(As you recall, there was no regular meeting held in March.) 1. Public Hearing - Consideration of a Conditional Use Permit Request for Charles-Ritse. 2. Planning Commission - 4/14/81 AGENDA SUPPLEMEM I. Public Hearing - Consideration of a Conditional Use Permit ReQuest,for Charles Ritse. Charles Ritze has made an application for a conditional use to do mining (removal of gravel fill, etc.) as defined in Monticello ordinance 010-3-8. A conditional use permit is required whenever the extraction of sand, gravel, or other material from the land in the amount of 400 cubic yards or more, and the removal thereof is to be done. Monticello ordinance requires that the conduct of mining -ball be permitted only upon the issuance of a conditional use permit within all zoning districts within the City. The location of this proposed conditional use for mining is that part of the RKY of the SA of Section 3, Township 121M. Range 25p. which lies south of County Road 75, across from Ritse Mawr. It is a staff recommendation that this permit be granted, contingent upon a plan being furnished, showing a finished grade which will not adversely affect the surrounding land or the development of the site on which the mining is to be conducted. It is Mr. Ritse's Latent that the fill which would-be removed from the mining site would be transported over to a low area in Ritse Manor to be used for fill to bring the lots up to the required grade. Both of these areas which are owned by Mr. Ritge are soned as R-1. APPLICANT: Charles Ritsa CONSIDERATION: Consider recommending approval or denial of this conditional use request with the above contingency regarding a plan being furnished. Public Hearing - Consideration of a Conditional Use Permit Request - Vance Florell. Vance Florell, owner of the Freeway Standard Station, has made an application for a conditional use permit to allow open and/or outdoor storage and/or sales on the parcel of the I-94 Tri -Plaza where the Freeway Standard Station is now located. This property is zoned B-3. Monticello Ordinance 610-13-4-(B) provides that open or outdoor service, sale and rental as a principal or accessory use may be conducted in a B-3 zone, provided that: A. Outside services, sales and equipment rental connected with the princi- pal uses is limited to 302 of the gross floor area of the principal use. At this time, the Standard Station is providing the parking spaces which they need for the operation of their business, with no axtras. Mr. Florell feels, however, that even though they provide the required parking spaces in conformance to what our ordinance requires, that there is not a need for all of those park- ing spaces, and that there is adequate room for all of his customer parking, etc. plus enough additional room to allow him to adequately provide U -Haul rental from that property. One item for consideration in that respect would be to limit the number of U -Haul vehicles which would be allowed on the parcel, or to definitely limit the number of square foot, or to specify the area which could be used for U -Haul rentals. One additional item which Mr. Floroll may be requesting at the meeting, in addition to the above-mentioned subject, would be to allow an additional pylon sign advertising the U -Haul rental. At the time of this writing, Mr. Florell had not made a definite decision as to whether or not he would be asking for this additional pylon sign, but should he request that, it ; ) +,� • S . If it were recommended for being granted on a permanent basis, it would be necessary to advertise for a variance at a public hearing. Public Hearing - Consideration of Rezoning Request by Mel Wolters in The Meadows Subdivision Plat. Mel Wolters, owner of The Meadows, is_proposing chayg-ing-the- zoniag_of the Meadows from R-1 to R-2 for Lois 1-11, Blockf, ,Lots 1-9, Block 3;� Lots 1-15, and Lot 24, Block 4, and ZOts 1 b 2', 1oZ" . Mr. Wolters is making this proposal, based on his desire to locate zero lot line duplexes on various lots throughout the Meadows addition. Previously, Lots 1-14, Block 1 in The Meadows were rezoned to R-2 for the same purpose. Zero lot line duplexes, are those duplexes which are built on an indivi- dual lot, and share a common wall, which becomes the property line when the individual lot which contains the duplex is divided into two equal parcels of 5,000 or more square feet each. (You may recall at a previous meeting this was approved for Quintin Lanners on a duplex built on Ramsey Street adjacent to the railroad. It was discovered at that time that Monticello Ordinances do allow this type of a duplex on an R-2 lot, without approvals being necessary.) REFERENCES: Enclosed map depicting the area of the Meadows and the lots on which rezoning is requested. �r A pA s r4 ,Z �i 1 D �Z Planning Commission - 4/14/81 Public Hearing - Consideration of a Conditional Use Permit Request (Re -Hearing) for Medical Facilities Company. On September 22, 1980, a public hearing on the rezoning and conditional use for a proposed medical clinic east of the Monticello -Big Lake Community Hos- pital was held. Monticello -Big Lake Community Hospital had requested rezoning of Lots 1 6 13, and the West 33' of Lot 2, Block 22, Lover Monticello and the east half of Oak Street lying between Blocks 22 and 23, Lover Monticello, from R-1 to R -B. In addition to their rezoning request, the Hospital had also made an application for a conditional use for a proposed medical clinic. At that meeting, it was noted that previously the City of Monticello had received correspondence from neighbors in the Ellison Park area, expressing concern with the possible extension of River Street to accommodate a parking lot at the rear of the proposed medical clinic. At that time, the rezoning request and the conditional use request for the clinic did not propose to have River Street extended to meet the parking lot, but rather it was designed to have the parking lot traffic enter and exist onto Hart Blvd. At that time, the developer of the clinic indicated that if, for some reason, Hart Boulevard could not be used as the entrance and access point to the parking lot, he may approach the City for possible extension of River Street to the rear of the parking lot. At this time, it is the developer's intention to extend River Street to allow access to the parking lot, thus the re -hearing is being held. The Planning Commission, at their meeting prior to the September 22, 1980 Council Meeting, recommended approval of both the rezoning and conditional use permit for the clinic, provided that the developers provide access to the proposed parking lot from Hart Blvd., rather than opening up and extending River Street. At the September 22, 1980 Coune it Meeting, n unanimous vote carried to rezone. Lots 1 b 13 and the West 33' of Lot 2, Block 22, and the cast half of Oak Street lying between Blocks 22 and 23, from R-1 to R -B, and also, to approve the issuance of a conditional use permit for the proposed medical clinic contingent upon the proposed parking lot using Hart Boulevard as an access and exit point. (This was done using Zoning Ordinance Amendment 9/22/80 086). Enclosed with this agenda supplement is material relating to both the Planning Commission Minutes dealing With this item in September of 1980, and the Council Minutes dealing with this item in September 1980. APPLICANT: Medical Facilities Company CONSIDERATION: Consider recommending approval or denial of the amendment to the conditional use which Would allow access to the parking lot off from River Street if it is extended.
