Members Present: Jim Ridgeway, Joyce D -+ling, Richard Carlson, Don Cochran, Ed Schaffer. Staff Members Present: Gary Anderson and Kick Wolfsteller. The meeting was called to order at approximately 7:38 P.H. by Chairman Jim Ridgeway. 2. Approval of Minutes. A motion was made by Don Cochran, seconded by Joyce Dowling to approve the July 5, 1983 minutes. 3. Public Hearing - W. J. Murphy - Front Yard Setback Variance. Mr. N.J. Murphy, representing the Americ-lan, presented his proposal for an addition onto his present building. kr. Murphy is requesting a front yard variance of 12 feet to build the proposed addition to the building to within 18 feet of the front property line. Mr. Murphy indicated that he had reduced the number of rooms from 38 to 36 and that possibly he could get by with a 10 foot variance setback, which would leave no with a 20 foot front yard setback. Anderson aunmitted to the Planning Commission for their review a letter from Reinert Homes, Inc., the property owners for Hi llnide Phase I, in which they stated thou opposition to the approval of the front yard variance requost. They ntatad that the new propoued addition to the existing building would calls, a hindrance to the vi:.,bility oL the inturoaetion of Cedar Stroat and laurinq 1linu. Also, with the number of chiLdrnn that May in the arca, the reduced vi:iibility would be a hazard to Lhe children. Mr. Murphy's Luilding is going to be net in 10 feet from the prooenl building to the west, which would help the vi:,ibility to the souLh. Cammiouion members, taking into consideration the viaihi lity queation,answered that there baing only two buildings on that block with the 10 foot encroachro nt into the tront yard uetbacl, not being a dotiiment to the other affected property, a motion wan made by Don Cochran, ueennded by Joyce Dowling to approve the variance request for a 10 font front yard setback. The motion wan carried unanimously. Planning Commission Minutes - 8/9/83 4. Public Hearin - Conditional Use Reauest - Sign Relocation — dlocher Outdoor Advertisirw. Mr. Lee Ibberson, plant manager for Blocher Outdoor Advertising, was present and presented his proposal for the relocation of a single pole outdoor advertising sign on Lot 11, of Thomas In- dustrial Park. Mr. Ibberson indicated that Blocher Outdoor Advertising is currently in the process of purchasing the property and stated that the highest and beat use for the property is not the outdoor advertising signs itself, but that the beat proposed use is for the development of the property for industrial purposes. Mr. Ibberson indicated that Blocher Outdoor Advertising's position is to develop the property and not to hang on to the property for its sign purposes. 7Te owner indicated the high cost of the purchase of the land and therefore, it would not be practical to hold onto the parcel for just the location of the advertising sign. The intent of the original ordinance that was adopted was to eliminate al 1 signs on the freeway, and this request is not only a relocation of a sign but is basically constituting a now sign request. Mr. Larry Carter,of MacCarlund Plaza , was also present and indicated to the Planning Commission members that they wo zo in the negotiating stages of selling this property to Blocher outdoor Advertising for the purpoue of having Me two signs located hero but with the otipulation that the property is to be developed at acme point in time. The Planning Commission memborp, rccognLz ed the fact that it to a proposed varianco for a now sign which is against the ordinance,and oleo acknowledged the fact that Blocher Out— door Advertising is purchasing the proporty for erection of those cigno . A motion was made by Richard Carlson, second- ed by Don Cochran to deny the request for an additional out- door advortioing sign. The motion was carried unanimously. 5. Public Hearin - Variance Baguet - Number of Parkins_ Spacon Woruirod - St. Henry's Catholic Church. Mr. Larry Michlbaucr and Fran fair, representing St. Henry s Catholic Church Parking Lot Committec, presented information to the Planning Commission for davelopment of a parking lot. The plan indicated the layout of the parking lot with curb and gutter and hard surface parking arm the number of parking cpacea which would moat and exceed the current roquiromento for parking which the committee indicated. Duo to the foacibility of the project and this being a complete separate project from Cha propoced addition to the Catholic Church, the Parking Int Committee would like core time to develop the parking lot. Many memb.,ts responded that a five year plan would bu very feasible and an earlier completion of the project would be quite likely. A motion was then made by Don Cochran, seconded by Richard Carlson to approve the variance for parking requirements for a maximum of five years. Thu parking require- ments being hard surfacing of the lot, curb and gutter and the number of parking spaces being installed, but with one condition attached to the motion that the church committee after three years set up a meeting with Planning Commission Members for an overall review of the completion of the project. The motion was carried unanimously. 6. Public Hearinq - Variance Request - Proposed New Health Club - James Powers. James Powers presented his new proposal for the parking lot of his new proposed health club. Mr. Powers has come up with ap- proximately 187 parking spaces as compared with 215 being required and 25% being allocated for compact parking and Mr. Powers indicated that he would meet the 215 spaces that are required. Mr. Powers also indicated that he would be within 10 feet of the front property line and that he would also want to be within 10 feet instead of the 12 fcuL that was publiuhed in the public hearinq and would require an 18 tool va r i "Inca. I1ru.Jeff Rowan was present to request a variance to allow re- placement of an oxiating garage within throe feet of the oido- yard cotback. Anderson noted that thin wau an older auction of town and the placement of Lite garages in the areas aro around 3 foot of the oidoyard lot lino, and the City ordinances were adopted after the garages were built, therefore, the yaragou are currently in violation of the ordinance. A motion was made by Joyce Dowl+.ng, seconded by Richard Carlson and carried unanimously . 