Also Presents Tom Eidem, City Administrator. The regularly scheduled meeting of the Monticello Planning Commission was duly held at 7s30 P.M. on April 10, 1984, in the City Council Chambers. fembera present wares Ridgeway, Cochran, Schaffer. On a motion by Cochran with a second by Schaffer, the minutes of March 13, 1984, and March 26, 1984, were approved as read. 3. Public Hearing — Conditional Use Request to Allow a Self-Sorvico Car Wash and a Self -Service Gan Station/Convonienco Store in a 8-3 Zone, Applicant - gainuol Construction. / Ridgeway convened the public hearing requesting any public comment. Mr. Sam Peraro, representing Samuel Construction, addrseced the Planning Cemmisoion providing a brief explanation of his proposed project. He noted that all conditions as stipulated in the Ordinance were to be casplied with. Mr. Poraro acknowledged that in an oarlior diacunsion with Gary Andoreon, Zoning Administrator, he was made atwaro of the fact that he would have to incroaao the number of parking apacon or apply for a Variance. Peraro indicated that Mr. Andorson advisad him that he would require eight parking apacce instead of four. Poraro alao indicated that i®odiatoly prior to this meeting he had mt with Ridgeway and Eidom to dia cuss the parking problem and was informed that the projoct would require 13 spaces rather than eight parking opacos. Pararo noted that he had atgplo land to supply th000 parking spacoo and that he did not wish a Variance to have l0000r parking opacoc. He agreed to provide a new architectural rondoring of the site ahwing all 13 opacca. Poraro indicated that he would have the rendering available to pr000nt to Anderson at the time of filing for the building permit. There being no additional public comment, Ridgeway cloaod the public hearing. A motion was mado by Cbehran, duly aeeonded by Schaffer, and carried unanimuoly to rocwosend to t.ho City Council that a Conditional Use for a coli-carvice car wanh and self-oorvico convonionco store/fuol atation be granted. -1- Planning Commission Minutes - 4/10/84 4. Public Hearing.- Variance Reuumst to Allow a Sidavard Variance within Five Peet of a Side Int Line and a Variance Reguest to Allow Another Driveway Access Within 40 Feet of an Existing Driveway, Applicant - Best in Webb. Ridgeway convened the public hearing asking for any public comment an the proposal. Mr. Wayne Bidwell, representing Beet in Webb, came before the Commission to provide detailed explanation of the site plan. He explained that in order to accommodate the size of expansion his firm required, the building would need to be built within five feet of the side lot line. In referring to the Variance Request for the second driveway, he explained that two loading berths wore required for the new building and that it would be virtually impossible to serve the building if the driveways had to be 40 feet apart. Commission member Cochran questioned Eidem with respect to a letter that was submitted by John Simola, Monticello Public works. Director. Cochran's question referred to the following statement: "We are opposed to these types of Variances." Eidem explained that Simcla's comment was primarily addressing two Variances that were not officially applied for, vis, that off-street parking shall not be allowed within 15 feet of street surfacing and that the boulevard portion of any street right-cf-way shall not be used for parking. He explainod that the configuration of the loading bertha when occupied by trucks would violate both of these provisions. He stated that Simola's comment was primarily from the Public Works Department but that it had general staff support. Eidam noted that while those variances wore not in the form of formal requests, approving the building and site configuration would implicitly approve these Variances. This was Simola'o,concern. Mr. Bidwoll indicated that it would be easy for him to move his proposed building westerly 10 toot, but that he had designed it ao that the oast wall of the proposed building would be in lino with the east wall of the existing building for aesthetic purposoa. He indicated he caw no real difficulty moving the building westerly to accommodate the loading berth requirements. Bidwell noted that to move the building westerly would not really altor the oubmittod Variance requests. He indicated he would still need a Variance to place the building within five foot of the aide lot line and a Variance to have two driveways within 40 foot of each other. Prior to the making of any motion, the Commieaion caked Bidwell to confirm U:at the site configuration would be amended to chow the proposed building being placed westerly 10 foot from ita proposed location to address the loading berth question. Bidwell agreed to that provision. Thoro being no other public commont. Ridgeway cloned the hearing. A motion was made by Cochran, duly seconded by Scl:offer, and carried unanimously to grant a Variance to Boot in Webb for two driveway accesses within 40 foot of each other and to grant a Variance allowing a building to be within five foot of the side yard lino. D Planning Commission Minutes - 4/10/84 5. Public Hoarinq - Variance Request to Allow Another Driveway Access Within 40 Feet of an Existinq Driveway Access. Applicant - Dairy Queen of Monticello. Ridgeway convened the public hearing . There were no representatives of the applicant present at the meeting. There being no public response to the public hearing, Ridgeway closed the hearing. Planning Comaniesion members briefly discussed the request, with Ridgeway noting that the