REGULAR MEETING - MONTICELLO PLANNING COMMISSION
September 6, 1983 - 7:30 P.M.
Members Present: Richard Carlson, Jim Ridgeway, Joyce Dowling.
members Absent: Ed Schaffer, Don Cochran.
Staff Present: Gary Anderson, Thomas Eidem.
T:ie meeting was called to order by President Jim Ridgeway at
7:39 P.M.
2. Approval of the Minutes of the Special Meeting.
A motion was made by Joyce Dowling, seconded by Richard
Carlson to approve the Special Planning Commission Meeting
Minutes of the August 22, 1983 meeting. Members voting
in favor: Joyce Dowling, Richard Carlson, Jim Ridgeway.
Members absent: Ld Schaffer, Don Cochran. The motion was
carried.
3. Public Rearing - Robert and Mary Saxon - Sideyard variance
Request.
Robert and Mary Saxon were present to r.oquest a variance
to build a two -car detached garage that. would be located
within five feet of the sideyard property line, therefore,
requiring a five foot sideyard variance with the City being
the only affected property owner. fir. Thomas Eidem, City
Administrator, was present on the City's behalf. ;4r. Eidem
indicated to the Planning Commission members that the City
would be interested in purchasing Mr. and Mrs. Saxon's house
for use as a parking lot for East Bridge Park once the new
bridge is in. Mr. Eidem indicated to the Planning Commission
members that he and Gary Anderson, Zoning Administrator, had
met with air. Saxon on Friday morning to discuss the possible
sale of his property to the City. At this point, no firm
committment or purchase price has been submitted by either
party involved. Commission members noted that the City has
not submitted a proposal to Mr. and Mrs. Saxon. A motion
was made by Joyce Dowling, seconded by Richard Carlson to pass
this on to the City Council for their consideration due to
lack of a proposal on the City's part for acquisition of Mr.
and Mrs. Saxon's property. Members voting in favor: Joyce
Dowling, Richard Carlson, Jim Ridgeway. Members absent:
Ed Schaffrr, Don Cochran. The motion was carried unanimously.

4. Conditional Use Request - Monticello Assembly of God Church.
This being a continuance of a June Conditional Use Request
by the Monticello Assembly of God Church, the Planning
Commission members asked what the Church's intent was to do
with the Conditional Use Permit. Zoning Administrator
Anderson replied that he has not heard from Monticello
Assembly of God Church and that the Pumpkin Patch has not
gone ahead with their proposed plan to relocate their day
care center in a new location. Anderson also presumed that
there would possibly be a new site for the Pumpkin Patch Day
Care Center in the old Monticello Assembly of God Church.
Commission members noted that no one was present from
Monticello Assembly of God Church, and not knowing what their
real intent was for the Conditional Use Request, a motion was
made by Richard Carlson, seconded by Joyce Dowling to deny
the request for a Conditional Use of the Monticello Assembly
of God Church- Members voting in favor: Richard Carlson,
Joyce Dowling, Jim Ridgeway. Members absent: Ed Schaffer,
Don Cochran. The motion was carried unanimously.
ADDITIONAL INFORMATION ITRr15
1. Conditional Use Request to Allow ,daior Auto Repair in
B-3 'Lone.
The Commission members were inlormcd that J.iy Morrell had
withdrawn his request for a Conditional Use to allow major
auto repair in a 13-3 Zone.
2. Possible Vacation of City Owned Streets and New Platting
of the Property in the Lauring Hillside Addition - Property
Owners are Construction 5.
This not being a public hearing, just an information item
passed on to the Planning Commission members, Mr. Gua
La Fromboise was present from Construction 5, Inc., to present
their proposal for development of Phase I and Phase I1 in
Lauring Hillside Addition. tor. La Fromboise pointed out to
the Planning Commission members his intent to develop the
adjacent property next to his current 12 -unit apartment
building under construction nearing completion of construction.
Under Mr. La Fromboiso's plan,if the City would vacate Hennepin
SLreet from ilio railroad tracks to Lauring Avenue, in return
Mr. La Fromboise would give to the City extension of Lauring
Lane Lo connect with the old platted Washington Street, which
would provide road access to the undeveloped property alonq
the freeway. Mr. La Fromboise indicated to the Planning
Commission members that his 12 -unit apartment buildiny currently
under construction is already filled without even advertising
apartments for rent, therefore, n,'CLrc;ttating his need for an