8. Public Hearing - Proposed Amendment Request to the Ordinance to Allow Flea Markets in a B-3 Zone. Jim Ridgeway read the staff proposed ordinance amendment to allow flea markets in a B-3 zone. On the completion of the proposed staff recommendation and list L� all,:;-.• a flea market, Mr. Ridgeway opened the floor to the public for more input from the audience. Mr. Hobert McWnald, Monticello Mall partner/part owner of Monticello Mall,comnunted on flea markets not suited for the Monticello area, especially the overflow parking lot at the Dairy Queen. There are no sanitary facilities available at this location and also the litter that would result from the flea market. Mr. Arthur Dorn Mall tenant, claimed his reason for opposition to the flea market was that it was a detriment to the existing busineos'c who pay their fair share of taxes in the area. He also discussed acme of the problems with the flea market that already are .existing. Discussion then centered around the background of a transient morchant permit and the conditions of a transient merchant permit. Judy Osowski, of Oswki'o Flea Market, was present and stated that his flea market- attracts arketattracts poople from the Minneapolis/St. Paul area, the Dakota's, Iowa and Wisconsin. Theoe people who come to his flea market take on lodging here in Monticello, buy their gau and oleo their food. Mrn. Oaowoki indicated that approxi- mately 90e of hiu buninenu in from eut of the Monticello area. He utated that the flea market in aluo attracting business to the businsso in the Mill, and that the tenants out at the fhm market do pay their taxes, not. the property or real estate taxes that ate paid by the busino• !:men Lhrmselves, but do pay uther types of taxes. Mr. Leruon indicated to t.hr 1 fanning Cotnaiusien numbers F1 Planning Commission Minutes - 8/9/83 that the overall design of the parking lot would be in compliance with the Monticello parking ordinances except with five foot green area that is required around the perimeter of the parking lot. Mr. Larson indicated that they would like a two foot variance on the north side of the parking lot and the northwest portion of the parking lot. Mr. Larson indicated that with the proposed parking lot, a total number of 23 parking spaces would be provided, but the total number required is 28 spaces. Mr. Rick wolfsteller indicated to Mr. Larson that the total number required would be 31 spaces because we still have to con- sider the 3 spaces that must be provided plus 1 per 200 square feet of gross floor area. Rick also indicated to Mr. Larson that the total number of compact spaces to be provided can only be 25% of the required amount. The Planning Commission members took into consideration the following: the overall layout and review of the project, the conformity of that building within that end of town, and widening of the narrow access to the Post Office parking lot. Don Cochran made a motion, seconded by Joyce Dowling to grant the variance on the north and south sides required for green area around the perimeter of the parking lot from five feet to three feet and also to grant the vari- ance for the required amount of parking apacen from 31 to 23 parking spaces. Thin motion was carried unanimously. ADDITIONAL INF094ATION ITEMS At this time, member Ed Schaffer departed from the meeting at 10:08 1,.M. 1. Conditional Use Request - Monticello Assembly of God Church. The Church was under the impression that the City of Monticello would ho interested in purchasing their old church property for a Senior Citizen's Center. The City has indicated to them that they aro not interested in purchasing the property. Also, the proposed tenant to relocate to that building who requested a conditional use request has purchased other property, and therefore, thin request was withdrawn altogether. 2. Proposed Amendment Rquest to the Ordinance to Allow an a Conditional Use a Major Auto Rnpair in a 0-3 Zone. Anderson introduced Jay Morrell, partner in a corporation which currently owns the property next to and Including the Rose Tire Building. This not being a public hearing, Mr. Morrell only briefly presented his proposal for a pro- opoctive body shop relocation on thin site, and possibly r - planning Commission Minutcs - 8/9/83 it could be De Boer Auto Body Shop now located on Hwy 25. Water and sewer would be extended to this property at the owner's expense. The developer is currently aware of the possible conditions that may be attached to the proposed conditional use request. Mr. Morrell indicated that he would be present at the next regularly scheduled meeting in September to present his final plan for approval or denial of this conditional use for a major auto repair in a B-3 Zone. Proposed Conditional Use Request to Allow Two Rental Buildings in a B-3 Zone. Anderson received a call on Tuesday afternoon to have this item dropped from the agenda, however, Anderson had another informational item in its place to pass onto the Planning Commission members and that being that the Pumpkin Patch Day Care Center has purchased a building for relocation for its existing facilities. Mr. Lindberg would be in at the next regularly scheduled Planning Commission meeting to request a variance on the hard surtaced parking requirements. Members Present: Joyce Dowling, Don Cochran, Jim Ridgeway, Rrchard Carlson, Ed Schaffer. Staff Members Present: Gary Anderson. Council Members Present: Mayor Arve Grimsmo. The meeting was called to order by Chairman Jim Ridgeway at 6:50 P.M. 2. Approval of the Minutes. A motion was made by Don Cochran, seconded by Joyce Dowling to approve the minutes of the August 9th, 1983 meeting. 3. Public Hearing - James Powers - Front and Rear Yard Setbacks and Parkinq Space Requirements. Jim Powers was present to present his proposed now plan for additional parking spaces. Most of the discussion centered around the parking variance requirements. Mr. Powers indicated that he has 201 parking spaces. The number required,if this facility is being used as a health club center only, would be 190 spaces, but if it were being used as a joint business establish- ment containing a bar/lounge in the upper floor, it would require 215 parking spaces, therefore, Mr. Towers would be short 14 parking spaces. Ile has requested a variance to this parking opcco requirement. Mr. Powers stated that there will be an access put in to corvico the rear of the property during eonotruction and also to oervo as an emergency entrance and exit only at this time. Taking the above statements Into consideration, a motion was made by Ed Schaffer, seconded by Don Cochran, to approve the variance request of 14 parking apacoo and aloo to approve the 20 foot variance in the front and rear cotbacka. RON Planning Commission Minutes - 6/22/83 Due to a conflict in our next regularly scheduled meeting that was tentatively scheduled for September 13, 1983, a motion was made by Ed Schaffer, seconded by Joyce Dowling to approve setting the next tentatively scheduled meeting for the Planning Commission to September 6, 1983, at 7:30 P.M. The regularly scheduled meeting that was to be held on Septem- ber 13, 1983 has been taken by the City Council due to the fact that their regular meeting to be hold on September 12, was cancelled until September 13. The City Council cancelled their meeting because of the annual Industry and Business Day Banquet scheduled for September 12, 1983. There being no further business, a motion was made by Ed Schaffer, seconded by Richard Carlson to adjourn the meeting. The meeting adjourned at 7:05 P.M. Gary Andoroon Zoning Administrator - 2 - Planning Commission Agenda - 9/6/83 AGENDA SUPPLEMENT 3. Public Hearing - Robert and Mary Saxon - Sideyard Variance Request. Mr. s Mrs. Saxon who currently own the house located next to the east Bridge Park would like to build an attached two car garage, but due to the design and construction of their house they are unable to build an attached garage. Therefore, the Saxon's are requesting a 5 foot Sideyard variance to build the proposed double car garage within 5 feet of the property lot line. The proposed double car garage will be a detached garage with a 4 foot walkway between the existing house and the proposed garage. The City is the only affected property owner to the west of the Saxon's property. One concern the City has is with the construction of the new bridge across the Mississippi River in which a portion of our East Bridge Park would be used for the construction of the bridge. As part of the over all project, municipalities can acquire land for which land has been lost due to proposed bridge construction. Additional land may be purchased to off sot the land that would be used for the proposed bridge and in acquiring the land, the State would reimburse the municipality, the City of Monticello, for any land acquisition. At this point, tho City would like to acquire the Saxon's property for a proposed parking lot for the East Bridge Park, therefore, eliminating any parking or driving through the park. Mr. Tom Eidem and myself will be meeting with Mr. Saxon on Friday at approximately 1000 A.M. to diocuus this with him. Any comments of our meeting with Mr. Saxon will be attached with the agenda supplement or be presented at Tuesday's Planning Commisoion meeting. Conditional Use Request - Monticello Assembly of God Church. This is a continuation of an original public hearing held on June 14, 1983 Monticello Planning Commission meeting. The church has decided to pursue their request to allow as a conditional use in an R-2 zone, a day care center. The only information that I have to pass on to you would be that the Pumpkin Patch Nursery had been in to obtain a building permit to relocate their day care center to Mr. Marvin Framer's property. They had intended to purchase the property from Mr. Kramer and convert the house into a day care center but that deal has fallen through. Therefore, the Assembly of God Church has obtained a conditional use to have the Pumpkin Patch Day Care Center in their facilities. This is only what I assume that they intend to do as they have not sold this property yet. They would like to have some kind of income from this property and therefore, they have applied for a conditional use to have a day caro facility on this property in an R-2 zone. Possible Vacation of City owned Streets and New Platting of tho Property in the Lauring Hillside Addition - Property Owners are Construction 5. Public Hearing will be hold on September 13, 1983, and possible City street vacation in exchange for Lauring Lane axtension relocation. Mayer-Rohlin, Inc., Engineers and Land Surveyors, have been hired by Construction 5 to design a site plan layout for the development of Phase I and Phase IX apartment building complex. Tho main concern of the owners and the land surveyors and engineers at thio time would be the vacation of Hennepin Street from Burlington Northern Railroad to Sixth Street or touring Lane. This street vacation is necessary to proccod with plans for Phase Z of a 24 unit apartment building complex. The City Staff has recommanded to the owner that we would not only like to sea a partial dovolopment of the entire property but that the whole property is developed with the plane that are intended for its that being if the City vaeatco all of Hennepin and Seventh Stzoeto and part of touring Lane for the owner that the area would be plattod, thoreforo, oliminatingpirtial platting and vacating of any streets.