adjacent property owner was also the applicant and hence, the proposal could accommodate development an both parcels. Motion was made by Schaffer, duly seconded by Cochran, and carried unanimously to approve the request for a Variance allowing a driveway access within 40 feat of an existing driveway access. G. Public Hearing - Variance Request to Allow a New Datached Garage to be Built up to the Front Property Lino, Applicant - Norbert Kelly, Jr. Ridgeway convened the public hearing. The applicant was not in attendance to address the issue. There being no other members of the public wishing to address this iasuo, Ridgeway closed the hearing. Commisoion members conducted a brief discussion familiarising themselves with the parcel in question and noting the reotrictions on the land bacauso of its proximity to the Miaoioaippi River. Ridgeway noted that the garage is intended to replace an existing chod. Further, he noted that a curb cut that will become non- functional willbe filled in at the applicant's expense. Motion was mads by Cochran, duly seconded by Schaffer, and carriad unanimously to approve the request for a Variance from Norbert Kelly, Jr., allowing the construction of a detached garage up to the front property line. 7. Public Hearing - Conditional Una Racluemt to Allow Apartmonto in a Buninonn Buildinq in a B-4 Zone, Applicant - Tom Hamer. Ridgeway convened the public hearing. Ridgeway raised a question relating to whother or not this is nn appropriate request. Ila Indicated that he could not find in the Zoning Ordinance whore residential units were allowed no Conditional Uses within the 9-4 Zone. Eidcm noted that the discropancy had been discovered by otaff during a conversation with Mr. hammer's attorney. Eidom also stated that he had been in touch with both Mr. hammer and his attorney and that they had requested a continuance of the public hearing to tho next regularly echodulod Planning Commiooion mooting since they could not be in attendance on this particular evening duo to an emergency. The Commission directed Eidem to try to resolve any misunderstandings and confusion over the issues prior to that hearing. 8. Public Hearin - Conditional Use Request to Allow an Outdoor Sales Lot and a Minor Auto Repair Business in a B-3 Zone, Applicant - Eugene Kunkel. Ridgeway convened the public hearing. The applicant for the Conditional Use was not represented. There being no other members of the public present to speak to the issue, Ridgeway closed the hearing. Mr. Cochran, upon noting the location of the proposed Conditional Use, inquired as to the status of the Conditional Use Permit that was granted at an earlier meeting to Hurfin Landscaping for the same site. Ridgeway indicated that Murfin Landscaping had gone out of business, and hence, the Conditional Use was forfeit. Eidem noted that there had been other Conditional Use Requests for this site, and a major concern consistently arose over the landscaping and hard surfacing requirements. Ridgeway noted that there were 18 requirements explicitly stipulated in the ordinance for auto sales and minor auto repair, and that the applicant had agreed to abide by all conditions. Motion was made by Cochran, duly seconded by Schaffer, and carried unanimously to recommend to the City Council that a Conditional Use Pormit be granted to Eugene Kunkel to allow an outdoor sales lot and a minor auto repair busineso in a B-3 Zone. Eidom requested the Planning Commission to address a non -agenda item. Eidom provided Commiseion members with copies of a proposed resolution granting approval to Tax Incromont Finance Diatrict 14. He noted that the Monticello Housing and Redevelopment Authority had given their approval to the Tax Increment Finance Plan on April 4, 1984. Eidom explained that while District 14 io a aoparato legal entity, the project involving IXI io really an extension of Tax Increment Finance District 11. Ito noted that individual districts were being established to maximize the capturing of tax increment throughout the phosad construction of IXI'a complex. Eidam further adviaod that the project proposal wan in full compliance with all City planning and zoning regulations. Public Heerinq -Variance Inquest to Allow leas than Minimum Lot Square Footaqe Allowed for a 12 -unit Apartment Buildinq, Applicant - Bill Murphy. (G.A.) A. REFERENCE AND BACKGROUND, Mr. Murphy is proposing to build a 12 -unit apartment building an three residential lots, Block 10, I4ts 8, 9, and 10. With his proposed 12 - unit apartment building, Mr. Murphy would like to have eight 2 -bedroom unite and four 1-bodrom units. The amount of square footage Mr. Murphy has within his three lots is 32,670 sq. ft. The amount noedod for what he is proposing is 33,500 sq. ft., which would leave him 830 sq. ft. short, or an 830 sq. ft. variance request. To be in conformance, Mr. Huuphy would have to have six 2-bodrocm units and sir 1-bodroom units to conform to the minimum amount of square footage allowed, which would be 32,670 sq. ft., which is all he has to work with. With six 2 -bedroom units and six 1 -bedroom units, he would have 32,500 sq. ft., which would leave him an oxcoas of 170 sq. ft., thus being in conformance with our minimum square footage for a 12 -unit ,apartannt building. B. ALIBRNATIVE ACTIONS, 1. Approve the variance request to allow a variance of 830 sq. ft. to build a 12-unit.apartmant building with eight 2-bodroom unite ' and four 1-bodroom unite. 2. Deny tho variance request and not allow an 830 cq. ft. variance to build a 12 -unit apartment building with eight 2-bodrocm units and four 1-bodro® unite. 