MINUTES MONTICELLO POLICE ADVISORY COMMISSION Wednesday, April 18, 2012 - 7 p.m., Academy Room Members Present: Brad Fyle, Jason Roubinek, Leila McCarty, Chuck Fradella Members Absent: Brian Stumpf Ex- Officio Representatives: Captain Dan Anselment, Wright County Sheriffs Office Lieutenant Todd Sandeen, Wright County Sheriffs Office Bruce Westby, City Engineer Others: None 1) Call to Order Brad Fyle called the meeting to order at 7 p.m. 2) Consideration of approving minutes of January 18, 2012 regular Police Advisory Commission meeting CHUCK FRADELLA MOVED TO APPROVE THE MINUTES OF THE JANUARY 18, 2012 REGULAR POLICE ADVISORY COMMISSION MEETING AS WRITTEN. MOTION WAS SECONDED BY LEILA MCCARTY. MOTION CARRIED 4 -0. 3) Consideration of adding items to the agenda No items were added. 4) Wright County Sheriff's Office updates/ Q &A session Captain Anselment introduced Lieutenant Todd Sandeen to the PAC. Lieutenant Sandeen has been with the WCSO for 17 years and will be attending future PAC meetings in place of Lieutenant Mike Even who recently retired. Captain Anselment discussed some recent issues they have had at Chatter's. The Sheriff s Office has been receiving a fair number of calls to Chatter's later in the evening. Many of the calls are coming in "after the fact" when fights or other issues are well over, making it hard on the Sheriffs Office to provide enforcement. The Sheriffs Office has been working with City staff in an attempt to schedule a meeting with Chatter's owner to discuss options for allowing the Sheriffs Office to provide better law enforcement services. Captain Anselment noted that the Sheriffs Office has training available on handling excessive alcohol use in bars and restaurants. Brad Fyle said he would be interested in attending the meeting once it is scheduled. Captain Anselment said he will let Brad Fyle know when the meeting is to be held. Captain Anselment noted that Parks Superintendent Tom Pawelk recently informed the Sheriff s Office of an increase in vandalism in City Parks. Captain Anselment said it helps if people call them right away when damage is found or witnessed by the public. Police Advisory Commission Minutes: 04/18/12 Captain Anselment said the Sheriff's Office recently purchased a new mobile camera system that is available for use by the County and their 13 contracted cities. The camera is moved around often so nobody knows for sure where it is positioned. Leila McCarty asked Captain Anselment if he could mention to the editor of the Times that they have the new camera system to see if the Times might want to run an article on the new camera system to let people know it is out there and being used, which could help deter some of the vandalism. Captain Anselment said he will be meeting with the Times tomorrow and will ask if they want to publish this as part of a larger public safety article. Captain Anselment noted there has been a recent rash of theft from vehicles, which are primarily a crime of convenience committed by school age kids and young adults roaming the streets at night. Captain Anselment said there has also been an uptick on more sophisticated financial fraud crimes, which typically occur at the bigger box stores. These criminals are often quite bold. Lieutenant Sandeen added that the time of day is not typically relevant for such crimes. Captain Anselment said they know who many of the people committing these types of crimes are. Captain Anselment added that computer related crimes are also on the rise, but noted that they have an expert assisting them with exploring these crimes. Captain Anselment said they have increased traffic enforcement operations in Monticello, including stop sign running. One location in particular was Dundas and Edmonson due to noted concerns and crash reports. Right now they are short on traffic cars and trained deputies. It would therefore help if they could know which intersections and streets are worst for speeding and stop sign running. Brad Fyle reiterated his desire to have the Sheriff's Office enforce loud noise complaints and offenses. Brad Fyle also noted some curfew concerns with summer coming. Captain Anselment said the Wright County Sheriff's Office uses curfew enforcement as a tool in their toolbox for informing kids of the curfew times, as well as to inform parents that their kids are violating curfew. Captain Anselment said deputies also not only ticket kids who are violating curfew, but sometimes they'll ticket parents as well. Lieutenant Sandeen noted that different cities have different curfew times, which can make it hard on parents to know when their kids should be home, especially if they're visiting friends in another city. Brad Fyle asked the Sheriff's Office to inform PAC members if they have a problem with Monticello's adopted curfew times, especially since Monticello has a lot of businesses that are open 24/7. Captain Anselment said he feels the City's current curfew ordinance is fine as written, but if they note excessive curfew violations over the next couple of months they will present the issues at the July PAC meeting for further discussion. 5) Completion of contact information consent forms 2 Police Advisory Commission Minutes: 04/18/12 All PAC members completed their forms and handed them in as requested. 