RESOLUTION ON THE TERMINATION OR TRANSFER OF
4J. WORTH BRASIE TRUST AND LIBRARY OBLIGATION
WHEREAS, the City Council of Monticello, Minnesota previously approved
of a purchase agreement on October 22, 1979, with Monticello Independent
School District #882, to purchase Block 32 in the Townsite of Monticello,
contingent upon the City of Monticello agreeing to maintain and provide a
public library in the City of Monticello; and
WHEREAS, aforementioned purchase agreement stated the charitable
trust created by W. Worth Braise, if any therebe, be appropriately
resolved either by a District Court action which results in a judgment
terminating said trust or an opinion by the Office of the Attorney General,
the State of Minnesota, to the effect the same is not necessary.
NOW THEREFORE, BE IT RESOLVED, by the City Council of Monticello to
authorize Mayor Arve Grimsmo, City Administrator - Gary Wieber, and City
Attorney - Gary Pringle, to institute appropriate District Court proceed-
ings, joining with the Independent School District of Monticello (ISD #882)
to terminate or transfer the charitable trust created by W. Worth Braiie
and do all other acts reasonably necessary to transfer the obligation
of maintaining a public library from Independent School District #882
to the City of Monticello.

seconded by Ken Maus:
