AttheJune27th meeting,Councilheldapublichearingtograntacablefranchiseto
BridgewaterTelephoneCompany,dbaTDSTelecom.UnderMNStateStatutesChapter
238,acablefranchiseagreementmustbepresentedforapprovalatleast7daysafterthe
publichearing.CouncilisbeingaskedtoadoptOrdinance#537whichoutlinesthecable
franchiseagreementbetweentheCityofMonticelloandBridgewaterTelephone/TDS
Telecom.
Inkeepingwiththestaterequirementthatnoagreementcanhavetermsandconditions
morefavorableorlessburdensomethananexistingagreement,CityAttorneyJoel
JamnikcraftedtheBridgewater/TDSCableFranchiseOrdinancetobealmostidenticalto
theCableFranchiseOrdinancesthatwereapprovedwithCharterCommunicationsand
FiberNetMonticello.
TheproposedordinanceoutlinestheabilityforTDSTelecomtobuildacablesystemand
offercableservice,setsafranchisetermofabout9years(expiresMarch29,2020),and
establishestheserviceareaasthecorporateboundariesoftheCity.Therearesections
describingthesystemcapacity,communityserviceprogramming,dropsandservicesto
publicbuildings,andprovisionsrelatedtofranchisefees.
TheCableFranchiseOrdinancewasreviewedbytheSherburneWrightCable
CommissionmembersattheAugust4th Commissionmeeting.CommissionAttorney
BobVoserecommendedseveralchangestothelanguage.Thosewereforwardedtoour
CityAttorneywhoworkedonmodificationsthatwereincorporatedintothefinal
ordinancedocument.
CouncilisalsoaskedtoadopttheSummaryOrdinance#537Awhichwillbeusedfor
publicationofthecablefranchiseordinanceasrequiredbylaw.Itshouldbenotedthata
summaryordinancerequiresasupermajority(4/5)voteofapproval.

1.ThisCableFranchiseOrdinance(“Franchise”)ismadeandenteredintobyandbetween
theCityofMonticello,amunicipalcorporationoftheStateofMinnesota(“City”)and
TDSBridgeWaterTelephoneCompanyd/b/aTDSTelecom(“TDS”).
2.PursuanttoMinnesotaStatutesChapter238,inparticular§238.08andCityOrdinance
No.419(“CableOrdinance”),theCityisauthorizedtograntandissueanon-exclusive
franchiseauthorizingTDStoprovidecableserviceandconstruct,operate,andmaintaina
cablesystemintheCitysubjecttoChapter238.
3.UponevaluationofTDS’stechnical,financial,legalqualifications,completionof
franchisenegotiations,andasaresultofapublichearing,theCityfindsthatitisinthe
bestinterestsoftheCityanditsresidentstograntandissuetheFranchisetoTDS.
4.ThisFranchiseisnonexclusiveandisintendedtocomplywithapplicablelawsand
regulations.AnyapplicablerequirementestablishedbyMinn.Stat.238.084orotherstate
orfederallawnotexpresslyincorporatedinthisFranchiseshallbedeemedincorporated
byreferenceasthoughfullysetforthherein.
5.ThisFranchiseisnotintendedtograntafranchisetoTDSontermsthataremore
favorableorlessburdensomethanthoseintheexistingcablefranchisewithCharter
Communications,FiberNet,oranyfuturefranchisee.ShouldCharterCommunications,
FiberNetoranyfuturefranchiseebelievethatanycablefranchiseissuedbytheCityis
morefavorableorlessburdensomethanthoseinanexistingfranchise,thatfranchisee
shallhavetherightprovidedbyOrdinance419topetitiontheCityCouncilforfranchise
amendmentstorelievethefranchiseeofprovisionsmakingitsfranchiselessfavorableor

SECTION2.GRANTOFFRANCHISE
Section2.1 Grant.
a.TDSisauthorizedtoerect,construct,operateandmaintainin,along,
across,above,overandundertherights-of-way,nowinexistenceandasmaybecreated
orestablishedduringthetermofthisFranchiseanypoles,wires,cable,underground
conduits,manholes,andotherconductorsandfixturesnecessaryforthemaintenanceand
operationofaCableSystemintheCity.NothinginthisFranchiseshallbeconstruedto
prohibitTDSfromofferinganyserviceoveritsCableSystemthatisnotprohibitedby
federal,stateorlocallaw.
b.ThisFranchiseisgrantedpursuanttotheCableOrdinance.Byaccepting
thisFranchise,TDSagreestobeboundbythetermsoftheCableOrdinanceandthis
Franchise.IntheeventofanyconflictbetweentheprovisionsofthisFranchiseandthe
CableOrdinance,theprovisionsofthisFranchiseshallgovern.
c.ThisFranchiseshallbenonexclusiveandCitymaygrantadditional
franchisesatanytime.TheCitywillnotgrantanadditionalfranchiseontermsand
conditionsmorefavorableorlessburdensomethanthoseinthisFranchise.TheCitymay
imposeadditionaltermsandconditionsinanyadditionalfranchise.
d.IntheeventtheCitygrantsanadditionalfranchisethatTDSbelievesis
morefavorableorlessburdensomethaninthisFranchise,TDSshallhavearightto

additionalfranchisearemorefavorableorlessburdensomethanits
existingFranchise;

