Planning Commission Resolution 2016-008CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. PC- 2016 -008 RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE ESTABLISHING "ENTERTAINMENT/RECREATION, INDOOR COMMERCIAL" AS AN ALLOWED USE IN THE B -3, HIGHWAY BUSINESS DISTRICT WHEREAS, the applicant is proposing to occupy a portion of a building for the purposes of providing youth sports training; and WHEREAS, the subject property is zoned B -3, Highway Business, in which entertainment /recreation, indoor commercial facilities, including the proposed use, are not currently allowed as a land use; and WHEREAS, the proposed occupancy will not result in impacts to the site or to surrounding property; and WHEREAS, the proposed facility is consistent with the relevant general and conditional zoning requirements of the B -3 zoning district; and WHEREAS, the proposed use is consistent with the purpose and intent of the B -3, Highway Business zoning district; and WHEREAS, an amendment allowing Entertainment /Recreation, Indoor Commercial in the B -3 district would be consistent with neighboring uses in areas zoned as such; and WHEREAS, the Planning Commission held a public hearing to consider the matter at its regular meeting on May Yd, 2016 and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed use is consistent with the intent of the Monticello Comprehensive Plan. 2. The proposed use will meet the requirements of the Monticello Zoning Ordinance. 3. The proposed use will not create undue burdens on public systems, including streets and utilities. CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. PC- 2016 -008 4. The proposed use will not create substantial impacts, visual or otherwise, on neighboring land uses. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota that the proposed zoning ordinance amendment is hereby recommended for approval, subject to the following conditions: 1. Compliance with the terms of the zoning ordinance related to Entertainment /Recreation, Indoor Commercial uses, specifically: (a) No auctions shall take place on the premises. (b) Outdoor storage shall be prohibited. (c) Noise shall be controlled consistent with the standards of this ordinance. (d) When abutting a residential use, the property shall be screened with an aesthetic buffer (Table 4 -2, Buffer Type `B ") in accordance with section4.1(G) of this ordinance ADOPTED D this 3rd day of May, 2016, by the Planning Commission of the City of Monticello, Minnesota.
