EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF MONTICELLO, MINNESOTA HELD: JULY 8, 1975 Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Monticello, Ainnesota, was duly held at the City hall in said City on the 8th day of July, 1975, at 1:30 _ o'clock Is .M., C.D.T. The following members were present: Johnson, Erickson, Martie, Walters, Wicber and the following were absent: Ha 11 Member Martie introduced the follow- ing resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC SALE OF $775,000 GENERAL OBLIGATION IMPROVEMENT BONDS OF 1975 BE IT RESOLVED by the City Council of the City of Monticello, Minnesota, as follows: 1. It is hereby found, determined and declared that this City should Issue $775,000 General Obligation Improvement Bonds of 1975 to defray the expense of the construction of various improvements in the City. 2. This Council shall meet at the time and place specified in the form of notice hereinafter contained for the purpoae of opening and considering scaled blda for, and award- ing the sale of $775,000 General Obligation Improvement Bonds of 1975 of said City. 3. The City Clerk is hereby authorized and di- rected to cause notice of the time, place and purpose of said meeting to be publiahed In the official newspaper of the City and in Commercial West not less than Len days in advance of date of sale, as provided by law, which notice shall be in substantially the form set forth In Exhibit A attached hereto. 4 . The terms and conditions of said bands and the sale thereof are fully set forth in the "Ofric!al Notice of Bond Sale" attached hereto as Exhibit B and in::-,)r;)orated herein by reference. The motion for the adoption of the foregoing resolution was duly seconded by member Walters and upon a vote being taken thereon, the following voted in favor thereof: all present and the following voted against the same: none Whereupon said resolution was declared duly passed and adopted. Consulting Engineers L mdSungyors July 2, 1975 Honorable Mayor and City Council City of Monticello 215 South Cedar Street Monticello, Minnesota 55362 Re: Improvement No. 75TS-1, 75LS-1, 75TW-1, and 75LW-1 Gentlemen: On Friday, June 27, 1975, the City of Monticello received bids for the above referenced project and eleven contractors responded. The bids received varied from a low bid of $504,136.10 (corrected total) to a high bid of $648,580.00. Our estimate for this project was $554,010.00. After receipt of the bids, the bids were tabulated by our office and corrections noted in the addition, subtraction, and in the transposition of the figures. Two errors of transposition were found in the low bidder's figures, flood, Inc. The corrected total of their bid is $504,136.10. Furthermore, a check was made by myself and others of our staff with the several municipalities in which flood, Inc. had previously undertaken similar projects and the results were favorable. Therefore, it is recommended that Public Improvement 75TS-1, 75LS-1, 75TW-1, and 75LW-1 be awarded to flood, Inc. of Richmond, Minnesota, being the lowest responsible bidder, for the total sum of $504,136.10. Johnson (!.;IIrc lC.r LOCAL GOVERNMENT AIDS AGREEMENT THIS AGREEMENT made and entered into this day of 1975, by and between the City of Monticello, party of the first part, and the Town of Monticello, party of the second part, and the State of Minnesota -Department of Revenue, party of the third part, acting by and through their respective Citv Council, Town Board and Director of Tax Research Division; WITNESSETH: That on September 19, 1974, an Order from the Minnesota Municipal Comaission for the State of Minnesota ordered various land from the Town of Monticello into the City of Monticello. Subsequent to said order the Department of Revenue certified to the Town of Monticello that the local government aid to be received was to be $122,997.86 for the year 1975. Further, the Department of Revenue certified to the City of Monticello that their local government aid would be $85.644.72 for the year 1975• Shortly thereafter, the Department of Revenue recertified the City of Monticello's 1975 local governmental old from $85,604.72 to S12t,371.18, an increase of $35,766.46. However, the Department of Revenue did not notify, certify or order that the Town of Monticello's 1975 local government aid would be decreased from $122.997.86 to $87,231.40, a decrease of $35.766.46. In order to avoid appeals and continuation of appeals, the above part les have reached and hereby enter Into the following mutual agreement: 1. The March 15, 1975, quarterly payment of the $35.166.46 in local government aid transferred from the Town of Monticello to the City of Monticello would remain the revenue of the City of Monticello. 2. The July 15, 1975, the September 15, 1975, and the November 15, 1975. quarterly payments of the $35,766.46 In local government old would be paid by the Department of Revenue to the Town of Monticello, and not to the City of Monticello. 7_F /S d -C 3. The Town of Monticello for the year 1975 shall pay over to the City of Monticello that part of the $35,766.46 local government aid in excess of $150,000.00 the Town of Monticello receives from the fulluwiny: a) Local Government Aid 1975 b) Federal Revenue Sharing Payments 1975 c) Intergovernmental Transfers d) Other Non -property Tax Revenues e) An amount equal to 7 mills times the town's taxable value for levy in the year 1974, taxes payable in 1975 4. That for the year 1976 and subsequent years, the 1975 local government aid for the City of Monticello shall be $85,604.72, and for the Town, of Monticello shall be $122,997.86, as first determined by the Department of Revenue. 5. That for the year 1976 and subsequent years, the Town of Monticello shall pay over to the City of Monticello that part of the $35.766.46 local govern- ment aid in excess of $150,000.00 plus 5.5 percent of $150,000.00 (i.e., 1976, $158,250.00), and 5.5 percent for each subsequent year thereafter computed cumulatively, the Town of Monticello receives from the following: a) Local Government Aid b) Federal Revenue Sharing Payment c) Intergovernmental Transfers d) Other Non -Property Tax Revenues e) An amount equal to 7 mills times the town's taxable value for levy in tha prior year, tuxes payable In the current year. 6. That payments from the Town of Monticello to the City of Monticello shall be in four installments, ten days after the Town of Monticello receives payment from the Department of Revenue. Said quarterly payments shall be based on the prior year's Intergovernmental transfers, Federal revenue sharing and other non - property tax revenues made to the Town of Monticello. Subsequently, the Town of Monti- cello and the City of Monticello shall make a settlem nt.on the first day of February for 24, 2s &s C the prior year's payment using those amounts actually received for the year of settlement for the local government transfers, Fcdcral revenue sharing and other non -property tax revenues. 7. That parties hereby further agree that the appeal commenced by the Town of Monticello shall be suspended without prejudice. Further, the Town of Monticello does waive any of its rights to appeal the payment or payments made by the Department of Revenue to City of Monticello. Further, the Town of Monticello does not waive any of Its rights to appeal any and all claim and right of payments made pursuant to this agreement. Further, the Department of Revenue acknowledges that they have not issued an Order upon which the Town of Monticello, at this time, can appeal. 8. The parties shall do and perform their respective obligations under this agreement at all times and In such manner as not to delay or interfer with the intent of this aqreement.
