Theuseofcommon-usedumpsterswasfirstdiscussedin2002.Atthattime,planswere preparedthatshowedthetwoenddelineatorislandsonthenorthsideofthemunicipal parkinglot,southofthealley,beingreconstructedtoprovidesurmountablecurband gutterontheendsoftheislandsfacingthedriveaisles,andtheuseofconcretewalkin thecenteroftheseislandstoallowthedumpsterstoberolledonandoffthem.Somesort ofscreeningfencewouldthenbeusedtoscreenthedumpsters. Whenthe2010StreetReconstructionprojectwasawardedtheplansincludedanalternate bidforreconstructingtheBlock35municipalparkinglot,includingreconstructingthe twoendislandstoaccommodatecommon-usedumpstersbasedonthe2002plans.Staff thencontactedthepropertyownersonblock35todeterminewhomightstillbeinterested inparticipatinginacommon-usedumpsterproject,whattheirexpectationsandneeds wereinregardstothedesignoftheimprovements,andwhattheirexpectationswerein regardstofundingtheimprovements. Beforeschedulingameetingwiththeinterestedpropertyowners,staffinventoriedthe existingdumpstersinuseonBlock35todeterminewhichbusinessesgeneratedthemost trashandrecycling,andhowmanydumpstersmightneedtobemovedintotheparking lot.Atotalofthirteendumpsterswerelocatedbehindthebusinesses.Itwasnotedthat severalbusinessesutilizedmultipledumpsterstodisposeoftheirtrashandrecycletheir paperandcardboard.ItwasalsonotedthatCornerstoneCaféneededtodisposeoftheir grease,andthattheyweretheonlybusinesswiththisneed. Ifallthirteendumpstersweretoberelocatedtotheparkinglottheywouldoccupyalarge area,therebyreducingthenumberofavailableparkingstalls.Itwasthereforediscussed thattheonlywaytosignificantlyreducethenumberofrequireddumpsterswouldbeto utilizeasinglesolidwastehaulerallowingdifferentbusinessestousethesamedumpster. Inaddition,itwasdeterminedthatifthedumpstersweretobeemptiedmultipletimesper week,itwouldallowthenumberandsizeofdumpsterstobefurtherreduced,thereby reducingthesizeoftherequiredconcretepadandscreeningfence,andminimizingthe numberofparkingstallsthatwouldbelost.Inordertomoveaheadwithcompletinga preliminarydesign,staffhadtomaketheassumptionthatusingasinglevendorwouldbe possible. CityCouncilAgenda:10/11/10 2 StaffthereforecontactedVeoliaEnvironmental,ourcurrentcontractedsolidwaste vendor,todeterminehowmanydumpsterswouldberequiredifallthebusinessesonthe blockweretoparticipate.Basedonthenumberofexistingdumpstersinuse,Veolia estimatedthatfivedumpsters(twofortrash,twoforpaperandcardboard,andonefor grease)wouldprobablybesufficienttohandletheneedsofthebusinessesthatare currentlyinterested.Veoliaalsonotedthatitwouldbebesttolocatethegreasedumpster awayfromtheotherdumpstersduetothesplatteringofgreasethatoccurswhenthe wastegreaseispouredfromthepailsintothedumpster.Veoliaalsoestimatedthatifwe addedenoughspaceintheenclosurefortwoadditionaldumpstersthereshouldbeample roominthefutureforallbusinessesontheblocktoparticipate. OnJuly26th,theCityCouncilprovideddirectionthatthedumpstersshouldbeenclosed inmasonrystructures,similartotheenclosurebehindBeefO’Brady’s.Stafftherefore modifiedourpreliminarydesignsbeforesubmittingthemtothreelocalcontractorsfor quotes. Afterreceivingthequotes,staffmetwiththeinterestedpropertyownerstoreviewthe draftenclosuredesignsandassociatedcosts.Twodesignswereoriginallyproposed. Onedesignusedtwoseparatestructures,oneoneachendofthelotasproposedin2002. Theotherdesignusedasinglestructuretoreducecostsbyreducingtheoverallwallarea. Bothdesignsincludednatural,rock-facedblockwhichcouldbepaintedtanbyCitystaff toallowforeasiermaintenance,includingtheremovalofgraffiti.Duringourmeetingwe receivedvariouscommentsfromtheinterestedpropertyownersandsubsequentlyrevised thedesignofthesingleenclosurepriortosolicitingnewquotes. Therevisedenclosuredesign,alongwithsignedpetitionsfromthefourinterested propertyownerswhoagreedtobeassessedfortheimprovements,wasthenpresentedto theCityCouncilonSeptember13th,alongwithaquotefortheimprovements.Atthat time,theinterestedpropertyownersrequestedthatthedesignbemodifiedagaintouse twodumpsterenclosures,oneateachendofthelotasoriginallyproposed,whichwould allowviewingoftheexistingsignageforbusinessesnorthofthealleybehindthe