buildings would be located right in the platted Hennepin
Street, therefore, necessitating the need for the City
to vacate the street for Mr. La Fromboise to go ahead with
his project. No formal proposal has been submitted by
either Mr. La Fromboise or the City of Monticello for street
vacation purposes. Mr. La Fromboise also indicated to
the Planning Commission members that due to the current lay of the
land on his proposed apartment building site, he would have
to do some site work prior to construction of his 24 -unit
apartment buildings. Mr. La Fromboise indicated to the
Planning Commission members that he intended to keep a natural
drainage along the north side of Lauring Lane to allow storm
water drainage to continue along Lauring Lane onto and down
Washington Street to the culvert going across Washington
Street to our storm sewer catch basin; also in placement
of the proposed 24 -unit apartment building and the parking
lot for it,he indicated that enough room was left for
proposal of the interceptor sewer line along the railroad
tracks. The Commission members agreed that Mr. La Fromboise's
plan seems workable and suggested passing it on to the City
Council for their review.
3. The next tentative date for the Planning Commission Meeting
will be October 11, 1983 at 7:30 P.M.
Due to the conflict with the October 10, President's Day
holiday, the Monticello City Council decided to have their
meeting on October 11. Thorefore, the Planning Commission
members decided it would be feasible for them to have their
next tentatively scheduled October meeting on October 4, 1983,
at 7:30 P.M.
Motion by Joyce Dowling, seconded by Richard Carlson, to
adjourn the meeting. Members voting in favor: Joyce Dowling,
Richard Carlson, Jim Ridgeway. Members absent: Ed Schaffer,
Don Cochran. Tho motion was carried unanimously. The meeting
was adjourned at 8:24 P.M.

AGENDA SUPPLEMENT
3. Public Hearing - City of Monticello Rezoning Request.
Blocks 32 and 17, formerly known as the Oakwood Block when the
City in turn sold it to Security Federal, were assumed to have
been rezoned from an R-2 to a B-4 Zone. In checking further
into the records, we find no change ever taking place of the
rezoning from R-2 to a B-4 Zone. Therefore, before further
development of the property can be made , the rezoning would have
to take place.
PQSSIBIE ACTION: Consideration of approval or denial of the
rezoning request to rezone from an R-2 to a B-4 Zone.

Public Hearing - Milton Olson - Hard Surfacing Parking Lot
Variance Request .
Milton is currantly building a 60' x 120', 7,200 sq. ft. casement
level combination retail electrical business in front, tho
middle portion being an electrical repair shop and electrical
parts storage, and the back part to be rented out for a body shop.
With construction as of today's dar-o, the walls are currently going
up. Due to tho lateness of the construction season and allowing
the settlement of the proposed parking site out there, Milton is,
therefore, requesting a variance to allow him up to one year
to put in his hard surfaced parking lot. Milton intends to put
in the hard surfaced parking as soon as possible in the spring
to complete his project.
POSSIBLE ACTION: Consideration of apptoval or denial of a hard
surfaced parking variance request.

a photo to bo presented at the mea ting on Tuesday night noting
the location of the building and the parking lo: on the property.

5. Public Hearing - Dr. Maus - Rezoning Request.
Dr. Maus currently awns the former Monticello Clinic, Ltd., building
located across the street from Golden Valley Furniture. Dr. Maus
has relocated his practice from this building to another site.
In looking at the possible ways of renovating his building for
other uses, Dr. Maus is considering putting in apartment buildings
on the main floor. Apartment buildings in a B-4 Zone is currently
not allowed, but apartments currently in the B-4 Zone before the
Zoning Ordinance went into effect are still allowed and, therefore,
continue as a non -conforming use in a B-4 Zone. Looking at other-
instances
therinstances along the 3-4 Main Street Zone, I find where other new
apartments have been built but aro basically old apartments that
were existing but have been renovated into new apartments. Therefore,
in looking at Dr. Maus' request, he would be requesting apartments
to be built in a building that is already existing but the business
that was existing there was a conforming use. Therefore, with him
proposing to put in apartments in this building, it would be a non-
conforming use in a B-4 Zone.
POSSIBLE ACTION: Consideration of approval or denial of a rezoning
request.