6) Consideration of increasing enforcement related to STOP sign violations. Chuck Fradella requested this item be added due to his numerous observations of stop sign running violations. Chuck was surprised to see that the 20114 th quarter crime statistics only showed a total of 6 stop sign running violations. Chuck often witnesses more than this amount in a single day and feels there should be greater emphasis placed on enforcing such violations. Captain Anselment said he will talk to his staff and ask them to do a better job of enforcing such violations. Bruce Westby asked what the standard operating procedure is for enforcing stop sign running violations. Does it depend on time of day, the presence of pedestrians, etc? Captain Anselment said it most always depends on the surrounding circumstances. Both Leila McCarty and Chuck Fradella noted that when other drivers see someone else being ticketed for a traffic violation it can have the added advantage of deterring other drivers from making the same offense, and as such would like to see more enforcement in this area. 7) Discussion of added items. REFERENCE AND BACKGROUND: Representatives from the Wright County Sheriff s Office will update the Police Advisory Commission on recent crime statistics, trends and other law enforcement issues affecting the City of Monticello, and will respond to questions and /or concerns from the Police Advisory Commission and others in attendance. B. SUPPORTING DATA: None Police Advisory Commission Agenda: 7/18/12 5. Consideration of 2013 Law Enforcement budget recommendations to City Council. (BW) A. REFERENCE AND BACKGROUND: The City is preparing the annual budget for fiscal year 2013. Law enforcement is one of the larger line items in the budget. This service is contracted through the Wright County Sheriff s Office. Contract teens are for 2- years, and the current contract runs through December 31, 2013. A copy of the contract is attached as supporting data. In fiscal year 2012 (leap year) the City budgeted $1,137,162 for law enforcement services based on 19,032 contract hours, or 52 hours per day, at a rate of $59.75 per hour. This included 24 -hour call and general service. Based on the current 2012/2013 Law Enforcement Contract, the City will receive 18,980 hours of law enforcement services in 2013 at a rate of $60.50 per hour. The City will therefore need to budget $1,148,290 for law enforcement services in 2013, unless of course the City opts to reduce our number of contract hours. Per our contract the City can notify the County in writing prior to August 15 regarding any changes in the number of contract hours for the subsequent year. To assist Council in approving a law enforcement budget for 2013, the Commission is being asked to provide a recommendation on the number of contract hours to be provided by the Sheriffs Office in 2013. It is staffs understanding that the Sheriffs Office feels the current number of contract hours will be adequate for 2013, and that most other cities in Wright County are not reducing their contracted law enforcement hours for 2013. However, due to the continued economic downturn, the City Council requested staff to explore all available options for reducing the 2013 budget. The Police Advisory Commission is therefore asked to review the number of contract hours for law enforcement services in 2013, and to discuss the potential for reducing the number of hours. And if the Cormnission has any ideas on service areas that could be reduced in 2013 to allow for a reduction in hours, staff would appreciate those ideas as well. And if the Commission does recommend a reduction in hours, what would the recommended number of hours be? Please bear in mind that contract hours can only be reduced in 4 -hour increments. As always, Wright County Sheriff s Office representatives will be in attendance to provide feedback to Commission member's discussion items including potential impacts that could be realized if reductions in hours or service areas are being considered. B. ALTERNATIVE ACTIONS: 1. Motion recommending that the City Council maintain our current law enforcement service contract hours for 2013 at 52 hours per day. 2. Motion recommending that the City Council reduce our current law enforcement service contract hours for 2013 to hours per day. Police Advisory Commission Agenda: 7/18/12 C. SUPPORTING DATA: 2012/2013 Law Enforcement Contract LAW ENFORCEMENT CONTRACT THIS AGREEMENT, made and entered into this ,2S 7'4 clay of .%�u 20117 by and between the COUNTY OF WRIGHT and the WRIGHT COUNTY SHERIFF, hereinafter referred to as "County" and the CITY OF MONTICELLO hereinafter referred to as the "Municipality'; WITNESSETH: WHEREAS, the Municipality is desirous of entering into a contract with the County for tha performance of the hereinafter described law enforcement protection within the corporate limits of said municipality through the County Sheriff; and WHEREAS, the County is agreeable to rendering such services, and protection on the terms and conditions hereinafter set forth; and WHEREAS, such contracts are authorized and provided for by the provision of Minnesota Statutes 471.59 and Minnesota Statutes 436.05; NOW THEREFORE, pursuant to the terns of the aforesaid statutes, and in consideration of the mutual covenants herein contained, it is agreed as follows: That the County by way of the Sheriff agrees to provide police protection within the corporate limits of the Municipality to the extent and in the manner as hereinafter set forth: a. Except as otherwise hereinafter specifically set forth, such services shall encompass only duties and functions of the type coming within the jurisdiction of the Wright County Sheriff pursuant to Minnesota Laws and Statutes. b. Except as otherwise hereinafter provided for, the standard level of service provided shall be the same basic level of service which is provided for the unincorporated areas of the County of Wright, State of Minnesota. C. The rendition of services, the standard of performance, the discipline of the officers, and other matters incident to the performance of such services and control of personnel so employed shall remain in and under the control of the Sheriff. d. Set vices purchased pursuant to this contract shall include the enforcement of Minnesota State Statutes, including but not limited to the Traffic Code and the Criminal Code, as well as all local ordinances enacted in conformance therewith. Statutes and ordinances which prescribe enforcement by a different authority; i,e,, the State Electrical Code, the Uniform Building Code, etc., shall be excluded from this agreement. Ordinances pertaining exclusively to purely local city management matters; i.e., sewer and water collection, etc., shall be excluded from this agreement. The Municipality shall be responsible for enforcement of the Municipal Zoning Code, except that the Sheriff will enforce nuisance ordinances conforming to State law; i.e., junk cars, etc, and traffic ordinances; i.e,, parking and erratic driving. 