Section2.2 FranchiseTerm.ThisFranchiseisgrantedforatermthatwillexpireon
March29,2020(the“ExpirationDate”),unlesssoonerrenewedorrevoked.TheExpiration
DatematchestheexpirationdatefortheotherfranchisedcableoperatorsintheCityanditisthe
City’sintenttoaddressfranchiserenewalrequestsofCharter,FiberNetandTDSatthesame
timepriortotheExpirationDate.AnyrenewalofthisFranchiseshallbeperformedin
accordancewithapplicablefederal,stateandlocallawsandregulations.Pursuantto47U.S.C.
546,TDSshallprovidenoticeofitsintenttoseekrenewalofthisFranchise36-30monthsprior
totheFranchiseExpirationDate.
Section2.3 ServiceArea.
a.ThisFranchiseisgrantedforthecorporateboundariesoftheCity,asit
existsfromtimetotime,subjecttothedensityrequirementofSection2.3.bbelow.The
CitywillnotifyTDSinwritingintheeventtheCityannexesanyareasthatTDSwillbe
requiredtoserve.
b.TDSwillextenditsCableSystemandoffercableservice,withina
reasonabletime,afterarequestforservice,toareaswithadensityofatleastnine(9)
residentialunitsperone-quarter(1/4)cablemileofsystem,asmeasuredfromthenearest
CableSystemtrunklineordistributioncableasofthedateofsuchrequestforservice.
Wherethedensityislessthanthatspecifiedabove,TDSmayrequirethatpersons
requestingservicepayaportionofthecostofthecapitalcostofthelineextensionin
advance.TDSshallprovideafreewrittenestimateofthetotalcostforextensionandthe
requiredpaymentamountwithinfifteen(15)daysoftherequestforservice.Thecharge
forinstallationorextensionforeachpersonrequestingserviceshallnotexceedaprorata
shareoftheactualcostofextendingtheservice.Subscribersshallalsoberesponsiblefor
anystandard/non-standardinstallationchargestoextendtheCableSystemfromthetapto
theresidence.
SECTION3.SYSTEM
Section3.1 SystemCapacity.TDScurrentlyoperatesandmaintainsa
communicationssystemwhichprovidestelecommunicationsandinformationservicesto
residentsandbusinesses(“TelecommunicationsNetwork”)withintheCitypursuanttoauthority
prescribedintheCertificateofNeedissuedbytheMinnesotaPublicUtilitiesCommission.
UtilizingitsTelecommunicationsNetwork,GranteeshallmaintainandoperatewithintheCity
anInternetProtocoltelevision(IPTV)applicationthroughwhich Internettelevision servicesare

deliveredusingthearchitectureandnetworkingmethodsof InternetProtocol overapacket-
switchednetworkinfrastructuresystem,generallyreferredtointhisFranchisehereinasa“Cable
System”providingaminimumofatleast75videoprogrammedchannelsthroughoutthetermof
thisFranchise.TheCableSystemmusthavereturncapabilityandpermit“narrowcasting”as
providedinSection4.2(c)unlesssufficientchannelsareavailableasspecifiedinthatSection.
TDSacknowledgesthatthisFranchiseisgrantedpursuanttoMinnesotaStatutesChapter238.
TDSagreestobeboundbyChapter238unlesspreemptedbyapplicablestateorfederallaw.
Section3.2 ConstructionDeadline.ExceptforTDS’sCableSystemextension
obligationspursuanttoSection2.3,systemconstructionissubstantiallycomplete.Exceptas
otherwiserequiredbyaRight-ofWayOrdinance,TDSwillusebesteffortstocompleteany
CableSystemextensionandconstructionofnewfacilitiesfornewdevelopments
contemporaneouswithinstallationofotherutilities.TheCityshallprovidereasonableandtimely
advancewrittennoticeofthelocationofallnewdevelopmentstoTDS.
SECTION4.COMMUNITYSERVICES
Section4.1 CommercialVideoProgramming.TDSwillprovidebroadcategoriesof
videoprogramming,includingnews,sportsandentertainment.
Section4.2 PEGAccessFacilities.
a.AccessChannels.TDSmustdedicateaminimumoftwo(2)channelsfor
PEGAccessprogramming.Thetwo(2)PEGAccessChannelsmustbecablecastonthe
BasicCableServicetier.AllsubscriberswhoreceiveCableServicesofferedontheCable
SystemmustreceivethePEGAccessChannelsatnoadditionalcharge.Nothingherein
shalldiminishtheCity’srightstosecureadditionalchannelspursuanttoMinn.Stat.§
238.084,Subd.1(z),andapplicableFCCregulations.
b.ResponsibilityforPEGAccess.TheCitywilloperate,administer,and
managePEGAccessprogrammingpursuanttothisSection4.2.TheCitywillbe
responsibleforthechannelcurrentlyusedforpublicaccessprogramming.TheCitymay
delegateitsPEGAccessauthorityandresponsibilitiestotheCommission.TDS
acknowledgesthattheCommissionmaycoordinatetheexpenditureofFranchiseFees
andPEGCapitalFeesbyandamongtheCommission’smembermunicipalities.Nothing
hereinshallobligatetheCitytomakeequipmentorchannelsavailableforpublicaccess
programmingortoanyparticularprogrammer.
c.Narrowcast.IfinthefutureTDSservesareasoutsidetheCity,atleastone
(1)PEGAccessChannelmustpermittheCitytoprovide“narrowcast”programmingof
events;i.e.permitsaprogramtobecablecastonsuchchannelforviewingsolelybyCity
residentswhileresidentsinadjoiningtownshipsorcitiesservedbyTDSsimultaneously
viewotherprogrammingonthatchannel.ThisprovisionmaybewaivedbytheCityif
TDSprovidessufficientchannelstoallowallservedareastoviewallprogrammed
events.
d.LiveOrigination.TDSmustensurethatliveprogrammingmaybe
originatedandcablecastfromthepublicinstitutionalsiteslistedinExhibitAattached

heretoprovidedhowever,thatTDSshallonlyberequiredtopaythecostofthefirstone
hundredandfifty(150)feetofanynewsystemconstructionnecessarytopermitlive
originationatsuchsiteandshallnotberequiredtoprovideend-userequipment.TheCity
maydesignateadditionalliveprogrammingsites.TheCityshallpayanyadditional,
actualconstructioncostspriortoadditionalconstructionandshallberesponsibleforthe
provisionofend-userequipment.TDSmustensurethatthesystemmeetsthetechnical
standardsattachedheretoasExhibitBatallliveoriginationsites.TDSmustfurther
ensurethattheCitycan“narrowcast”programmingoriginatedfromallofthesites
designatedpursuanttothisparagraphunlessTDSprovidessufficientchannelstoallow
allservedareastoviewallprogrammedevents.
e.PEGAccessCapitalSupport.InadditiontotherequirementsofSection
4.2(a)-(d)above,theCitymayrequireTDStocollectandremitaPEGCapitalFeeofup
toeighty-fivecents($.85)persubscriber,permonthtosupportcommunityprogramming.
TDSshallremitsuchpaymentsonthesamescheduleastheFranchiseFee.Allamounts
paidshallbesubjecttoauditandrecomputationandacceptancethereofdoesnot
constituteanaccordthatamountspaidarecorrect.TDSmustbenotifiedinwritingonor
beforeOctober1stoftheamountofthePEGCapitalFeetobeeffectiveonJanuary1stof
thefollowingyear.IftheCityfailstoprovidethewrittennotificationrequiredhereinby

