I MINUTES REGULAR MEETING - MONTICELLO PLANNING COMMISSION Tuesday, March 8, 1988 - 7:30 p.m. Members Present: Richard Carlson, Joyce Dowling, Richard Martie, Cindy Lemm Members Absent: None Staff Present: Gary Anderson, Rick Wolfsteller, Jeff O'Neill 1. The meeting was called to order by Chairperson Richard Carlson at 7:32 p.m. 2. Motion was made by Cindy Leven, seconded by Richard Martie, to approve the minutes of the regular meeting held February 9, 1988. Motion carried unanimously. 3. Planning Commission Applicant Interviews. Zoning Administrator, Gary Anderson, indicated to Planning Commission members the procedure that would be used for the interview process with the Planning Commission member applicants. Anderson explained to the Planning Commission members each of the applicants present and that one, Mr. William Weisbrod, would not be present this evening but still would like to have his name considered as a possible Planning Commission member. Planning Commission members interviewed each of the Planning Commission member applicants present, those being Mr. Patrick Faltersack, Ms. Candi Thilquist, Mr. Dan McConnon, and Mr. Chris Donnell. After the interview process, Chairperson Richard Carlson thanked the applicants for attending the meeting and that they were all very well qualified applicants for the Planning Commission position. Zoning Administrator, Gary Anderson, representing all of the City staff, wished to thank all of the Planning Commission member applicants for attending tonight's meeting and that they were certainly welcome to stay for the rest of the Planning Commission meeting, and that they would be cent a letter indicating the time at which they would be interviewed by the Monticello City Council members at their meeting on March ld, 1988. No decision was rendered by the Planning Commission members at Lhis meeting. d. Tabled Re .guest for a Final Plat Review of the Proposed New Subdivision Plat. Applicant, City of Monticello. Zoning Administrator Anderson indicated to Planning Commisoion members and residents in attendance the City's proposed now subdivision plat to be known as Oakwood Industrial Park Second Addition. The City purchased Lots 9 and 10, Block 2, Oakwood Industrial Park, from the Oakwood Industrial Park Partnership to create six smaller lots ranging in size from 1.2 acres to 2.3 acres. With no input from the public and also no further input from the Planning Commisoion members present, motion was made by Joyce Dowling, seconded by Richard Martio, to approve the final Tlat fcr a proposed now subdivision plat. Motion carried unanimously. O Planning Commission Minutes - 3/8/88 Sketch Plan Review of a Proposed New Subdivision Plat. Applicant, Rent R7ellberg. Chairperson Richard Carlson opened the agenda item, not clearly understanding the applicant's request when there are some things that haven't been completed as per City staff. Zoning Administrator Anderson indicated to Planning Commission members that the developer, Mr. Rjellberg, is proposing to plat part of unplatted land currently in the Township into residential single and two-family residential development, mobile home park development, and also some commercial type development within the approximate 160 acre unplatted tract of land. Zoning Administrator Anderson indicated that Mr. Jeff O'Neill, Assistant City Administrator, would present on behalf of the City some of the City's concerns outlining the entire proposed development for them to brief them on the applicant's sketch plan request. Mr. O'Neill explained to Planning Commission members the staff's concern over the proposed area layout. The first concern of the City staff was that the property has been approved by the Municipal Board for annexation into the City even though the City has not received those official papers yet. Secondly, the Monticello City Council has not acted formally on whether or not to accept this plat into the City. The developers have come up with a lot and block layout on this entire unplatted tract of land prior to the City establishing some type of zoning for this proposed unplatted land currently in Monticello Township. Mr. O'Neill referenced to the City's Comprehensive Plan which showed how a proposed trail system and a proposed arterial road were to be laid out through this unplatted tract of land. Mr. Rick Wolfateller, City Administrator, explained to Planning Commission members additional City staff concerns as far as the zoning, which the developers are proposing multi -type zonings within this unplatted tract of land prior to the City establishing some type of zoning there before the developers laid out their proposed lots within the blocks in this unplatted tract of land. Mr. Wolfateller questioned the location of the proposed trailer park on this proposed sketch plan request. With the logical power line with the existing southerly most power line easement which runs through the property, it acts as a natural buffer from the existing Kjellberg East Trailer Park from the area proposed to be single and two family residential on this unplatted tract of land to the north of the southerly most power line easement. Mr. Wolfateller also explained the developers are proposing that the City take the entire land under the southerly most power line easement for the developers portion of the park dedication in land only. City staff is contending that if we accept any of this land underneath the power line easement, we would probably accept only a 50 -foot strip through the power line easement for the establishment of some sort of trail system through this area. Chairperson Richard Carlson questioned how the utilities would be laid out to serve this property. Zoning Administrator Anderson indicated on the sketch plan there are three different ways of serving 9 Planning Commission Minutes - 3/8/88 