Approval of Minutes - August 15, 1978. �I Unfinished Business New Business - O AGENDA SUPPLEMENT 1. Public Hearing - Consideration of Conditional Use Permit - Tom Chock. VMr. Tom Chock has applied for a Conditional Use Permit to allow him to to make a third apartment in his existing duplex at 801 West 3rd Street. This property is zoned Rr2 (Lot 5, Block 42). Under our present ordinance, to have a triplex on the lot, as Mr. Chock has proposed, he would need a lot that is 12,5010 square feet, and there areonly 10,690 square feet on this lot, or 13% less than required. You may also want to note that Mr. Chock owns the three lots to the hest of this property (lots 2, 3 & 4). If you were to consider these d four lots as one piece of property, then there would be more than o L o, adequate room as far as square footage is concerned, even with the other building on the other three lots. Notices have been sent, and there have been no objections made as of SOo� this date. �L �\ POSSIBLE ACTION: Consideration of approval or denial on recommending this conditional use permit. According to Monticello Ordinance relative to subdivisions, Section 11-1-7, a request to divide a lot which is part of an existing lot of record where a division is to permit the adding of a parcel of land to an abutting lot or to create two lots and a newly created property line will not cause the other remaining portion of lot to be in violation of thi s ordinance or the zoning ordinance, a aut%d vision request can merely be approved by the Planning Commission upon the receipt of a certificate of survey and upon 0 0 final approval by the City Council. 1 James Metcalf and Bradley Larson are proposing a subdivi Sion of land where- by thoy will subdivide a portion of a lot they own which to to be purchased by an abutting property owner, Mrs. Viva Jean Abrahamson. 'lis The proposed subdivision does meet the requirements of 11-1-7 in that all existing requirements are met of the zoning ordinance. In effect, the addition of parcel C to parcel A would create a lot 16000 square feet, and still leave a remaining lot which would be 12,903 square feet. In effect, parcel A would be brought from a legal non -conforming use in terms of size of a lot to a legal conforming use and still leave the remaining parcel as a legal conforming use in terms of lot size. One other item that should be brought to the attention of the applicant in this case is that the subdivision requirements call for the recording of any newly created subdivision. This is necessary for the records of the County Assessor and the City in determining future setbacks. POSSIBLE ACTION: Consideration of a recommendation of approval of subdivision as outlined. REFERENCES: See enclosed sketch relative to the property. APPLICANT: Viva Jean Abrahamson 3. Consideration of Extension of Variance for River Meadows Apartments. On September 26, 1977, the City Council approved the variance request by River Meadows Partnership to allow a variance for the construction of up to a 30 unit apartment along East County Road d99. Ordinance Section 10-23-7 indicates that whenever within one year after granting a variance or appeal the work as permitted by the variance or appeal shall not have been completed, then such variance or appeal shall become null and void unless a petition for the extension of time in which to complete the work has been granted by the City Council. Such an extension shall be requested in writing and filed with the zoning administrator at least 30 days before the expiration date of the original variance or appeal. f Such a petition for an extension has been filed by the partnership requesting the extension of the variance for another year. Reason for the request for an extension is that the developers of this project are currently in the process of lining up a financing commitment in order to allow construction to begin in the Spring of 1979. Tentative commitment has been granted by Knutson Mortgage Company, and the developers are looking at the possibility of this loan commitment and L also looking into the possibility of comnorcial revenue bonds. His sign would only say "ELECTRO INDUSTRIES" with an arrow pointing west to his manufacturing plant. Under the present ordinance this type of sign would only be allowed as a variance.