f.UseofPEGCapitalFee.TheCityandTDSagreethattheCitywill
expendthePEGCapitalFeessolelyforcapitalcosts(consistentwithGAAP)associated
withPEGAccess.HistoricallytheCityhasprovided,onanannualbasis,substantial
financialsupportforPEGAccessprogramming.InconsiderationforTDS’sobligationto
remitthePEGCapitalFee,theCityagreestoprovidefinancialsupportforPEGAccess
thatisequivalenttotheamountofPEGCapitalFeescollectedandprovidedtotheCity.
ByMarch31stofeachyear,theCityshallprovideTDSwithanannualreportofany
expendituresofthePEGAccessCapitalFeetoinsuresuchfeesareusedforcapitalcosts

requirementtoprovidematchingsupportforPEGAccess.Basedonthereport,TDSmay

SECTION5.ADMINISTRATIONPROVISIONS
Section5.1 FranchiseFee.
a.TDSshallpayaFranchiseFeetotheCityinanamountequaltofive
percent(5%)ofitsgrossrevenues.TDSshallremitFranchiseFeepaymentstotheCity
onaquarterlybasiswithin60daysofthecloseoftheprecedingcalendarquarter.
Paymentsshallbebasedongrossrevenuesgeneratedduringtheprecedingquarter.
b.EachFranchiseFeepaymentmustbeaccompaniedbyareportinform
reasonablyacceptabletoCitydetailingthecomputationofthepayment.Allamountspaid
aresubjecttoauditandrecomputationbytheCity,andacceptanceofanypaymentmust
notbeconstruedasanaccordthattheamountpaidisinfactthecorrectamount.In
accordancewithMinn.Stat.§541.05,anyactiontorecoverFranchiseFeesmustbe
commencedwithinsix(6)yearsofreceiptoftheFranchiseFeepaymentorduedatefor
suchpayment.

Section5.2 RulesofTDS.TDSmaypromulgatesuchrules,termsandconditions
governingtheconductofitsbusinessprovidedthatsuchrules,termsandconditionsmust
notbeinconflictwiththeprovisionsofthisFranchise,theCableOrdinance,or
applicablelawsorregulations.
SECTION6.INDEMNIFICATION,INSURANCE,BONDSANDSECURITYFUND
Section6.1 Indemnification.ByacceptanceofthisFranchise,TDSagreesto
indemnify,defend,andholdtheCityharmlessinaccordancewiththeCableOrdinance.
Section6.2 Insurance.AtthetimeofacceptanceofthisFranchise,TDSwillfilewith
theCityaCertificateofInsuranceinaccordancewiththeCableOrdinance.TDSmust
maintainsuchinsurancefortheentiretermofthisFranchise.TheinsuranceforTDSmay
bepurchasedandmaintainedjointlywiththeCity’sotherinsurancecoverage.
Section6.3 SecurityforPerformance.
a.AtthetimeofacceptanceofthisFranchise,TDSshalldelivertoCitya
performancebond,informandsubstanceacceptabletoCity,fromaNationalorState
bankapprovedbyCity,intheamountof$50,000.
b.TheperformancebondshallensureTDS’sfaithfulperformancein
accordancewiththetermsofthisFranchise,theCableOrdinance,andapplicablelaws
andregulations.AfterprovidingTDSwithnoticeandanopportunitytocurein
accordancewithSection14oftheCableOrdinance,theCitymaydrawonthe
performancebondintheeventTDSfailstocomplywithanylaw,ordinanceor
regulation,tocompensatetheCityforanydamagesorlosssufferedbytheCityasa
result,andfurtherguaranteeingpaymentbyTDSofclaims,liensandfeesduetheCity
whicharise.IntheeventthisFranchiseisrevokedortherightshereunderrelinquishedor
abandonedbyTDS,theCityisentitledtocollectanyresultantdamages,costsor
liabilitiesincurredbytheCity.
c.TheCityandTDSacknowledgethatitmaybedifficultorimpossibleto
accuratelyquantifyactualdamagesorlossessufferedbytheCityduetoaviolationor
unsatisfiedobligationunderthisFranchise,theCableOrdinance,orapplicablelawsor
regulations.Suchviolationsorunsatisfiedobligationsmay,however,bepresumedto
harmtheCityandthepublic’sinterest.Accordingly,theCitymay,initsreasonable
discretion,collectliquidateddamagesinanamountofuptoTwoHundredandFifty
Dollars($250.00)perviolationofanyprovisionofthisFranchise,theCableOrdinance,
orapplicablelawsorregulations.Eachviolationmaybeconsideredaseparateviolation
forwhichseparateliquidateddamagescanbeimposed.
d.IntheeventtheCitywillmakeanyclaimagainstthefund,theCitymust
complywithSection14oftheCableOrdinancegoverningenforcementofthisFranchise.

e.TheCity’srightshereinareinadditiontoallotherrightstheCitymay
haveandtheCity’sexerciseofsuchrightsdoesnotconstituteanexclusiveremedynor

Section6.4 ConstructionSecurity.
a.TDSshallcomplywithMinnesotaStatutes§574.26whenundertakingany
constructionprojectsorenteringintoanyconstructioncontracts.Anyperformanceor
paymentbondsobtainedshallnametheCityofMonticelloaswellasTDS.
b.IfTDSoranyofitscontractorsfailtoperforminaccordancewiththe
termsofthisFranchise,theCableOrdinance,andapplicablelawsandregulations,the
CitymaydrawontheperformancebondestablishedinSection6.3.IntheeventtheCity
willmakeanyclaimagainsttheperformancebond,theCitymustcomplywithSection14
oftheCableOrdinancegoverningenforcementofthisFranchise.
c.TheCity’srightspursuanttothisSectionareinadditiontoallotherrights
theCitymayhave.Anyactionwithrespecttothesecurityfunddoesnotconstitutean
exclusiveremedynorlimitanyotherright.
SECTION7.MISCELLANEOUSREQUIREMENTS
Section7.1 AmendmentofFranchiseOrdinance.TDSandtheCitymaymutually
agree,fromtimetotime,toamendthisFranchise.Anychanges,modificationsor
amendmentstothisFranchisemustbemadeinwriting,signedbytheCityandTDS.
NothinghereinisintendedtoexpandordiminishtherightsgiventoCityunderstatelaw.
TheCityreservesitslawfulrights,includingitspolicepowersandordinance-making
authority.
Section7.2 ForceMajeure.IntheeventTDS’sperformanceofthisFranchiseis
preventedduetoacausebeyonditsreasonablecontrol,suchfailuretoperformmustbe
excusedfortheperiodofsuchinabilitytoperform.
Section7.3 Severability.Ifanyterm,conditionorprovisionofthisFranchiseorthe
applicationthereoftoanypersonorcircumstanceisheld,toanyextent,invalid,
preemptedorunenforceable,theremainderandalltheterms,provisionsandconditions
hereinmust,inallotherrespects,continuetobeeffectiveprovidedthelossoftheinvalid,
preemptedorunenforceableprovisionsdonotsubstantiallyaltertheagreementbetween
theparties.Intheeventalaw,ruleorregulationissubsequentlyrepealed,rescinded,
amendedorotherwisechangedsothattheFranchiseprovisionwhichhadbeenheld
invalid,preemptedormodifiedisnolongerinconflicttherewith,suchFranchise
provisionwillreturntofullforceandeffectandthereafterbebindinguponthirty(30)
dayswrittennoticetoTDS.
Section7.4 NonenforcementbyCity.TDSisnotrelievedofitsobligationsto
complywiththisFranchiseortheCableOrdinanceduetoanyfailureordelayoftheCity
toenforcepromptcompliance.TheCityandTDSmayeachonlywaiveitsrightsby
expresslysostatinginwriting.

