Adjourn. 4 Planning Commission: 05/21/13 Public Hearing - Consideration of a request for Preliminary Plat and Final Plat for the Great River Addition, a commercial subdivision in a B -3 (Highway Business) District and R -3 (Medium - Density) Residential District. Applicant: City of Monticello and RiverWood Bank (NAC) Property: The property in question is approximately 27.4 acres in area, and occupies land between Minnesota Street and Elm Street, abutting the north boundary of Interstate 94. The property is bisected by the proposed extension of 7th Street between Minnesota and Elm Planning Case Number: 2013 -010 A. REFERENCE & BACKGROUND Request(s): Preliminary and Final Plat Deadline for Decision: NA Land Use Designation: Places to Shop Zoning Designation: B -3 (Highway Business) and R -3 (Medium Density Residential) The purpose of the "B -3" (highway business) district is to provide for limited commercial and service activities and provide for and limit the establishment of motor vehicle oriented or dependent commercial and service activities. The purpose of the "R -3" medium density residential district is to provide for medium density housing in multiple family structures ranging up to and including twelve (12) units and directly related, complementary uses. Current Site Use: Land subject to the plat is currently vacant, with the exception that a portion of the right of way is being acquired from the Monticello Village Apartments, a multiple family residential parcel. Surrounding Land Uses: North: R -3, Townhouses and Apartments East: B -3, Vacant and Shopping Center South: B -3 and B -4, Freeway, Automobile Dealerships West: B -3, RV Dealership and Residential Project Description: The project plats the various parcels (including a vacated portion of Minnesota Street) into an outlot for development along with the extension of the 7th Street right of way, a major planned collector roadway along the north side of I -94. The plat will also create an outlot for drainage and ponding, and an outlot for future re- combination or development. The extension of 7th Street through this section has been a long -time objective of the City, in an effort to provide a better circulation for local traffic, and help relieve freeway crossing pressure on the Highway 25 bridge and related intersections. The extension of West 7th St. between Minnesota and Elm is included in both the adopted Capital Improvement Plan (CIP) and the adopted Transportation Plan. The City has been working with the co- applicant property owners to obtain right of way, dedicate easements, and arrange for improvements to the street and utilities in terms of cost assessment. The design of the right of way is meandered to maximize developable area adjacent to Interstate 94, and also to retain adequate slopes and land area north of 7th Street for regional ponding (which also serves neighborhoods to the north). The design further includes a major pathway connection on the north side of the street. As the proposed plat creates only outlots at this time, future development will be dependent upon replatting and site planning, all of which will require details of specific development proposals. No immediate development is pending, however, the construction of the street and utility improvements is expected to facilitate interest in the land. Monticello Zoning Ordinance (Section 3.3) requires platting of outlots into legal lots and blocks in order to allow building improvements. Ordinance Requirements: Preliminary Plats require demonstration that the proposed lots meet the City's zoning and engineering standards. As noted above, the Great River Addition plat meets those requirements from an engineering standpoint, but zoning compliance will await a development proposal. Plat Standards The City must find that the Preliminary Plat meets the requirements and conditions of the City's codes and standards related to zoning and Comprehensive Plan. The requirements of the City's Subdivision Ordinance become applicable at the time the parcels are replatted into developable lots and blocks. The City must then find that the Final Plat is consistent with the terms of approval of the Preliminary Plat. In this case, both submitted documents agree, and subject to any changes required by the City Council, may be processed together. 2 B. ALTERNATIVE ACTIONS Decision 1: Resolution of Recommendation for Preliminary and Final Plat Approval 1. Motion to approve Resolution 2013 -032 recommending approval of the Preliminary and Final Plat for Great River Addition as submitted, based on the findings included in the resolution. 2. Motion to deny Resolution 2013 -032 recommending a Preliminary and Final Plat, based on findings to be made by the Planning Commission. 3. Motion to table action on the request, pending additional information as identified by the Planning Commission and staff report. C. STAFF RECOMMNDATION Staff recommends approval of the Preliminary Plat and Final Plat for Great River Addition. As noted in this report, the principal effect of the plat is to consolidate the various parcels into a development parcel, a regional pond, and the right of way necessary for the construction of West 7th Street, along with incidental outlots for purposes of transfer. WHEREAS, the City of Monticello and co- applicant property owners own certain land adjacent to, or in the area of, the planned 7th Street extension; and WHEREAS, it is beneficial to plat the land to establish the location and alignment of said 7th Street, and provide for its construction and improvement, and WHEREAS, the Preliminary Plat reflects the appropriate requirements for engineering, utilities, and future access; and WHEREAS, the Preliminary Plat provides for the development of the area consistent with the City's zoning ordinance and Comprehensive Plan; and WHEREAS, the proposed Final Plat is consistent with the Preliminary Plat as required by the Subdivision Ordinance; and WHEREAS, the Planning Commission has reviewed the Preliminary and Final Plats pursuant to the regulations of the Monticello Zoning Ordinance and Monticello Subdivision Ordinance; and WHEREAS, the Planning Commission held a public hearing on May 7th, 2013 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The application is consistent with the 2008 Monticello Comprehensive Plan for Places to Shop; and 2. The proposed plat will be able to meet the intent and specifics of the Zoning Ordinance; and 4 3. The plat is consistent with the requirements for subdivision according to the City's Subdivision Ordinance; and 4. The Final Plat is consistent with the Preliminary Plat as required by the Subdivision Ordinance; and 5. The plat will facilitate the beneficial use of the lands subject to the plat, as well as provide other improvements to the City's general welfare. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Monticello, Minnesota: 1. Pursuant to Minn. Stat. §462.358 and Chapter 11 of the Monticello City Code, the Preliminary Plat is recommended for approval by the City Council as submitted. 2.
