City Council Ordinance 176ORDINANCE AMENDMENT NO. 176 THE CITY COUNCIL OF MONTICELLO HEREBY ORDAINS THAT SECTION 3-1 [J] OF THE MONTICELLO ZONING ORDINANCE PERTAINING TO ALTERATIONS OF NON -CONFORMING RESIDENTIAL UNITS BE AMENDED AS FOLLOWS: Chapter 3 GENERAL PROVISIONS [J] Alterations may be made to a building containing or related to a lawful non -conforming residential unit when said alteration will improve the livability thereof provided the alteration will not increase the number ofdwelling units. In the B-4 zone, alterations or expansion may be made to a building containing or related to a lawful non -conforming residential unit when said alteration or expansion will improve the livability thereof provided the alteration or expansion will not increase the number of dwelling units and provided that such alteration or expansion shall not constitute more than 50 percent of estimated market value. Said value shall be determined by City or County Assessor. All adjoining property owners and the Monticello HRA shall be provided notice of plans to expand non -conforming residential structure. Expansion may occur only after completion of a 30 -day notice period. Expansion of non -conforming residential structures is limited to one expansion after the date of June 12, 1989. All setbacks associated with residential structure expansion must meet R-1 yard requirements. Adopted this 12th day of June, 1989.