Section7.5 RightsCumulative.AlloftheCity’sandTDS’srightsandremedies
pursuanttothisFranchiseareinadditiontoandnotexclusiveofanyandallotherrightsand
remediesavailabletotheCityorTDS.
Section7.6 WorkPerformedbyOthers.AllobligationsofthisFranchiseapplyto
workperformedbyanyagent,subcontractororotherpersonperforminganyworkorserviceson
behalfofTDSpursuanttothisFranchisetotheextentapplicable,however,innoeventwillany
suchpersonobtainanyrightstomaintainandoperateaCableSystemorprovideCableService.
Section7.7 EntireAgreement.ThisFranchisesetsforththeentireagreement
betweenthepartiesrespectingthesubjectmatterhereof.Allagreements,covenants,
representations,andwarranties,expressandimplied,oralandwritten,ofthepartieswithregard
tothesubjectmatterhereofarecontainedherein.Nootheragreements,covenants,
representationsorwarranties,expressorimplied,oralorwritten,havebeenmadebyanypartyto
anotherwithrespecttothematterofthisFranchise.Allpriorandcontemporaneous
conversations,negotiations,possibleandallegedagreements,representations,covenantsand
warrantieswithrespecttothesubjectmatterhereofarewaived,mergedhereinandthereinand
aresupersededherebyandthereby.
Section7.8 TerminationandAbandonment.Notwithstandinganythingfoundin
Sections11.2,11.3(d),14.1or14.2oftheCableOrdinance,TDSshallnotberequiredto
removeitsTelecommunicationsNetworkortorelocatetheTelecommunicationsNetworkorany
portionthereof,ortosellanyright,titleandinterestinitsTelecommunicationsNetworktothe
City,asaresultofanytermination,revocationorforfeitureofthisFranchiseorabandonmentof
theCableSystemprovidedtheCableSystemorTelecommunicationsNetworkisbeingusedoris
usablebyTDSfortheprovisionofTelecommunicationsServicesorbroadbandservicesas
definedbyapplicablestateandfederallaw.TDSshallhavetherighttoterminatethisFranchise
uponninety(90)daysadvancewrittennoticetotheCity(“TerminationDate”)andanysuch
terminationshallnotimpactTDSrighttocontinuetheprovisionofTelecommunicationsservices
andbroadbandservicesovertheTelecommunicationsNetwork.IntheeventtheFranchiseis
terminated,TDSshallberesponsibletoremitpaymenttotheCityuptotheTerminationDatefor
allPEGfeesrequiredunderSection4.2andallfranchisefeesrequiredunderSection5.1.In
addition,ifTDSentersintoanybindingcommitmentswithFiberNetorCharterCommunications

A.REFERENCEANDBACKGROUND:
Thepreliminaryassessmentrollsforthe2011StreetReconstructionproject,includingArea
4BandWestRiverStreet,mustbeupdatedtoreflectpreviousCouncilmotionsregarding
coststobeassessed,includingtheconsiderationofusingactualconstructioncostsversus
estimatedorbidcostsinadoptingfinalassessmentrates,aswellasassessmentsrequiredfor
workperformedforprivatepropertyownersattheirrequest.
InaccordancewithMinnesotaStatute429,inordertobondforthisprojecttheCityCouncil
mustholdapublichearingpriortoawardingacontractforconstructionoftheimprovements.
AhearingwasconductedonFebruary28,2011forArea4BandWestRiverStreet.TheCity
Councilisalsorequiredtoconductanassessmenthearingatthecompletionoftheproject.
WrightCountyrequiresthatassessmentsbecertifiedtotheCountyAuditorbytheendof
Novemberforcollectiononnextyear’staxes.Thisdeadlinecanbemetbycallingforthe
assessmenthearingtobeheldattheOctober24,2011CityCouncilmeeting.Byconducting
theassessmenthearingonOctober24th,adequatetimeforpublicationandmailingofnotices
willbeprovidedtosatisfytherequirementsforpublicimprovementprojectsinaccordance
withMinnesotaStateStatutesChapter429.
Constructionoftheprojectisnotyetcomplete.However,allactualconstructioncostswillbe
calculatedandanyoutstandingprojectcostswillbeestimatedascloselyaspossiblepriorto
thehearinginordertomeettheassessmenthearingdeadlinesperStateStatute.
ThisprojectisinitiallybeingfundedthroughGeneralObligationbondswhichwillbepaid
backthroughacombinationoffundingsourcesincludingstateaidfunds;streetreconstruction
funds;stormsewer,sanitarysewerandwatertrunkfunds;andassessmentstoadjacent
benefitingproperties.
Benefitingresidentialpropertieswillbeassessedforstreetimprovementsusingflatratesfor
eachproperty,regardlessofthesizeorlocationofthepropertyorthenumberofaccesses.
TheresidentialassessmentratethatwaspreliminarilyapprovedbyCouncilwas$4,000per
property,whichreflectsa5%increaseoverthe2010StreetReconstructionprojectassessment
rateof$3,800.Benefitingnon-residentialpropertieswillbeassessedforstreetimprovements
onafront-footbasis.Thenon-residentialratepreliminarilyapprovedbyCouncilwas$80per
frontfootforstreetimprovementsand$12perfrontfootforsidewalkimprovements,which
aretheCity’scurrentstandardnon-residentialrates.
Uponapprovingthepreliminaryassessmentrates,Councilnotedthattheymaywishto
considerreducingthefinalassessmentratesifconstructioncostscameinlowerthanthe
engineer’sestimate.StaffplanstoaddressthiswithCouncilatthehearing.

