Public Hearing - Rezoning of Parcel from R-1 to R-2 to allow for Two Family Dwelling. Mr. Vern Youngberg is requesting that lot 1, block 2 of Creekside Terrace (see enclosed map) be rezoned from R-1 to R-2 to allow for a double bungalow. As required by city ordinances, hearing notices for this rezoning have been sent to property owners within 350 feet. O From a zoning standpoint the plans that have been presented meet the existing city ordinances. There appears to be more than sufficient existing trees to meet the city's ordinance requirements of one percent of the development cost put into landscaping. POSSIBLE ACTION: Consideration of recommending rezoning application. REFERENCES: Enclosed map. NOTE: If rezoning is approved by city council the building permit request will have to be reviewed ythe planning commission and city council. Agenda Item 3. Apuruval of Buildinn Permit - 'twelve Unit Auartment. Mr. Joseph LaFromboisc dba Construction Five is requesting a building permit for it twelve unit, apart- ment. This apartment would be constructed utilizing an existing foundation just, west, of the apartment known as Delmar Apartments (sec enclosed map). Thies foundation was abandoned in 1073 shortly after cun- stvuet.ion had started on an apartment house at, that. time. It. would app, -lir from a zoninu standpoint. that. the structure is In compliance with our ordinances rela- t.ive to proper zoninu district., yard size, setbacks, parking spaces, square foot -ane of apartment units, etc. J. W. Miller has reviewed the plans as they relate to the state W ildinn code and 1 believe there are no problems. Jay has also reviewed the existing foundation to assure that It meets code and is In safe condition. b f City ordinance requires that one percent of the development costs be utilized for landscaping exclusive of sod and walkways and it would cer- tainly appear there are sufficient trees on the existing lot to meet this requirement provided the trees are not taken down. POSSIBLE ACTION: Consideration of approving building permit. REFERENCES: Enclosed map depicting area. Plans are available for review at City Hall. Agenda Item 4. Public Hearing - Ordinance Amendments - Motor Vehicle and Recreation Equipment Sales. As you may be aware, Monticello recently went to court to resolve a matter relating to our ordinances pertaining to outdoor car sales. Eventually the matter was resolved out of court but it was felt our ordinances should be clarified in this area to determine what areas are properly zoned for such sales and what conditions (if any) should be attached. Enclosed please find a memo from Dick Dwinell and also a hearing notice relative to the proposed amend- ment. A public hearing i.s required by city ordinances and state statutes nn any revisions to a zoning ordinance. The effect of the ordinance amendments would be to require a conditional use permit in a B-3 or B-4 zoning district rather than allow car sales as a permitted use in these zones. Purposo is CO cnnt.rol outside car sales by the following conditions listed in the ordinances. 1. Outside service, sales and equipment rental connected with the principal use is limited to thirty (30) per cent of the gross floor area of the principal use. f ',his percentage may be increased as a condition of the conditional use permit.. -2- 2. Outside sales areas are fenced or screened from view of neighboring residential uses or an abutting residential district in compliance with Section 10-3-4 (G) of this Ordinance. 3. All lighting shall be hooded and so directed that the light source shall not be visible from the public right-of-way or from neigh- boring residences and shall be in compliance with Section 10-3-2 (H) of this Ordinance. 4. Sales area is grassed or surfaced to control dust. 5. The provisions of Section 10-22-1 (E) of this Ordinance are considered and satisfactorily met. June 16, 1977 Mr. Gary Wieber City Administrator 215 South Cedar Street Monticello, Minnesota 55362 Re: Twelve -Unit Apartment Building on 6th Street Dear Gary: The Construction "5" firm sent me a copy of the site plan for the construction of a twelve -unit apartment building on 6th Street between Locust Street and Lynn Street. The site plan submitted had insufficient information to suggest anything as being a grading plan other than some very light arrows indicating direction of drainage. As you know, this area has had its surface water problems and 1 see no resolution in sight until storm sewers are constructed as previously proposed. Existing and proposed contours should be provided indicating elevations of the ground floor of the building and drainage of the yard area, as well as the parking area. Enclosed is a portion of the topographic map of the area. The area proposed for the parking lot is now a depressed area that collects drainage from the surrounding land. If as shown by the arrows on the site plan, the developer must anticipate filling in this low area. This will in- crease the amount of runoff to Lot 10 (private property) west of the proposed site. The plan also shows a drain- age arrow to the south, but the topog map shows this to be a high area. liow he proposes to dispose of runoff southerly remains to be seen. 1 think the property should be filled and graded so that all runoff flows northerly to 6th Street and not on private .)ropert.y to the west and aouth. It would be better to flood the street at this time than private property. In the future, when storm sewers are constructed, this runoff can be readily collected and conveyed. 0 Re: Twelve -Unit Apartment Building on 6th Street June 16, 1977 Page 2 It appears that the apartment complex will be built on a flat slab (no basement). If this is the case, no problem should be experienced with a sewer connection as the sewer main is relatively shallow being only 8 feet deep in the street.