the property depending on how the developer would choose to service the property and how far south he would go beyond the proposed area to be annexed into the City. Zoning Administrator Anderson also questioned Mr. Dennis Taylor, Taylor Land Surveyors, the firm which has drawn up the sketch plan for the developer, Mr. Kent Kjellberg, as to what they were proposing for screening around their proposed trailer park. Mr. Taylor indicated that the developer, Mr. Kent Kjellberg, was proposing to plant rows, ut pine trees around the entire area of the trailer park which would abut single and two family residential zoning. Mr. Jeff O'Neill wanted to reiterate that the City's Comprehensive Plan was here prior to this proposed development and that certainly amendments could be made to the Comprehensive Plant but basically, the developer should have developed their development around the trailways and the proposed arterial road as were laid out to go through parts of this unplatted tract of land. Mr. Taylor questioned the layout of an arterial road system through this development in that he felt it was detrimental on the part of the City to have a main arterial road going through this residential plat. Mr. Richard Carlson, in summing up the proposed sketch plan request, sees some major issues that needed to be addressed first. They are as follows: 1. Whether or not the property will be annexed into the City. 2. That the City apply some type of zoning to this unplatted tract of land. 3. That the developer lay out his development on this unplatted tract of land after the City has established some type of zoning to this unplatted tract of land in the Township. Chairperson Richard Carlson then opened the meeting for further input from the Planning Commission members. Mr. Richard Martie indicated he was in agreement with statements from Mr. Richard Carlson in that he was in agreement with all of the statements which Mr. Carlson indicated previously. Mr. Jeff O'Neill indicated to Planning Commission members that there could be some possible revisions to the Comprehensive Plan and that the reason for the arterial road was to create a road system from the southerly most portion of the middle school property along 118 all the way over to a possible connection with Highway 25. commission member, Cindy Gemco, questioned personally not being willing to purchase a home next to the trailer park. Mr. Olen Pasusta, Kjellberg Trailer Park Manager, explained Mr. Kjellberg's intent of the mobile home park development within the single and two-family residential area. However, if the trailer park was going to be a holdup in the proposed sketch plan request that the developer, Mr. Kjellberg, would oak that the City work with him in further annexation proceedings for the development of land further south of the existing Kjellberg East Trailer Park. With no further inr%.ir from the public or the Planning Commission members, motion was made by Richard Martie, seconded by Joyce uowliny, to table the sketch plan request. Variance request to allow a proposed residential lot, when platted, to have less than the minimum lot frontage on a public right-of-way. Applicant, Charles Ritze. Council action: Denied request as per Planning Commission recommendation. 2. A tabled request for a preliminary plat review of a proposed new subdivision plat. Applicant, Charles Ritze. Council action: Denied request as per Planning Commission recommendation. 3. A conditional use request to allow as a home occupation a beauty shop in an R-1 (single family residential) zone. Applicant, Karla Dickey. Council action: Approved request as per Planning Commission recommendation. 4. A conditional use request to allow construction of more than one building on an unplatted lot. A conditional use request to allow construction of an apartment building in excess of the maximum number of units allowed. Applicant, David Hornig. Council action: Approved request with conditions as per Planning Commission recommendation. S. A rezoning request to rezone part of an unplatted tract of land from B-3 (highway business) to PZM (performance zone mixed) zoning. If property is rezoned, a conditional use request to allow construction of an apartment building in excess of the maximum number of units allowed. Applicant, Metcalf and Larson. Council action: Tabled as per applicant's request. 6. A rezoning request to rezone platted lots from B-4 (regional business) to PZM (peformance zone mixed) zoning. The meeting adjourned at 9:09 p.m. Respectfully submitted, ��A"t Cary Anderson Zoning Administrator 0 Planning Commission Agenda - 4/12/88 Public Hearing - A variance request to allow a loading berth to be constructee in the public right-ot-way setnacx requirement. Applicant, Automatic Garage Door Company. (G.A.) A. REFERENCE AND BACKGROUND: Automatic Garage Door Company, as noted on the enclosed site plan, is proposing an expansion of their existing building. With the proposed expansion of their building, the loading/unloading area, which is now done on the south side of their building, will be redirected to the east side of their building. With the redirection of their loading/unloading area to the east side of the proposed building addition, a semi -truck tractor will have to drive onto our public right-of-way to get backed up to the unloading dock. The applicant is proposing to be allowed to have the semi -truck tractor enter from the northeast driveway, come through their parking lot, and come out their southeast driveway out onto the public right-of-way of South Cedar Street, and then back up to the loading dock on the proposed new building addition. I would encourage each of the Planning Commission members to drive out to the site to look at the problems the existing site has with the building elevation in relationship to South Cedar Street. The building