Regardingnon-residentialrates,thepreliminaryrateof$80perfrontfoothasbeenusedon
numerousprojectsinrecentyearssostaffbelievesthisrateisreasonable.However,because
thisprojectreceivedfavorablebidsstaffwillreviewthisratebeforetheassessmenthearingto
makesureitinfactremainsreasonable.
TheimprovementsthatweremadetoWest7th StreetbetweenTH25andLocustStreetarenot
beingassessedsoalthoughtheseimprovementswerepartofthe2011StreetReconstruction
projecttheydonotrequireanassessmentrollandwillthereforenotbeaddressedduringthe
publichearing.
SeveralprivatepropertyownersrequestedtheCity’scontractortocompleteadditionalwork

WHEREAS, West Metro Auto Dealership has requested an Amendment to Planned Unit
Development for West Metro Auto Dealership, legally described as Lot 1, Block 2 of the
Carcone Addition; and
WHEREAS, in accordance with this application, the Planning Commission has found it
appropriate to review the City’s previous approval of the Conditional Use Permit for Planned
Unit Development; and
WHEREAS, the Planning Commission has reviewed the application for Amendment to
Conditional Use Permit pursuant to the regulations of the Monticello Zoning Ordinance; and

WHEREAS, the Planning Commission has considered all of the comments and the staff report,
which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following Findings
of Fact in relation to the recommendation of approval:
1. The application is consistent with the 2008 Monticello Comprehensive Plan for Places to
Shop.
2. The applications are consistent with the Monticello Zoning Ordinances regulating the B-2
(Highway Business) District, the Planned Unit Development and Conditional Use Permit,
subject to conditions as outlined.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of
Monticello, Minnesota:
1. Pursuant to Minn. Stat. §462.357, the application for Amendment to Conditional Use
Permit for Planned Unit Development is hereby recommended to the City Council for
approval.
2. The recommendation for approval is subject to those Conditions as follows:
a) The proposed car wash shall be for the private use of West Metro Auto Dealership
and shall not be made available for the use of the general public without approval of a
new amendment to the Planned Unit Development.
b) The entire area shall have a drainage system which is subject to the approval of the
Community Development Department.
c) All lighting shall be in compliance with Section 4.4 of the Monticello Zoning
Ordinance.
d) Intermittent sounds produced by car wash operation such as the sound of a vacuum,
dryer system, or warning signal shall not be audible to adjoining residential.

5. Public Hearing: Consideration of a preliminary plat for Carcone Addition (formerly
Monticello Ford). Applicant: Chrysler Financial (NAC)
REFERENCE AND BACKGROUND
Jacob Holdings, a parent/financial company of Denny Hecker, is seeking preliminary plat
of nineteen (19) properties located north of Chelsea Road, south of Interstate 94, east of
Marvin Road and west of Highway 25. These properties, referred to as the Carcone
Addition, are comprised of West Metro Buick Pontiac GMC, the former Monticello Ford,
the former Dunlo Motors (currently West Metro expansion site), and the former
Monticello Ford sales/storage lot. The submitted preliminary plat indicates that the
current 19 properties are proposed to be consolidated into four (4) properties.
The properties are located in the B-3, Highway Business District and total approximately
14.17 acres. It should be noted that the Playhouse Child Care property located within this
vicinity is not included in this preliminary plat.
Previous applications have been processed with these properties throughout the past ten
years including, but not limited to;
Planned unit development (PUD) approval,
Conditional use permits (CUP) for outdoor sales and car wash,
Variances to the sign ordinance, minimum building size requirements for auto
sales, allow directional signage in the right-of-way
PUD amendments to allow off-site auto sales/storage lot, larger electronic
signage, expansion of auto sales/storage lot
Interim use permit (IUP) to accommodate temporary automobile display and
storage
IUP amendment for temporary automobile storage
For the purposes of this preliminary plat, each proposed property is listed below with
various development review criteria analyzed for each. In all cases, any existing internal
drainage and utility easements shall be vacated to accommodate the proposed preliminary
plat. This vacation is intended to be processed in a parallel action concurrent with the
Final Plat.
The proposed application indicates reestablishing one (1) thirty (30) foot drainage and
utility corridor running east/west through Lot 2, Block 2 between Lot 1, Block 2 and the
Playhouse Child Care facility and any easements at the property lines.
In the material that follows, a summary of the site conditions on each of the four
proposed parcels is provided. Following that, a consolidation of the issues to address as
part of the Plat request is included as a part of the Alternative Actions section of the
report.

ALTERNATIVE ACTIONS

and 2 of Block 1 and Lots 1 and 2 of Block 2, along with an amendment to the Planned
Unit Development permits for the subject parcels, with one of the following options.
Each of the approval options would include the incorporation of the conditions listed in
Exhibit Z.
a. Approve preliminary plat and PUD amendment, and bring all signage into
compliance, as well as the previously required buffering adjacent to the Daycare
building as noted above.
b. Approve the preliminary plat and PUD amendment, incorporating all of the
existing signage and current site conditions into the revised PUD approval.
c. Approve the preliminary plat and PUD amendment, requiring compliance with
signage and site conditions as enumerated by the Planning Commission following the
public hearing.
2. Motion to recommend denial of the preliminary plat of the Carcone Addition for Lots 1
and 2 of Block 1 and Lots 1 and 2 of Block 2, due findings to be identified following the
public hearing.
STAFF RECOMMENDATIONS
Planning staff recommends approval of the Preliminary Plat and PUD Amendment under Option
1.a. above, specifying that existing signage be brought into conformance with the current sign
regulations, and reinstatement of the required landscaped buffer between the Sandberg Road
expansion site of West Metro and the Daycare building. It appears from staff’s review of the
available file information that a significant amount of signage has been added to the site,
including temporary signage, that was not part of any previous PUD approval.
Since the time of the last approval, the City has revised its Sign regulations to increase flexibility
for business signage in the area. As such, the removal of temporary signage and a current banner
would be very close to meeting the current requirements. It should be noted that these estimates
are based on the staff’s analysis of the available submissions by the applicant, which do not

include detailed site plan conditions nor detailed architectural dimensions. Planning staff’s
recommendation includes the incorporation of the additional conditions stated in Exhibit Z.
The Planning Commission should choose between Options 1.a., 1.b., or 1.c. if a recommendation
of approval is the preferred course of action. If Option 1.c. is chosen, a specific list as to which
improvements are or are not required should be made.
If a denial recommendation is forthcoming under Option 2, the Planning Commission should
specify its Findings of Fact supporting the denial recommendation.

