Planning Commission Resolution 2016-015CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA PLANNING COMMISSION RESOLUTION NO. PC- 2016 -015 RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE REGULATING NON - COMMERCIAL SPEECH SIGNS WHEREAS, the City of Monticello has established zoning ordinances for the purpose of regulating the number, location, size, type, illumination and other physical characteristics of signs within the City in order to promote the public health, safety and welfare; and WHEREAS, the City of Monticello has established zoning ordinances for the purpose of maintaining, enhancing and improving the aesthetic environment of the City by preventing visual clutter that is harmful to the appearance of the community; and WHEREAS, the City of Monticello has established zoning ordinances for the purpose of improving the visual appearance of the City while providing for effective means of communication, consistent with constitutional guarantees and the City's goals of public safety and aesthetics; and WHERAS, the City of Monticello has found it necessary to review the zoning ordinance for regulations pertaining to non- commercial speech signage; and WHEREAS, the Planning Commission held a public hearing to consider the matter at its regular meeting on May 3rd, 2016 and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed amendment is consistent with the intent of the Monticello Comprehensive Plan. 2. The proposed amendment is consistent with the purpose and intent of the Monticello Zoning Ordinance. 3. The proposed amendment provides adequate means of expression, while protecting the City and its citizens from a proliferation of signs of a type, size, location and character that would adversely impact upon the aesthetics of the community and threaten the health, safety and welfare of the community. Time limitations are necessary to ensure that such temporary signs are regularly monitored, maintained, and replaced when necessary, in order to prevent deterioration from weather, vandalism, or other sources. 5. Unlimited periods of display are likely to lead to temporary signage which is no longer relevant to events, activities, or circumstances about which such signs are providing messages, creating unnecessary distractions to drivers on adjacent streets. 6. Size limitations are necessary to balance the need to accommodate opportunities for non - commercial and commercial speech, and to prevent confusion to drivers navigating busy roadways in commercial areas. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota that the proposed zoning ordinance amendment is hereby recommended for approval.
