MINUTES
REGULAR MEETING - MONTICELLO PLANNING COMMISSION
Tuesday, October 16, 1979 - 7:30 P.M.

1. Approval of Minutes.
Motion was made by Dave Bauer, seconded by Ed Schaffer and unanimously
carried to approve the minutes of the Regular Meeting of September 18, 1979.
2. Public Hearinq - Consideration of Recommendinq Approval of Curtis Hoglund's
Subdivision Request for Macarlund Plaza.
Mr. Ron 110glund prevented to the Planning Commission the intentions of
Mr. Curtis Hoglund to subdivide his property (9.4 acres) on East Broad-
way into 67 lots.
The purpose of the request is to develop commercial property on Lots 2
thru 6 of Block 1 and residential property on Lot 1, Block 1 and the
balance of the Lots on Block 2 through 11 and Outlot A.
The immediate plana oro to develop townhousas on Block 2 thru 11 with
outlot A to be used as common shared ground for the townhouse ownors.
There wan concern expressed that if the property were given cervices
off of Mississippi Drive as to whether or not adequate water pressure
could be developed. However, at a previous Council meeting, Mr. John
Badolich, the City Engineer, informed the members that plane and opecifi-
cations could be doveloped that would make servicing Maearlund Plaza
from Mississippi Drive feasible.
Presently, also, the developer to considering requesting looping of the
water services from the east end of Mississippi Drive along County
Road 79 and East Broadway to approximately Dino's Other World to give
bettor water pressure and circulation. Other affected property owners
would have to be contacted in this cane, however, and a public hearing
hold.
Mr. Badslieh roeammendod approval of the preliminary plat of Macarlund
Plaza if the developer would drain the hardourfaced parking and road
area to a catch basin or series of catch haoino along the route to and
at the went end of the road area and then drain the runoff through a
series of storm sower and manholas across Lot 14, Block 7 of the Hoglund
Addition, which to owned by Curtis Hoglund, and into the existing storm
sower lino on Micniocippi Drive.

Mr. Hoglund is proposing to dedicate all of Lot 14, and whatever part
of Lot 13 of Block 3 in Hoglund Addition that is necessary to meet
the park ordinance requirements.
A motion was made by Ed Schaffer, seconded by Dave Bauer and unanimously
carried to recommend approval of Macarlund Plaza's preliminary plat
contingent upon following the engineer's recommendations and recommended
that the looping of the services from Mississippi Drive at County Road
39 to Dino's be given consideration.
3. Public Hearing - Consideration of a newest for a Conditional Use Premit -
Cbrtis Hoglund.
In conjunction with Item M1 above, Mr. Hoglund is requesting a condi-
tional use permit to develop townhouses on Blocks 7 through 11 and
garages for those townhouses on Blocks 2 through 6. Each individual
townhouse would have a single attached garage and a single detached garage.
Outlet A would be owned by a townhouse owners association and by agree-
ments signed by all parties and binding on all property owners would pro-
vido for maintenance of all common ground areas.
The owners association agreement has been reviewed by Gary Pringle,
tho City Attorney, and has received his preliminary approval.
On a motion by Dave Bauer and seconded by Ed Schaffer, the rocommenda-
tion for approval passed unanimously.
4. Consideration of a Variance Request - LaRavne Voqt.
faRayno Vogt, on behalf of a client who presently wishes to remain
anonymous, requested a variance to allow an owner-oporatod beauty shop
in a residence located on the Ny and the MS of Lot 3 and NS of Lots 4 c 5,
Block 36, Lower Monticello, currently owned by Ralph Kiffmoyer. Zoned R-2.
The prospoctive operator would agree, if granted the variance, to be the
only operator of this shop, and to not have any employees, and to place
a sign on the property no more than 2' x 3' for advertising the business,
if a sign were used, and thio oign is to be approved by the Building Official.
There were no comments, pro or eon, offered prior to or at the Planning
Cemmiou ion meeting from affected neighboring property owners.
Notion wag made by Dave Bauer, seconded by Ed Schaffer and unanimously
carried to recommond approval of this varicnco request.
S. Oonside ration of a Simolo Subdivision of Prorwrty - Troy Chaplin and
Lawronco Hoyt.
Mr. Troy Chaplin and Mr. Lawrence Hoyt, who aro abutting property owners,
made a request to make nems exchange of property between themselves
to batter arrange their property linen, and rosolve a problem which
exists bocauoo one of the owncre has a driveway which Is partly an

the others lot. Both property owners made the request which would tend
to make their lots more rectangular rather than the present wedge shapes.
t Motion was made by Mr. Dave Bauer, seconded by Ed Schaffer and unanimously
carried to recommend approval contingent upon the certificate of survey
being prepared and recording be done by the process outlined in the
Monticello Ordinances.
6. Miscellaneous.
Mr. David Klein came before the Planning Commission to get a tentative
response about rezoning Lots 9 s 10 of Block d, lower Monticello, from
R-1 to R-2 so he could remove the existing house and build a new duplex.
The Planning Commission members indicated they could possibly be
favorable to his request, but clarified that any decision would have to
be made after holding a public hearing on the matter.