2. That it is agreed that the Sheriff shall have fill cooperation and assistance from the Municipality, its officers, agents and employees so as to facilitate the performance of this agreement, In order to facilitate a local presence of Sheriff's Deputies, the Municipality shall, if requested bythe Sheriff, provide a secure office for the Sheriff's Deputies having adequate space for two desks with chairs, limited public visibility, a local telephone line and an internet connection. The Municipality shall allow a sign indicating the location of its Sheriff's substation with appropriate telephone numbers to be displayed on the exterior of the building. That the County shall furnish and supply all necessary labor, supervision, equipment, communication facilities for dispatching, cost of jail detention, and all supplies necessaty to maintain the level of service to be rendered herein. 4. The Municipality shall not be liable for the direct payment of any salaries, wages, or other compensation to any personnel performing services herein for said County. The Municipality shall not be liable for compensation or indemnity to any of the Sheriffs employees for injuries or sickness arising out of its employment, and the County hereby agrees to hold harmless the Municipality against any such claims. 6. The County, Sheriff, his officers, and employees shall not be deemed to assume any liability for intentional or negligent acts of said Municipality or any officer, agent, or employee thereof 7. This agreement shall be effective from January 1, 2012 to December 31, 2013. An additional 52 hours will be provided in 2012 because it is a leap year. 8. The Municipality agrees to pay to the County the sum of $59.75 per hour for law enforcement protection during the calendar year 2012 and $60.50 per hour during the calendar year 2013, if salaries of Deputy Sheriffs are increased at any time during the term of this contract, the hourly rate of this contract shall not be increased, 9. This contract shall be extended automatically for successive one year periods at a rate to be established by the County, unless the County or Municipality shall notify the other of termination, in writing, prior to August 15 of each year. 10, The number of hours of service to be provided pursuant to this contract are as follows; 52 hours per day; 18,980 annually and shall provide 24 -hour call and general service. The Municipality shall notify the County in writing prior to August 15 regarding any change in the number of hours for the subsequent year. 11, The County shall provide for all costs and prosecution efforts with respect to violations charged by the Sheriff in the performance of this agreement. All fines arising from such prosecutions shall accrue to the County. Violations of municipal ordinances excluded from enforcement by this agreement shall be prosecuted by the Municipality at its expense, All fines arising from city prosecutions shall accrue to the Municipality unless other wise provided by law. 12. Pursuant to law, the County Auditor/Treasurer shall remit to the Municipality its share of all fines collected. The Municipality shall return to the County within 30 days all fine money attributable to prosecutions initiated by the Sheriff in accord with Paragraph 11 of this contract. The Municipality shall keep and retain any fine money submitted by the Auditor/Treasurer attributable to prosecutions initiated by the Municipality, 13. For the purpose of maintaining cooperation, local control and general information on existing complaints and problems in said Municipality, one member of the Municipal Council, the Mayor or other person or persons shall be appointed by said Council to act as police commissioner(s) for said Municipality and shall make ponodic conti'ctsmith and,atrend ineetings with the Sheriff or his office in relation to the contract herein, i. 14. The County shall save, hold harmless and defend the City fiom any acid all claims arising from the acts or omissions, including intentional acts and negligence, committed by employees or agents of the County or Sheriff while in the performance of duties in furtherance of this contract. IN WITNESS WHEREOF, The Municipality, by resolution duly adopted by it governing body, caused this agreement to be. signed by its Mayor and attested by its Clerk; and the County of Wright, by the County Board of Commissioners, has caused this agreement to be signed by the Chairman and Cleric of said Board, and by the Wright County Sheriff, effective on the day and year first above written. Update on vacant Police Advisory Commission position. (BW) A. REFERENCE AND BACI {GROUND: On May 15t1i, Leila McCarty resigned her position on the Police Advisory Commission. The vacant PAC seat has been posted since May 18t". To date there have not been any responses or inquiries regarding the vacant seat. An option that is available for consideration to better broadcast this vacancy to the public is to advertise it in the Monticello Times. The cost for this would not exceed $175. Funding could be taken from the Outstanding Citizen Recognition Award budget, or staff can research other available funding options. B. ALTERNATIVE ACTIONS: 1. Motion to approve advertising the vacant Police Advisory Commission seat in the Monticello Times for a period of one week at a cost not to exceed $175. 2. Motion of other. C. SUPPORTING DATA: Posting for Police Advisory Conunission Opportunity Volunteer Opportunity Police Advisory Commission The City of Monticello currently has a volunteer position available on the Police Advisory Commission. You must be a resident of Monticello to be eligible for this position. The Police Advisory Commission advises the City Council on law enforcement and public safety matters. Quarterly meetings are held in the evening on the third Wednesday of the month (January, April, July and October).
