Public Rearing - A Conditional Use Request to Allow Major Auto Repair in a B-4 (Regional Business) Zone - Applicant. Jay Spitzengel. (G.A.) A. REFERENCE AND BACKGROUND: Mr. Jay Spitzengel is requesting to be allowed to operate a major auto repair business in a B-4 Zone. The location is the former Monti Motors business in the rear of the old Monticello Ford building. The auto body repair will be his only type of business operated in this location and will be done by himself only. Mr. Spitzengel has indicated he would like to work only on small repairable care that could be fixed in a very short period of time rather than fix care that have a lot of damage. Mr. Spitzengel would like to be allowed to operate an auto body shop out of this location to get his business established, and hopefully within a year or two construct a new body shop in the City of Monticello. B. ALTERNATIVE ACTIONS: 1. Approve the conditional use request to allow major auto repair in a B-4 Zone. 2. Deny the conditional use request to allow major auto repair in a B-4 Zone. 3. Allow major auto repair in a B-4 Zone with the following conditions: a. No exterior storage of damaged automobiles, automobile parts, etc., allowed. b. A conditional use be granted for a period not to exceed one year, and upon being given a notice by the City will vacate the promisee within 60 dayo. C. STAFF RECOMMENDATION: Staff rocommondo approval of the conditional uoo roqueot with tho following conditions: 1. All automotive repair work be done inaido the building with the doors closed. 2. No exterior otorago allowed for repairablo automobiloo or automobile parto. 3. A conditional uoo be granted for a period not to exceed one year. The conditional uoo can be pulled at any time by the City upon a written 60 -day notice. D. Planning Commission Agenda - 6/11/85 4. Public Hearing - A Variance Request to Allow a Garage to be Built in the Sideyard Setback Requirement - Applicant, LeRoy Miller. (G.A.) A. REFERENCE AND BACKGROUND: Mr. LeRoy Miller is proposing to build an attached 26-x 26' garage to his existing 24-x 40' home. With his proposed garage construction, he would like to encroach into the sideyard setback requirement 317". On the enclosed site plan, you will note that from the property pine the garage will be placed 6131' from the sideyard property line. The adjacent structure immediately north is the garage units for a 4-plex. The garages are currently set 10' from the property line, which allows for a total distance between the two structures of 16'3". B. ALTERNATIVE ACTIONS: 1. Approve the variance request to allow a garage to be built within the sideyard setback requirement, which would be a 3'9" variance. 2. Deny the variance request to allow a garage to be built within the sideyard setback requirement. C. STAFF RECOMMENDATION: Staff recommendo approval of the variance request to allow a garage to be built within 6'3" of tho side property line. With this being an existing lot in the old intor-City, there are no utility easements around tho property. But with tho location of the garage, it would still allow 613" to the nearest structure for a utility easement should one be needed. D. SUPPORTING DATA. Planning Commission Agenda - 6/11/85 5. Public Hearing - A Variance Request to Allow a Garage to be Built in the Sideyard Setback Requirement - Applicant, Richard Carlson. (G.A.) A. REFERENCE AND BACKGROUND: Mr. Carlson is proposing to build a garage addition to his home. In doing so, he is proposing to extend the front of the garage 6 feet into the sideyard setback. With a vehicle parked in front of the proposed garage, the vehicle will still he on the owner's property and wouldn't be sitting on City boulevard. B. ALTERNATIVE ACTIONS: 1. Approve the variance request to allow a garage to be built within 14 feet of the sideyard setback requirement. 2. Deny the variance request to allow a garage to be built within 14 feet of the sideyard setback requirement. C. STAFF RECOMMENDATION: Staff recommends approval of the variance request to allow a garage to be built within 14 feet of the aidayard setback requirement. D.
