Planning Commission Resolution 2016-031CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. PC- 2016 -031 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MONTICELLO RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE OPTING OUT OF THE REQUIREMENTS OF MN STAT SECTION 462.3593 WHEREAS, the Minnesota Legislature passed, and the Governor has signed, MN State 462.3593 requiring municipalities to provide for Temporary Family Health Care Dwellings; and WHEREAS, the statute provides for an opt -out, exempting the municipality from the requirements of the statute; and WHEREAS, the City of Monticello currently regulates accessory dwellings separately from the requirements of the statute; and WHEREAS, the Planning Commission held a public hearing to consider the matter at its regular meeting on August 10h, 2016 and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The proposed statutory requirements are not consistent with the intent of the Monticello Comprehensive Plan. 2. The proposed statute, if enacted, will not meet the requirements and intent of other sections of the Monticello Zoning Ordinance. 3. The ordinance will be inconsistent with the regulations and intent of the City for single family neighborhoods. 4. The proposed statutory provisions have the potential to create substantial impacts, visual or otherwise, on neighboring land uses or public property. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota that the proposed zoning ordinance amendment opting out of the requirements of MN Stat Section 462.3593 is hereby recommended for approval.