AttheAugust22,2011meeting,Counciladoptedaresolutioncallingforthesaleof
GeneralObligationRefundingBonds,Series2011A.Thepurposeofthebondsisto
refundtheCity’sG.O.Bonds,Series2005A,whichiscallableonFebruary1,2014.The
Citywouldbedoingwhatisreferredtoasanadvancerefundingtotakeadvantageofthe
lowinterestrates.
TheCityusedEhlers&Associates,Inc.asFinancialAdvisorstohelpissuethisbond
sale.Ehlers&Associates,Inc.issuedtheOfficialStatementonbehalfoftheCityand
workedwiththeCitytoobtainabondratingfromMoody’sInvestorServices.Thefirst
fewpagesoftheOfficialStatementareattachedastheypertaintothebondissue.Acopy
ofthefullOfficialStatementisavailablebyrequesttothefinancedepartment.

authorizedtoactassuccessorRegistrar.TheCityagreestopaythereasonableandcustomary
chargesoftheRegistrarfortheservicesperformed.TheCityreservestherighttoremovethe
Registrarupon30days’noticeandupontheappointmentofasuccessorRegistrar,inwhichevent
thepredecessorRegistrarmustdeliverallcashandBondsinitspossessiontothesuccessor
RegistrarandmustdeliverthebondregistertothesuccessorRegistrar.Onorbeforeeachprincipal
orinterestduedate,withoutfurtherorderofthisCouncil,theCityFinanceDirectormusttransmitto
theRegistrarmoneyssufficientforthepaymentofallprincipalandinterestthendue.
2.05.Execution,AuthenticationandDelivery.TheBondswillbepreparedunderthe
directionoftheCityAdministratorandexecutedonbehalfoftheCitybythesignaturesofthe
MayorandtheCityAdministrator,providedthatthosesignaturesmaybeprinted,engravedor
lithographedfacsimilesoftheoriginals.Ifanofficerwhosesignatureorafacsimileofwhose
signatureappearsontheBondsceasestobesuchofficerbeforethedeliveryofaBond,that
signatureorfacsimilewillneverthelessbevalidandsufficientforallpurposes,thesameasifthe
officerhadremainedinofficeuntildelivery.Notwithstandingsuchexecution,aBondwillnotbe
validorobligatoryforanypurposeorentitledtoanysecurityorbenefitunderthisResolutionunless
anduntilacertificateofauthenticationontheBondhasbeendulyexecutedbythemanualsignature
ofanauthorizedrepresentativeoftheRegistrar.CertificatesofauthenticationondifferentBonds

4.02.Findings.Itisherebyfoundanddeterminedthatbaseduponinformationpresently
availablefromtheCity’sfinancialadvisers,theissuanceoftheBondswillresultinareductionof
debtservicecosttotheCityontheRefundedBonds,suchthatthepresentvalueofsuchdebtservice
orinterestcostsavings(the“Reduction”)isatleast3.00%ofthedebtserviceontheRefunded
Bonds.TheReduction,aftertheinclusionofallauthorizedexpensesofrefundinginthe
computationoftheeffectiveinterestrateontheBonds,isadequatetoauthorizetheissuanceofthe
BondsasprovidedbyMinnesotaStatutes,Section475.67,Subdivisions12and13.
4.03.ThemoneysintheDebtServiceAccountwillbeusedsolelytopaytheprincipalof
andinterestontheBondsoranyotherbondshereafterissuedandmadepayablefromtheFund.No
portionoftheproceedsoftheBondswillbeuseddirectlyorindirectlytoacquirehigheryielding
investmentsortoreplacefundswhichwereuseddirectlyorindirectlytoacquirehigheryielding
investments,except(i)forareasonabletemporaryperioduntilsuchproceedsareneededforthe
purposeforwhichtheBondswereissued,and(ii)inadditiontotheabove,inanamountnotgreater
thanthelesseroffivepercentoftheproceedsoftheBondsor$100,000.Tothiseffect,any
proceedsoftheBondsandanysumsfromtimetotimeheldintheFund(oranyotherCityaccount
whichwillbeusedtopayprincipalandinteresttobecomedueontheBonds)inexcessofamounts
whichundertheapplicablefederalarbitrageregulationsmaybeinvestedwithoutregardastoyield
willnotbeinvestedatayieldinexcessoftheapplicableyieldrestrictionsimposedbythearbitrage
regulationsonsuchinvestmentsaftertakingintoaccountanyapplicabletemporaryperiodsorminor
portionmadeavailableunderthefederalarbitrageregulations.Inaddition,theproceedsofthe
BondsandmoneyintheFundwillnotbeinvestedinobligationsordepositsissuedby,guaranteed
byorinsuredbytheUnitedStatesoranyagencyorinstrumentalitythereofifandtotheextentthat
suchinvestmentwouldcausetheBondstobefederallyguaranteedwithinthemeaningofSection
149(b)oftheInternalRevenueCodeof1986,asamended(the“Code”).
4.04.GeneralObligationPledge.Forthepromptandfullpaymentoftheprincipaland
interestontheBonds,asthesamerespectivelybecomedue,thefullfaith,creditandtaxingpowers
oftheCitywillbeandareherebyirrevocablypledged.IfthebalanceintheEscrowAccountor

DebtServiceAccountiseverinsufficienttopayallprincipalandinterestthendueontheBondsand
anyotherbondspayabletherefrom,thedeficiencywillbepromptlypaidoutofmoniesinthe
generalfundoftheCitywhichareavailableforsuchpurpose,andsuchgeneralfundmaybe
reimbursedwithorwithoutinterestfromtheEscrowAccountorDebtServiceAccountwhena
sufficientbalanceisavailabletherein.
4.05.CancellationofPriorLevyAfterRedemptionDate.Itisherebydeterminedthat
uponthedepositofProceedsandFundsintheEscrowAccount(assuchtermsaredefinedin
Section5hereof),anirrevocableappropriationtothedebtservicefundfortheRefundedBonds
maturingaftertheRedemptionDatewillhavebeenmadewithinthemeaningofSection475.61,
subdivision3oftheActandtheCityAdministratorisherebyauthorizedanddirectedtocertifysuch
facttoandrequesttheCountyAuditor/Treasurertocancelanyandalltaxleviesfortaxespayablein
2014andthereaftermadebytheresolutionauthorizingandapprovingtheRefundedBonds.
4.06.PledgeofTaxLevies.
(a)ToprovidemoneysforpaymentoftheprincipalandinterestontheBondsmaturing
aftertheRedemptionDate,thereisherebyleviedadirectannualirrepealableadvaloremtaxupon
allofthetaxablepropertyintheCitywhichwillbespreaduponthetaxrollsandcollectedwithand
aspartofothergeneraltaxesoftheCity.SuchtaxwillbecreditedtotheDebtServiceFundabove

