RESOLUTION ACCEPTING BID,
AWARDING CONTRACT, AND ORDERING IMPROVEMENTS
FOR PROJECT 92-02 (SCHOOL BOULEVARD) AND
PROJECT 92-07
(PHASE II OF CARDINAL HILLS RESIDENTIAL SUBDIVISION)
WHEREAS, a resolution of the City Council adopted the 23rd day of
March, 1992, fixed a date for a Council hearing on the proposed
improvement of School Boulevard between Fallon Avenue and Wright
County Road 118 (Project 92-02, School Boulevard); and
WHEREAS, ten days' mailed notice and two weeks' published notice of
the hearing was given, and the hearing was held thereon on the 11th
day of May, 1992, regarding improvement project 92-02 (School
Boulevard) , at which all persons desiring to be heard were given an
opportunity to heard thereon; and
WHEREAS, a public hearing was not necessary on improvement project
92-07 (Cardinal Hills) because the single property owner affected
has petitioned the City to complete the public improvement; and
WHEREAS, pursuant to an advertisement for bids for the improvement
of School Boulevard between Fallon Avenue and Wright County
Road 118 (project 92-02), bids were received, opened, and tabulated
according to law, and the attached bids were received complying
with the advertisement; and
WHEREAS, pursuant to an advertisement for bids for the improvements
to phase II of the Cardinal Hills residential subdivision (project
92-07), bids were received, opened, and tabulated according to law,
and the attached bids were received complying with the
advertisement; and
WHEREAS, it appears that Brown and Cris, Inc., of Lakeville is the
lowest responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MONTICELLO, MINNESOTA:
1. Subject to the completion of items outlined under item #4
below, Improvement projects 92-02 (School Boulevard) and 92-07
(Cardinal Hills phase II) are hereby ordered as proposed in
the Council resolution adopted this 11th day of May, 1992.
2. Subject to the completion of items outlined under item #4
below, the Mayor and Clerk are hereby authorized and directed
to enter into the attached contract with Brown and Cris of
Lakeville in the name of the City of Monticello for the
improvement of School Boulevard between Fallon Avenue and
Wright County Road 118 (project 92-02).

3. Subject to the completion of items outlined under item #4
below, the Mayor and Clerk are hereby authorized and directed
to enter into the attached contract with Brown and Cris of
Lakeville in the name of the City of Monticello for the
improvement of phase II of the Cardinal Hills residential
subdivision (project 92-07).
4a. Official recording of the final plat of phase II of the
Cardinal Hills residential subdivision and recording of the
associated development agreement.
4b. Execution of the terms of the development agreement governing
phase II of the Cardinal Hills residential subdivision.
4c. City acquisition of title to the School Boulevard right-of-
way.
5. The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids,
except that the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been
signed.