proposedsteelroof(whichstaffrecommendsbeeitherrustorcranberryincolor). Staffthereforerevisedthedesignagainandsolicitednewquotes,whichwillbepresented indetailwiththenextagendaitem.Thefinaldesignincludedtwoenclosurestructures locatedsouthoftheparkingdelineatorislandsonbothendsofthelot.Thedumpsterscan thenberolledoutandemptiedthroughtheendsalongthedriveaisles.Theenclosureon thewestendofthelotincludesa5’x6’separateroomforagreasedisposaldumpster. Gabledsteelroofswereagainspecifiedoversingle-slopetominimizetheroofheight. Bothenclosureswillbebufferedonthesouthandnorthsidesusingcurbedislandsto preventvehiclesfromaccidentallyhittingtheenclosures.Theseislandswillinclude stampedconcretepads,whichwillhaveseverallandscapeplantersplacedontheminthe spring.TheconcreteflatworkandplantersareproposedtobeprovidedbythePublic WorksDepartment. CityCouncilAgenda:10/11/10 3 Thequotereceivedforconstructingthetwomasonrydumpsterenclosuresshownin Figures1and2,includinggabledsteelroofs,lockablegates,andthereinforcedconcrete slabstosupportthestructures,totals$17,447.99.Abreakoutofthecostsforthe individualdesigncomponentsisincludedinthefollowingagendaitem. Thecontractorwhoprovidedthequotefortheenclosuresanticipatesthattheenclosures couldbecompletedbytheendofOctober,butthiswillneedtobeverifiedwiththe contractorfollowingawardofcontract.Whiletheparkinglotreconstructionworkwillbe nearlycompletebythetimetheenclosureconstructionbegins,thelotwassetupsothat theenclosurescanbeconstructedwithoutimpactingthepavingorcurbworkalready completed. AssessmentConsiderations: ShouldCouncilchoosetoawardacontractforthecommon-usedumpsterenclosure improvementswiththenextagendaitem,benefitingpropertyownerswillbeassessedfor theimprovements.Theamountofeachpropertyowner’sassessmentcouldbebasedon severalassessmentmethodologiesincluding: Equalshares–Thetotalcostfortheimprovementscouldbesplitequallyamong propertyowners,whichmaybejustifiedifyouconsiderthatbusinessescomeand goovertime. Usage-based–Thetotalcostfortheimprovementscouldbesplitamongthe propertyownersbasedontheircurrenttrashandrecyclingdisposalallocation,for whichwehavenumbers.Thiswouldincludetheresidentialpropertiesabovethe businesses. Someotherformula–Councilmaydirectstafftouseanothermethodtocalculate assessmentratesforeachofthepropertyownersbasedonfeedbackreceivedat tonight’spublichearing. ItisimportanttonotethatthereissomequestionastowhetherornottheCitycan assessunwillingpropertyownersforthisimprovementbecauseitisnot specificallylistedasaprojecteligibletobefundedviaanassessmentprogramin theStateStatutes.Itislikelythatapropertyownerchallengingtheassessment againsthis/herpropertywouldwin.IfCouncildesiresfullparticipationpriorto orderingtheproject,itshouldberequiredthateachpropertyownersignan assessmentagreement.ThereareatotaloftenpropertyownersonBlock35,with theCitybeingoneofthem.Atpresentweonlyknowoffourotherproperty ownersthatarewillingtobeassessedfortheimprovements.Thismeansthere mayonlybefivepropertyownersthatarewillingtobeassessed. ServiceContractConsiderations: Toguaranteethatallparticipantswillagreetouse,andcontinuetouse,thesamesolid wastevendor,theCitywillneedtoadministerthecontractwiththevendor.Thisalso meansthattheCitymayhavetoinvoicetheparticipatingbusinessesfortheirshareofthe service.AlthoughtheCityisnotcurrentlydoingthisforanycommercialproperties,in CityCouncilAgenda:10/11/10 4 thisinstancestaffthinksitcouldbedonewithminimaleffort.Inaddition,theenclosures willbeconstructedonCitypropertyunlikeothercommon-usetrashenclosuresinthe City,whichfurthersupportsourdesiretomanagethewastecontracttoensureproper maintenanceandcontractaccountability. IftheCityweretoberesponsibleforadministeringthecontract,staffwouldrecommend contractingwithVeoliaEnvironmentalServicessincewecontractwiththemonallofour othersolidwastecontracts.ItshouldbenotedthatVeoliadoesofferamaintenance serviceforcleaningtheenclosure,whichissomethingthePublicWorksDepartmentis notcurrentlyequippedorstaffedtodo.Preliminaryserviceandmaintenancecostswill beavailableattheCouncilmeeting. ItshouldbenotedthatstaffmetwithRobHolzerwithVeoliaEnvironmentaltodiscuss