REFERENCE AND BACKGROUND: The Building Committee and the City Council have discussed the idea of repainting the entire natatorium ceiling as a part of the improvement project currently underway. The decision from the Building Committee was to do what is in the scope of work and revisit the need to repaint within two years to coincide with a community center pool shutdown. It was brought to the attention of Ron Hackenmueller, Jeff O'Neill, Brian Weldon and Clint Herbst, during the sandblasting process, that the original paint on the ceiling was not applied per specifications and because of the improper application, large areas are flaking off and there is concern about applying the new paint over the old and its adherence to the ceiling. Councilmember Lloyd Hilgart and Joel Dunning from Wold can provide more information on the concerns this initial improper application has for the reliability of the new paint job. The cost from Ebert Construction to provide this work is $161,207.40. This is to do the remaining areas of the ceiling outside of the scope of work. As a point of note, the overhead and profit for Ebert is $300, for the Paint /sandblasting sub - contractor is $7,519.40 and there is no cost in this project to Wold Architect. Ebert indicated that the work would require an additional week past the current November 191h pool reopening to a new date of November 26`h. Joel Dunning from Wold Architect, will be at the Special Meeting to answer any questions the Council might have. Some concerns that have been voiced that the Council may want to discuss are; should Wold have recognized the need to repaint the entire ceiling during the investigative phase, is the City paying a premium for the work now as opposed to if it had been a part of the original scope of work or if we did it in the future as a stand -alone project, is it viable to continue with only the current scope of work around the perimeter and hold off on repainting the rest of the ceiling at a later date? Our attorneys have been notified to determine if there is any ability to go back to the original General Contractor, Donlar Construction, for damages because the specification were not followed. There is a ten year statute within claims must be made, and we are beyond that ten year limit, however, Tom Scott is looking into another avenue that might be pursued. We don't have enough information at this time to provide enough details, but will follow up with Council as information becomes available. Al. Budget Impact: As you will see on the Cost Analysis provide in your packet, that with the change orders currently approved and the addition of the roofing project, the contingency fund for this project is at just under $44,000. This leaves $117,421.40 not covered by the contingency budget for the project. This will require a review of other funding sources if the Council feels that the full ceiling should be repainted as a part of this project. Wayne Oberg will be in attendance at the meeting and can provide information on this. B. ALTERNATIVE ACTIONS: 1. To approve the change order in the amount of $161,207.40 and determine a funding source to cover the balance after the contingency is depleted. 2. To continue with the current scope of work and revisit repainting the ceiling at the some point in the future to coincide with a future pool shutdown. 3. Other options as discussed at this Special Meeting. C. STAFF RECOMMENDATIONS: This problem was found on Tuesday the 9th of October and therefore there was no opportunity to convene the Building Committee to discuss and provide recommendations to the City Council.