5.01.AsofthedateofdeliveryofandpaymentfortheBondsproceedsoftheBonds,in

5.04.TheRefundedBondsmaturingonFebruary1,2013andthereafterwillberedeemed

andtheCityAdministratorareherebyauthorizedanddirectedtoexecuteonbehalfoftheCityan
escrowagreement(the“EscrowAgreement”)withtheEscrowAgentinsubstantiallytheformnow
onfilewiththeCityAdministrator.AllessentialtermsandconditionsoftheEscrowAgreement
includingpaymentbytheCityofreasonablechargesfortheservicesoftheEscrowAgent,are
herebyapprovedandadoptedandmadeapartofthisresolution,andtheCitycovenantsthatitwill
promptlyenforceallprovisionsthereofintheeventofdefaultthereunderbytheEscrowAgent.
Section6.AuthenticationofTranscript.
6.01.TheofficersoftheCityareauthorizedanddirectedtoprepareandfurnishtothe
PurchaserandtotheattorneysapprovingtheBonds,certifiedcopiesofproceedingsandrecordsof
theCityrelatingtotheBondsandtothefinancialconditionandaffairsoftheCity,andsuchother
certificates,affidavitsandtranscriptsasmayberequiredtoshowthefactswithintheirknowledgeor
asshownbythebooksandrecordsintheircustodyandundertheircontrol,relatingtothevalidity
andmarketabilityoftheBonds,andsuchinstruments,includinganyheretoforefurnished,willbe
deemedrepresentationsoftheCityastothefactsstatedtherein.
6.02.TheMayorandCityAdministratorareherebyauthorizedanddirectedtocertifythat
theyhaveexaminedtheOfficialStatementpreparedandcirculatedinconnectionwiththeissuance
andsaleoftheBondsandthattothebestoftheirknowledgeandbelieftheOfficialStatementisa
completeandaccuraterepresentationofthefactsandrepresentationsmadethereinasofthedateof
theOfficialStatement.
6.03.TheCityauthorizesthePurchasertoforwardtheamountofBondproceedsallocable
tothepaymentofissuanceexpenses(otherthanamountspayabletoKennedy&Graven,Chartered
asBondCounsel)toKleinBank,Chaska,ontheclosingdateforfurtherdistributionasdirectedby
theCity’sfinancialadviser,Ehlers&Associates,Inc.
Section7.TaxCovenant.
7.01.TheCitycovenantsandagreeswiththeholdersfromtimetotimeoftheBondsthat
itwillnottakeorpermittobetakenbyanyofitsofficers,employeesoragentsanyactionwhich
wouldcausetheinterestontheBondstobecomesubjecttotaxationundertheInternalRevenue
Codeof1986,asamended(the“Code”),andtheTreasuryRegulationspromulgatedthereunder,in
effectatthetimeofsuchactions,andthatitwilltakeorcauseitsofficers,employeesoragentsto
take,allaffirmativeactionwithinitspowerthatmaybenecessarytoensurethatsuchinterestwill
notbecomesubjecttotaxationundertheCodeandapplicableTreasuryRegulations,aspresently
existingorashereafteramendedandmadeapplicabletotheBonds.

7.02.TheCitywillcomplywithrequirementsnecessaryundertheCodetoestablishand
maintaintheexclusionfromgrossincomeoftheinterestontheBondsunderSection103ofthe

limitationsonamountsinvestedatayieldgreaterthantheyieldontheBonds,andtherebateof
excessinvestmentearningstotheUnitedStates.
7.03.TheCityfurthercovenantsnottousetheproceedsoftheBondsortocauseorpermit
themoranyofthemtobeused,insuchamannerastocausetheBondstobe“privateactivity
bonds”withinthemeaningofSections103and141through150oftheCode.
7.04.TheCitywilluseitsbesteffortstocomplywithanyfederalproceduralrequirements
whichmayapplyinordertoeffectuatethedesignationsmadebythissection.
Section8.Book-EntrySystem;LimitedObligationofCity.
8.01.TheBondswillbeinitiallyissuedintheformofaseparatesingletypewrittenor
printedfullyregisteredBondforeachofthematuritiessetforthinSection1.03hereof.Uponinitial
issuance,theownershipofeachsuchBondwillberegisteredintheregistrationbookskeptbythe

AnyPayingAgentorRegistrarsubsequentlyappointedbytheCitywithrespecttotheBondswill
agreetotakeallactionnecessaryforallrepresentationsoftheCityintheRepresentationletterwith
respecttotheRegistrarandPayingAgent,respectively,tobecompliedwithatalltimes.
8.04.TransfersOutsideBook-EntrySystem.IntheeventtheCity,byresolutionofthe
CityCouncil,determinesthatitisinthebestinterestsofthepersonshavingbeneficialinterest,in
theBondsthattheybeabletoobtainBondcertificates,theCitywillnotifyDTC,whereuponDTC
willnotifytheParticipants,oftheavailabilitythroughDTCofBondcertificates.Insucheventthe
Citywillissue,transferandexchangeBondcertificatesasrequestedbyDTCandanyother
registeredownersinaccordancewiththeprovisionsofthisResolution.DTCmaydetermineto
discontinueprovidingitsserviceswithrespecttotheBondsatanytimebygivingnoticetotheCity
anddischargingitsresponsibilitieswithrespecttheretounderapplicablelaw.Insuchevent,ifno
successorsecuritiesdepositoryisappointed,theCitywillissueandtheRegistrarwillauthenticate
Bondcertificatesinaccordancewiththisresolutionandtheprovisionshereofwillapplytothe
transfer,exchangeandmethodofpaymentthereof.
8.05.PaymentstoCede&Co.NotwithstandinganyotherprovisionofthisResolutionto
thecontrary,solongasaBondisregisteredinthenameofCede&Co.,asnomineeofDTC,
paymentswithrespecttoprincipalof,premium,ifany,andinterestontheBondandnoticeswith
respecttotheBondwillbemadeandgiven,respectivelyinthemannerprovidedinDTC’s
OperationalArrangements,assetforthintheRepresentationLetter.
Section9.ContinuingDisclosure.
9.01.TheCityherebycovenantsandagreesthatitwillcomplywithandcarryoutallof
theprovisionsoftheContinuingDisclosureCertificate.Notwithstandinganyotherprovisionofthis
Resolution,failureoftheCitytocomplywiththeContinuingDisclosureCertificatewillnotbe
consideredaneventofdefaultwithrespecttotheBonds;however,anyBondholdermaysuch
actionsasmaybenecessaryandappropriate,includingseekingmandateorspecificperformanceby