thecostsavingsassociatedwithusingcommon-usedumpsters.AccordingtoRob,there willbearealcostsavingstoanycustomerwhousescommon-usedumpsterareasfor multiplebusinesses.Robprovidedthefollowingexampletosupportthisstatement. Eachbusinesscurrentlyhirestheirownwastevendortoemptytheirrecyclingandtrash containers.Regardlessofwhotheyuse,ittypicallytakesaminimumof5minutesto drivetoandemptyeachbusinessescontainer.So,forthe10businessesonblock35 whichuseabout18-yardsofcapacity,andassumingthattheirdumpstersareallemptied onceperweek,itwouldtakeabout216minutespermonthtoemptytheircontainers.But ifthecontainerswereup-sizedbasedonanaverageneedof18yardsperweek,you wouldthenonlyneedthree3-yardcontainerstoaccommodatetheirneeds.Andifthe three3-yarddumpsterswerelocatedinacommonarea,itwouldonlytake10minutesto pickupthe3containers.Ifthethreecontainerswouldneedtobepickedup8.66times permonth,thenpickingupthesecontainerswouldonlytake87minutes.Assuminga truckanddrivercosts$75.00perhourtooperate,or$1.25perminute,thecostfor haulingthetrashfromacommon-useareawouldonlybe$108.75permonth,whereasif notusingacommon-useareathecostforhaulingthesameamountoftrashwouldbe $270.00permonth.Thisresultsinasavingsof$161.25permonthfortheblock,or $16.13permonthperbusiness.Inaddition,therearefewercontainerswhichfurther reducecostsforthehauler,andtaxesareless. Councilcouldconsiderthisasanon-residentialsolidwastecollectionpilotprojectfor Block35.Optionscouldincludebillingallparticipatingbusinessesastandardwaste collectionbaserateuptoacertainnumberofpoundspercubicyardofwaste,andthen theycouldbebilledforwhatevertheydisposeofoverthatweightlimitpercollection period.Anddependingonitssuccess,thisprogramcouldbeextendedoutsideofBlock 35ifthedemandwerethereforit,potentiallyresultinginsignificantcostsavingsforall participatingbusinesses,industries,andothernon-residentialuses Itshouldbenotedthatbusinessestypicallyenterintomulti-yearcontractswiththeir wastevendorssotheymayneedtowaitfortheirexistingcontractstoexpirebeforethey arewillingtosignupforthepilotprojectorbeassessedforthecommon-usedumpster enclosureimprovements. CityCouncilAgenda:10/11/10 5 A1.BudgetImpact:BasedonCouncil’spreviousmotionthecostofthedumpster enclosureimprovementswillbeassessedtotheprivatepropertyowners. However,therewillbesomecoststotheCityforadministeringthewastecontract andbillingthebusinesses,forpaintingandmaintainingthestructures,andfor plantingthelandscapeplanterseachspring. Onlyonequotewasreceivedinreturnfortheabove-referencedproject,whichwas openedonWednesday,October6,2010.Whileinsomecasesthismightcausesome concern,basedonthepreviousquotesreceivedforthisproject,(ofwhichtherewere severalduetothechangingdesignconsiderations)FullerConcreteandMasonryhad consistentlyreturnedthelowestquote.Inaddition,usingthepreviousquotesasbaselines thisquoteactuallycameinlowerthananticipated.Italsodidnotcomeasasurprisethat theothertwocontractorsdidnotsubmitquotesforthisfinaldesignastheydidn’tsubmit quotesasrequestedforthepreviousdesigneither. Mr.Flickerrecentlysentseveralemailsnotinghisconcernsovertheuseofthealleyasa two-wayfacility.Inhisemails,henotedthatthealleyshouldbesignedasaone-wayin fromTH25duetothenarrowwidthofthealley,andbecauseitisnotsafetopullout ontoTH25atanytimeoftheday. Overtheyearsstaffhasreceivedvaryingcommentsfromdowntownpropertyand businessowners,aswellasthetravelingpublic,onhowtobestregulatethedirectionof trafficindowntownalleysandatdrivewayentrances.Thesecommentstendedtodiffer basedonthetypeofbusinessanditsproximitytoTH25.Ultimately,duetothehigh trafficvolumesonTH25andthelimitedvisibilityatsomeofthealleyanddriveway entrances,therisksassociatedwithaccessingTH25atmid-blocklocationswillalways CityCouncilAgenda:10/11/10 2 behigh,nomatterwhichturningmovementsareallowed.Andtherisksassociatedwith left-inandleft-outmovementsareespeciallyhighsinceaccidentsassociatedwiththese movementsaretypicallymoresevere.ThisiswhyMn/DOTrequiresthatcertainaccess controlimprovementsbeimplementedwhencapacityimprovementsaremadealongtheir highways,includingaddingraisedconcretemediansbetweenintersectionstolimitmid- blockaccessestoright-in,right-outonlymovements.