3. REFERENCE AND BACKGROUND: Mr. John Plaisted and Mr. Jay Morrell, partners with Mel North in the Maus Tim building and storage building, are before you with a variance request similar Lu the one granted 1,efore on the Maus Tire building, with a new spec building erected with Martie's Feed and Seed being the leasee or renter of the building. The gentlemen are requesting a variance for the curbing in certain areas of the parking lot. They are intending to put curbing along the areas where the parking is to occur for parking spaces, but would like a variance from curbing (xi the rest of the perimeter around the driveway, parking lot area. There would be a separate entrance to the new Martie 'a Feed Store, and that would Lo off of State Highway 25 South onto Marvin Road, our currently not upgraded gravel surfaced street, for their entrance and exit out of their to -be -completed parking lot. Simple Subdivision Request - Tom Chock. (G.A.) A. REFERENCE AND BACKGROUND Tom Chock is before you with a request to subdivide the residential I,ot 3, Block 42, Original Plat to the City of Monticello. In doing so, he would subdivide the lot exactly in half, 33 ft. x 165 ft for each new subdivided lot, with half of the lot going to Lot 4 and the other half to Lot 2. On Lot 4 he currently has an existing 4-plex. In doing the simple subdivision, it would allow him to create another lot in which to build a proposed 4-plex. Mr. Chock did not got in in time for the public hearing process and will be before you again next month with his conditional use request to build a 4-plex on the newly subdivided Lot 3 if approved by the Planning Commission. Informal Planninq Commission Discussion to Hear a Rezoning Request to Rezone from R-2 to R-3, Applicant - Gordon Link. (G.A.) A. REFERENCE AND BACKGROUND. Mr. Gordon Link, along with his son, is proposing to have three of his residential lots, Lots 8, 9, and 10, Block 8, Original Plat, rezoned from R-2 to R-3 to allow him to build a proposed 8 -unit apartment building. Instead of going through public hearing process to have the rezoning request heard, City staff recommends that Mr. Link come in,along with his son,before you and present their proposed plans for their apartment building and ask for your input on their request to rezone Lots S. 9, and 10, Block 8, Original Plat, from R-2 to R-3. Mr. Howard Dahlgren, Dahlgren G Associates, the City's Consulting Planner, stopped in this afternoon, Thursday, May 3, 1984, to discuss with me the proposed rezoning request. Mr. Dahlgron had not driven by the site at this time but was getting some more information from me an the proposed request. At the time of this supplement, I will not have Mr. Dehlgron'e comments in regard to this request but will be presented to you at Tuesday night's Planning Commission meeting. Ono thing City staff recommended to Mr. Dahlgren was to look at more than just Lots 8, 9, and 10, of Block 8, Original Plat, but also to include the possibility of squaring off the existing R-2 zoning of Blocks 22, 23, 8, 9, T, and S, Original Plat Addition to the City of Monticello, and include those blocks in his consideration with the rezoning request. Therefore, it would not be spot zoning just Lots S. 9, and 10, of Block S. Original Plat Addition. Mr. Dahlgron indicated the reason that that was loft in the original planning, Blocka 22, 23, 8, 9, T, and S, was that those blocks contained larger older homoo, and he thought they would be boat protected within the area if it was zoned R-2 and not have apartment buildings all around thoca nicer old home. REFERENCE AND BACKGROUND: Mr. Phil Ritze, son of Charles Ritze, would like to build a garage separate from his Dad's building on his Dad's lot just east of the existing building on his Dad's property. In doing so, Mr. Ritze is proposing to clean up the area entirely, disposing of existing scrap iron, equipment, heavy road equipment, used trailers, brush and debris that currently exist there. In doing so, Mr. Ritze is proposing to put some existing equipment and the two trucks which he currently owns and uses in his business under cover or storage in this cold storage building he is proposing to build. In doing so, it would be a colored type building which would be harmonious with the existing housing and tree development there. YX. Ritze's property is currently existing under the Grandfather Clause. We do address in our R-1 Zoning that we do not allow accessory buildings other than the principal use. We have a principal use here with an existing attached garage to the principal use and the separate building for Mr. Charles Ritze's equipment. What City staff is looking for from Planning Commission members is how to address a situation like this wloro we have an applicant that is willing to clean up a very blighted area, put up a nice building, and conform as well as can be done within the R-1 neighborhood and yet still be allowed to build hiu cold storage building. We have allowed, in the past, Ruff Auto Parts to build a cold utorage building to put come of their car parts under cover. Mr. Ritze's request is very similar only hio is good equipment that ho is intending to put under cover. What he io intending to diopooe of is the uxicting equipment that he no longer has use for, scrap metal, bruoh, and debrtu, and clean up the area entirely and try and blend it an much into the rociduntial neighborhood au can possibly be done through aosthotic effects of tho building and the planting of additional chrubbory, trcce, and so forth. - 5 -
