City Council Ordinance 298ORDINANCE AMENDMENT NO. 298 City of Monticello Wright County, Minnesota AN ORDINANCE AMENDING TITLE 10, PORTIONS OF CHAPTERS 3 AND 4 AND CHAPTER 15A OF THE MONTICELLO ZONING ORDINANCE RELATING TO RENAMING THE BC (BUSINESS CAMPUS) DISTRICT TO I - 1A (LIGHT INDUSTRIAL) ZONING DISTRICT, AND RELATING TO LOT COVERAGE IN THE I-lA DISTRICT. THE CITY COUNCIL OF THE CITY OF MONTICELLO, MINNESOTA, HEREBY ORDAINS AS FOLLOWS: Chapter 3, Section 3-2[K] 1 is amended to read as follows: [K] NOISE: 1. All noise shall be muffled so as not to be objectionable due to intermittence, beat frequency, or shrillness and as measured at any property line, shall not exceed the following intensity in relation to sound frequency: Chapter 3, Section 3-3 [C] is amended to read as follows: [C] All setback distances as listed in the table below shall be measured from the appropriate lot line and shall be required minimum distances. All off-street driveways and parking areas in the I-1, I -1A, and I-2 districts shall have a continuous, concrete, non -surmountable curb barrier. This requirement shall be modified only by the STALL, AISLE, AND DRIVEWAY DESIGN CONDITIONAL USE PERMIT as described in Section 3-5, Subd. [D] 9(s), or by a permit from the Zoning Administrator for a portion of the parking and driveway area which meets the following conditions: Chapter 3, Section 3-5 [D] 9(s)vi. is amended to read as follows: vi. This conditional use permit is allowed only in I-1, I -1A, and I-2 zones. Chapter 3, Section 3-9 [E] 2 is amended to read as follows: 2. Within the PZM, B-1, B-2, B-3, B-4, I-1, I -1A, and I-2 districts, signs are subject to the following size and type regulations: Chapter 3, Section 3-9 [E] 2 (b) is amended to read as follows: (b) For buildings in which there are one (1) or two (2) business uses within the B-2, B-3, B-4, I-1, I -1A, and I-2 districts, and for buildings used for commercial retail activities located within a PZM district and located on property adjacent to B-2, B-3, B-4, I-1, I -1A, or I-2 districts, there shall be two (2) options for permitted signs, as listed below in 2(b)i and 2(b)ii. The property owner shall select one option, which shall control sign development on the property: Chapter 3, Section 3-12 [B] 5 (b) is amended to read as follows: b. All new antenna support structures for personal wireless communication system antennas shall be a single ground -mounted metal, concrete, or plastic composite (i.e., fiberglass, graphite fiber, etc.) pole. Such antenna support structures shall not exceed seventy- five (75) feet in height in Agricultural -Open Space (AO), Residential (R-1, R-2, R-3, R-4, and R -PUD), Performance Zone (PZR and PZM), and Business (B-1, B-2, B-3, and B-4) zoning districts, and shall not exceed one hundred sixty-five (165) feet in height in Industrial (I-1, I -1A, and I-2) zoning districts. Ordinance Amendment No. 298 Page 4 Chapter 4, Section 4-1[C] is amended to read as follows: [C] INDUSTRIAL DISTRICTS: 1. I-12 light industrial district 2. I4A, light industrial district* *Where this ordinance may refer to the BC, Business Campus District, such reference shall incorporate land zoned as I -1A, light industrial. 3. I-2, heavy industrial district Chapter 15A shall be renamed as I - 1A LIGHT INDUSTRIAL DISTRICT. Chapter 15A, Section 5A-5, shall be renamed as follows: 15A-5: I-lA Design and Site Plan Standards Chapter 15A, Section 1, shall be amended to read as follows: PURPOSE: The purpose of the I -1A, Light Industrial District, is to provide for the establishment of limited light industrial business offices, limited light manufacturing, wholesale showrooms and related uses in an environment which provides a high level of amenities, including landscaping, preservation of natural features, architectural controls, and other features. Chapter 15X Section 2, is amended to read as follows: PERMITTED USES: The following are permitted uses in an I-lA District: Chapter 15A, Section 3, is amended to read as follows: PERMITTED ACCESSORY USES: The following are permitted accessory uses in an I-lA District: Chapter 15A, Section 4, is amended to read as follows: CONDITIONAL USES: The following are conditional uses in an I-lA District: (Requires a conditional use permit based upon procedures set forth in and regulated by Chapter 22 of this ordinance.) Ordinance Amendment No. 298 Page 5 Chapter 15A, Sections 5 and 5[A], are amended to read as follows: 15A-5: I-lA DESIGN AND SITE PLAN STANDARDS: The following minimum requirements shall be observed in the "I -1A" District subject to additional requirements, exceptions, and modifications set forth in this chapter: [A] Lot Coverage: There shall be no minimum or maximum lot coverage requirements in this district. Chapter 15A, Section 5[B]2, is amended to read as follows: 2. In the I-lA District, all buildings constructed of curtain wall panels of finished steel, aluminum, or fiberglass shall be required to be faced with brick, wood, stone, architectural concrete case in place or pre -case panels on all wall surfaces. Chapter 15A, Section 5[E], is amended to read as follows: [E] Landscaping. A detailed landscaping plan in conformance with Chapter 3, Section 2[G], shall be submitted to the Council and approved before a building permit may be obtained. In addition to the requirements of Chapter 3, Section 2[G], all parcels developed along the boundary between the I-lA zone and a residential zone shall include planting of evergreens as a screen between the I-lA and R-1 uses. The evergreens planted shall be planted every 15 feet along the property boundary. This ordinance shall become effective from and after its passage and publication.