AGENDA SUPPLEMENT
2. Public Hearing - Consideration of Variance to Allow Second Accessory
Building - Robert Jamison.
Mr. 6 Mrs. Robert Jamison would like a variance granted to them
to allow for the erection of a log cabin on their property
located south of the High School.
Presently, under Monticello Ordinances, only one accessory building
is allowed on a parcel of R-3 property without a variance.
The log cabin which the Jamison's are proposing to re -erect, is
to be moved onto their property from another location in Wright
County. It has historical value as a pioneer home and would be
used for school tours, etc., to provide a spectator a view of a
home of the past in this area.
Building codes would not need to apply to this building because
of its historical nature. No objections have been received in the
City Office as of the time of the writing of this agenda.
POSSIBLE ACTION, Consideration of recommending approval or denial
of this variance request.

3. Public Hearing - Consideration of a Variance Request Curbinq and
v Driveway Openinq Size - Monticello Dorchester VFW.
Mr. Stuart Hoglund, representing the Monticello Dorchester VFW Post,
has requested a variance to be able to eliminate portions of the curb
around the parking lot and also requested a wider driveway opening at the
new Club building on South Cedar Street, east of the Perkins Restaurant.
Presently, Monticello ordinance requires parking lots to he hardsurfaced
and completely surrounded with concrete curbing to control drainage,
with no driveway openings larger than 24'0" without a variance.
At the time the new parking lot was developed this past fall, it
was not constructed according to the directions of the City Engineer,
and rather than part of the lot draining towards Cedar Street, nearly
all drainage is toward the Freeway ditch. The lot was constructed
also with an entrance/exit driveway approximately 90' in width.
Since the drainage of the parking lot is now toward the Freeway ditch,
the VFW Post feels that curbing all around the lot would be unnecessary
and would like a permanent variance to eliminate the curbing from the
west end of the new building, counter -clockwise around the parking lot
over to the SE corner of the lot along South Cedar Street.

Mark Weld, with the Minnesota Department of Transportation, has expressed
some concern about adding that amount of additional drainage created by
the lot into the 1-94 ditch. As of this time, we have received no
continents - pro or con - in writing, but Mr. Wold has committed a response
by Tuesday's meeting.
Also, the Post would like to maintain a 90' driveway by variance, rather
than construct two 24' driveway openings, as proposed at the tisk the
building permit was issued and as required by ordinance.
It ohould he pointed out that when the building permit was applied for,
the drainagu plan was submitted to the City Engineer for hio approval,
as required by ordinance, and the ownera agreed that the parking lot
would be conatructod as per the submitted plan, and it wan on that bania
that a permit wan issued. However, the owner changed the design and com-
plated the inotallation of the parking lot hardourfacing without notifying
the City of the change, which would have cauood the need for a variance
hearing before the fact, rather than after the fact which in the prosent
case. It aeomo that the City io now faced with two choices - either to
require t hat the lot be roconotructod to meet the original apecificationo
under which the original building ponnit waa granted, or accept the lot
in its present propooed state.

It is the Zoning Administrator's opinion that the City would be
�j hardpressed to grant a variance for a 90' driveway opening in lieu
of two 24' openings since others who made similar requests were
denied the same request in the recent past.
Additionally, the VFW would like a temporary certificate of occupancy
until August of 1980 to complete landscaping and parking lot require-
ments.
CONSIDERATION: Recommending denial or approval of variance request.

Mr. Quintin Lanners is proposirg to purchase Lots 11, 12 6 the
East 10' of Wt 13, Block 40, Original Plat, from the Dan Giddings
property at Q 648 West Broadway. Lot 13 would be divided into two � pieces - or,u 10' piece to Mr. Lanners and one 23' piece to remain
with Mr. Giddings property.
J In order to subdivide this Lot, a bare lot would be created and
there in no building on the West i of Lot 13 which would be closer
than 10' to the proposed new lot line.
A certificate of survey hasn't been prepared yet, but any final
Baction would he pending upon a proper certificate of survey.

MEMORANDUM
Attached is a copy of a letter handcarried to this Office on November 19,
1919, from the MnDOT regarding the variance hearing which the VFW is
❑_questing so that they might he given permission to open, as follows:
Their immediate request is to be able to open until August 1,
1980, without completion of landscaping or curbing and with the
present wide driveway.
2. Their secondary request is that they be given a permanent variance
of these items an mentioned, landscaping and curb, and that the
driveway be maintained at 90' rather than the two proposed openings
of 24'.
(Note: Item M1 does not require a public hearing - only Council action.)
11r. Mark Woell, of the Department of Transportation (ro'r), came to
Monticello this past Wednesday to review the variance request. He
found, as is stated in the letter, that the City of Monticello would be
in violation of their contract with the State if the VFW were allowed
to drain their lot into the freeway drainage area. The State and the
City formed a contract when the Freeway wan built that doesn't allow
for any further drainage into the Freeway ditch syotem without both portion
having firnt agreed to the name.
Without further study, Mi. Woell felt the drainage would overload the
present storm never and ponding areae. Ile further stated that the City
in presently in violation of their contract with the State by h.ving let
Perkins drain their lot into the ditch.
As stated in the letter, th,• 1,01' would like a few more weeks to study
the nituat.ion and do hydraulic's calculations to determine what, if any,
action should he taken.
Possibly, if any action ij taken toward❑ a recommendation, the recommenda-
tion should include a bond which would ho largo enough to fully correct
the problem of lot drain•ge and club and landoeapinq should It become
noeonsary to correct the alroady-installed lot.
