in equity, of the Grantor, of, in and to all that real property described above as Parcel A, located in Wright County, Minnesota, together with all improvements, ways, easements, right, privileges and appurtenances held or owned by or of Grantor in Parcel A. TO HAVE AND TO HOLD all of Parcel A, together with the appurtenances belonging thereto to Grantee, and his successors and assigns forever. IN WITNESS WHEREOF, the Grantor has executed and delivered this resolution as of this 25th day of July, 1994.
