RESOILUUTION NO. 2016-040
VACATING ALL EXISTING DRAINAGE AND UTILITY EASEMENTS WITHIN THE
BOUNDARIES OF LOT I, BLOCK 1, OTTER CREEK 1sT ADDITION
WHEREAS, pursuant to Minnesota Statutes Section 4152.851, after two (2) weeks' published and
posted notice of the hearing and after mailing written notice of the hearing at least ten (10) days before
a hearing to each property owner affected by the proposed vacation; and
WHEREAS, a public hearing on the vacation of drainage, utility and access easements over and across
the following described property was held on June 27, 2016 at 6:30 p.m. at the Monticello City Hall;
All those drainage and utility easements lying within Lot 1, Block 1, OTTER CREEK
CROSSING 1sT ADDITION, dedicated in the plat of said OTTER CREEK CROSSING 1sT
ADDITION, according to the recorded plat thereof, Wright County, Minnesota
WHEREAS, the vacation and utility easement per the petition is conditioned on the reestablishment of
required easements on the final plat and proper documentation on the final recorded plat;
NO W THEREFORE, BE IT HEREBY RESOL VED BY THE CITY COUNCIL OF
MONTICELLO, MINNESOTA: that the above described drainage, utility and access easements are
vacated.
Adopted by the City Council of Monticello, Minnesota this 27h day of June, 2016.
