,/Agenda Item 1 - Approval of the Minutes from the August 9, 1977 Planning
% Commission meeting.
/Agenda Item 2 - Consideration of Variance on Sideyard Setback Requirements.
Bruce Wachter is requesting a variance from the required 10 feet
requirement on sideyards to build a deck within 5 feet of the
property line.
Variance request is for Lot 2, Block 1 of Griefnow Addition.
POSSIBLE ACTION: Consideration of recommendation to
City Council to approve or deny variance
request.

✓Agenda Item 3 - Consideration of Business District Development Plan.
The Business District Development Plan has been reviewed at a
joint meeting with the City Council. At that time a decision
was made to wait with approval of the plan until the question
of opening Walnut Street could be resolved.
At their last meeting, the City Council requested the Planning
Commission act on the Business District Development Plan with
any recommended changes. Although the matter of Walnut Street
has not been resolved, it would appear this issue will be
brought to an end shortly and the Council would like to hold
informational and public hearings relative to the plan in the
near future.
POSSIBLE ACTION: Consideration of adoption of Business
District Development Plan with any
amendments.

Agenda Item 4 - Consideration of Adopting Uniform HousinR Code.
APPLICATION - Code would apply to all buildings either existing
or designed or intended to be built. However, existing buildings
do not have to comply with all the provisions of the code, only
those found to be substandard as spelled out in section 1001.
ENFORCEMENT - Building Inspector has authority to enforce code.
HOUSING ADVISORY AND APPEALS BOARD - City Council appoints board
consisting of five members who are not employees of the City.
The Building Inspector is an ex officio member of the Board.
This Board acts in an advisory capacity on the interpretation
of the Uniform Housing Code and also as an appeal board. Should
a property owner disagree with a decision rendered by the
Building Inspector, he would have the right to appeal the case
to the board. The board could be the City Council itself or
a combination of Council Members and other appointed members.
PROCECURE - whenever the Building Inspector has inspected or
M=e be inspected any building and has found and determined
that such building is a substandard building, he shall order the
building repaired, vacated or demolished to abate the problem.
The order of the Inspector must be carried out in a reasonable
period of time normally not to exceed 60 days.
APPEAL HEARING - If the property owner appeals the order of the
Building Inspector, a hearing is held by the Board of Appeals and
a final decision is rendered. Property owner must appeal order
of building inspector within 30 days after order is issued, and
if not appealed within 30 days, the building inspector's order
is final.
ENFORCEMENT OF ORDER - If the property owner fails to obey the
order, the building inspector may prosecute or institute any
appropriate action to abate such a nuisance.
REODVER4 OF COST OF REPAIR OR DEMOLITION - Any cost incurred by
the city in carrying out the provisions of the Uniform Housing
Code in repair or demolition of a building shall be assessed
against the property.
POSSIBLE ACTION: Consideration of recommendation to adopt
Uniform Housing Oode.

held by the Monticello Planing Commission on August 16,
19'7, at 7:30 P.M. in the Mopticello City Hall to consider

1. Amendment of Monticello City Ordinance to allow
a Pet Hospital as a'conditional or permitted use
In a B-3 (Highway Business) and I-1 (Light Indus-
trial) Zone.
2. Allowance bf a Pet Hospital in a B-3 (Highway
Business Zone as described belowt

Enclosed find a copy of the Right of Way map for the area you
described on Trunk Highway 25 south of Monticello. The area
marked In red Is controlled access which prohibits the placing
of additional entrances.
As you will note the only access to your property to a joint opening
on the south line. Access rights in this area were previously pur-
chased to prevent a proliferation of entrances and thus provide s
I_ eafor and more hazard free highway.
' The right of way line Is 75' from the centerline of Trunk Highway 75.
No buildings, structures, signs, etc, are permitted on hinhwey ritlht
of way.