A RESOLUTION RECOMMENDING APPROVAL OF AMENDMENT TO THE
MONTICELLO COMPREHENSIVE PLAN AND THE CITY OF MONTICELLO
OFFICIAL ZONING MAP FOR THE REZONING FROM I-1 (LIGHT INDUSTRIAL)
TO B-4 (REGIONAL BUSINESS) FOR LOT 1, BLOCK 1,
MONTICELLO COMMERCE CENTER 5th ADDITION.
WHEREAS, Riverwood Bank has requested an Amendment to the Monticello Comprehensive
Plan Long Range Land Use Plan for the redesignation from Places to Work to Places to Shop,
and the Monticello Official Zoning Map for the rezoning of Lot 1, Block 1, Monticello
Commerce Center 5th Addition as legally described on the attached Exhibit A; and
WHEREAS, the Planning Commission has reviewed the application for Comprehensive Plan
amendment and rezoning pursuant to the regulations of the Monticello Zoning Ordinance; and
WHEREAS, the Planning Commission held a public hearing on September 6th, 2011 on the
applications and the applicant and members of the public were provided the opportunity to
present information to the Planning Commission; and
WHEREAS, the Planning Commission has considered all of the comments and the staff report,
which are incorporated by reference into the resolution; and
WHEREAS, the Planning Commission of the City of Monticello makes the following Findings
of Fact in relation to the recommendation of approval:
(a) The amendment and rezoning address the need resulting from a trend toward
commercial land uses in the area arising since the adoption of the
Comprehensive Plan;
(b) The proposed amendment and rezoning accommodate commercial uses which are
compatible with existing and proposed commercial uses surrounding the
subject property; the proposed design and land use is appropriate for the land
with adequate parking, green space, and expansion area for similar land uses;
and the proposed amendment will maintain or improve compatibility among
nearby existing and planned commercial uses and ensure efficient
development within the City;
(c) The proposed amendment and rezoning to a commercial land use designation and
zoning is consistent with the guiding principles of the Comprehensive Plan;
(d) The amendment and rezoning to a commercial land use designation and zoning
will result in a logical, orderly and predictable development pattern; and
(e) The proposed amendment and rezoning to a commercial land use designation and
zoning with the purpose of the Monticello Zoning ordinance.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of
Monticello, Minnesota:
1. Pursuant to Minn. Stat. §462.357, the application for Amendment to the Monticello
Comprehensive Plan, Long Range Land Use Plan and Amendment to the City of
Monticello Official Zoning Map for the Rezoning from I-1 (Light Industrial) to B-4
(Regional Business) for Lot 1, Block 1, Monticello Commerce Center 5th Addition is
hereby recommended to the City Council for approval.
ADOPTED this 6th day of September, by the Planning Commission of the City of
Monticello, Minnesota.

A.REFERENCEANDBACKGROUND:
Thepropertyownerat102CedarStreetrecentlyconstructedalandscaperetainingwall
behindthepublicsidewalkontheeastsideofCedarStreet,southofEastRiverStreet,
whichwasbeinginstalledwiththe2011StreetReconstructionproject.Theareabehind
thewallwasthenplantedwithvegetationbythepropertyowner.
PriortoinstallingthesidewalkalongCedarStreet,staffreviewedoptionsforconstructing
thesidewalkandgradingbehindittomatchintotheexistingground.Atthattimeitwas
notedthatthepropertyownerhadplantedagoodportionoftheboulevardareawithinthe
right-of-waywithvegetation,therebypreventingusfromslopingthegroundbackbehind
thesidewalkata3:1orshallowerslopetoallowforeaseofmaintenancewithout
impactingtheplantings.Seepicture#1attachedassupportingdata.
Oneoptionthatwasdiscussedwastoraisetheelevationofthesidewalk6”to12”by
constructingaconcreteboulevardimmediatelybehindthecurbata1:1slope.This
wouldhaveallowedustogradeamaintainableslopebehindthesidewalkwithout
encroachingintotheplantings,eventhoughtheyarewithinCityright-of-way.
Otheroptionswerealsobeingexploredwhenthepropertyowneraskedifhecouldinstall
ashortretainingwallbehindthesidewalktoallowhimtoextendhisplantingareaoutto
thebackofthewallbehindthesidewalk.Hesaidhewouldpayforandconstructthe
wall.Stafftoldthepropertyownerthatashortretainingwallwouldbeallowable.
Thatweekendthepropertyownererectedthewall.Seeattachedpictures2through5.As
canbeseen,thewallwasbuiltusingmini-retainingwallblockandwillthereforelikely
becomeamaintenanceissuefortheCitysincetheCitywillbeclearingthiswalkofsnow
andiceduringthewinterandoursnowremovalequipmentwilllikelyimpactthewall
fromtimetotime,eventuallycausingdamage.
Erectingretainingwalls,revisinggradesand/orinstallingplantingbedswithinCityright-
of-wayisnotallowedbyCityordinance.However,theCityhasapprovedsuchrequests
whenworkingonstreetreconstructionprojectsinthepastgiventhenumerousexisting
non-complianceissuesthatareencounteredontheseprojects.
Afterthewallwaserectedthepropertyownersaidhewasnotmadeawareoftheoptions
thattheCityhadandthoughthehadtoinstallthewallinordertopreventhavingaslope
behindthewalkthathewouldn’tbeabletomaintain.Heisthereforerequestingthatthe
Cityreimbursehimintheamountof$500(+/-)formaterialsusedtoconstructthewall.
Stafffeelstheoptionswewereexploringwerearticulatedtothepropertyowner,andthat
itwasmadeclearthatwehadotheroptionsavailabletousbesidesconstructinga

retainingwallinordertoestablishamaintainablebackslope.Assuch,staffdoesnot
recommendreimbursingthepropertyownerforthematerials.
ItshouldbenotedthatthepropertyownerdidnotprovideCitystaffwithanyplansfor
theproposedwallafterverbalapprovalwasprovided,andapermitwasneverpulled.

retainingwallat$500.
