IN AND FOR THE CITY OF MONTICELLO
RESOLUTION NO - 01-03
RESOLUTION DIRECTING STAFF TO PREPARE MATERIALS
TO AUTHORIZE ACQUISITION OF PROPERTY BY EMINENT DOMAIN
WHEREAS, the Housing and Redevelopment Authority in and fur the City of Monticello
("Authority ") is a public beady corporate and public, organized and operating pursuant to Minnesota
Statues, Sections 469.001 'to 469.047 (the `-Act "); dad
WHEREAS, the AuthoTjty has identified the need to acquire fee simple title to certain
real property located 41
within the City of Monticello (the "Property ") in furtherance of' the Authority's objectives under
the Act; and
WHEREAS, the Authority has been unable to obtain d negotiated agreement with The
owner of the Property.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
Housing and Redevelopment Authority in and for the City of Monucello:
1. The Board of Commissioners makes the following findings of fact:
a. The Authonty is authorized w undertake development and redevelopment
activities pursuant to the Act.
b. The Authority has identified the acquisition of the Property as necessary and
desirable and in accordance with the Authority's goals and objectives as set
forth in the Act and in its project plans prepared in accordance Therewith-
;
c. The Authority has been unable to reach a negotiated agreement for the
purchase of the Property.
d. The Authority is authorized by the Art to acquire properly through the
exercise of the power of eminent domain.
e. It is necessary, convenient, and reasonable and in the best interest of the
Authority and in furtherance of the health, safety, and welfare of the citizens
of the City of Monticello, Minnesota for the Authority to consider the
acquisition of the Property by eminent domain.

2. Authority staff and consultants are authorized and directed to prepare all
documents and materials and to take all other appropriate actions necessary and desirable for the
initiation of eminent domain proceedings against the Propeny and to present such documents and
materials to the Authority's Board of Commissioners for its consideration_