was constructed to be above existing Highway 25 but below the existing South Cedar Street. With it being allowed to be built that way, we have problems with surface water drainage coming at a very fast pace against the curb adjacent to the existing building. We, as the City staff, have a definite concern with the truck tractor being allowed to enter into the public right-of-way to back up to the loading dock area. When the truck tractor is backed up to the loading dock area, the tractor will be parked approximately 12 feet to 13 feet onto the boulevard portion of the public right-of-way. We feel that there are still possibly two other ways to accommodate the loading/unloading in a different situation within this property. The first situation would be that a portion of the building addition would be utilized as the unloading dock area where the semi -trailer would be backed into a portion of the building to accommodate its loading/unloading of the semi -trailer. By backing the trailer into a portion of the building addition when backed up to the unloading dock, it would be on its own property and not on the City public right-of-way. But also to accommodate this means the semi -truck tractor still must drive out onto Cedar Street public right-of-way to back up to the loading dock. Tho second situation would be to construct a building addition onto the southeast corner of the building to accommodate an unloading dock arca. With this addition, the semi -truck tractor could enter in the southeast driveway, come up into the parking lot, and then back up to the loading dock and still be on private property to accommodate the maneuvering to the loading dock area. In the second situation, we recognize that there ME Planning Commission Agenda - 4/12/88 may be some problems with the construction of this building addition in regards to the elevations which exist of the driveway portion that is currently used to get back to the existing loading/unloading area. We also recognize that this is probably the more expensive way to do itt but in reality, there would not need to be a variance to accomplish this. B. ALTERNATIVE ACTIONS: 1. Approve the variance request to allow a loading berth to be constructed within the public right-of-way setback requirement. 2. Deny the variance request to allow a loading berth to be constructed in the public right--of-way setback requirement. C. STAFF RECO E NDATION: This is a very difficult recommendation to make in that we do not want to discourage expansion of an existing business, but we also do not want to create a situation which may be a problem at some point in time in the future. We do believe that there are two other alternatives to the construction of this building addition for the loading/unloading area which may or may not need a variance request. We also recognize that the building was allowed to be constructed in the location that it is and that the owners of this building have to work with the existing conditions to accommodate their proposed building addition. The building or use for which application is being made to utilize the off-street parking facilities provided by another building or use shall be located within three hundred (300) feet of such parking facilities. ii. OFF-STREET LOADING: . )A) PURPOSE: The regulation of loading spaces in these Boning regulations is to alleviate or prevent congestion of the public right -of -ray and so to promote the safety and general welfare of the public, by establishing minimum requirements for off -$treat loading and unloading from motor vehicles in accordance with the utilisation of various parcels of land or structures. )e) LOCATION: 1. All roquirad loading bartho ohall be off-atroot and located on the same lot as the building or use to be served. 2. All loading berth curb cuts shall be located, at a minimum, fifty (50) feet from the intersection of two (2) or more street right-of-ways. This distanco shall be measured from the property line. 2. No loading berth shall be located closer y than fifty (501 feet from a residential district unless within a structure. 0 O 4. Loading berths shall not occupy the front yard setbacks. S_ Loading bertha located at the front or at the aide of buildings on a corner lot shall require a conditional use permit under the provisions of Chapter 22 of this Ordinance, and provided that: (a) Loading berths shall not conflict with pedestrian movement. (b) Loading berths shall not obstruct the view of the public right-of-way from off-street parking access. (c) Loading bertha shall comply with all other requirements of this Section. 6. Each loading berth shall be located with appropriate means of vehicular access to a street or public alley in amanner which will cause the least interference with traffic. (C) SURFACING: All loading berths and accessways shall be improved with not less than six (6) inch clean five base and two (2) inch bituminous surfacing to control the dust and drainage according to a plan submitted to and subject to the approval of the City Engineer. (D) ACCESSORY USE, PARKING AND STORAGE: Any space allocated as a required loading berth or access drive so as to comply with the terms of these coning regulations shall not be used for the storage of goods, inoperable vehicles or snow and shall not be included as part of the space requirements to most the off-street area. (E) SCREENING: Except in the case of multiple dwollingo all loading areas ohall be ocroonod and landscape) from abutting and surrounding residential uses in compliance with Chapter 3, Section 2 [G) of this Ordinance. [P) SIZE: Unless otherwise specified in these zoning regulations, the first loading berth shall be not less than fifty-five (55) feet in length and all loading berths shell be not less than thirty (30) feet In length. A11 Loading berths shall be not less than ten (10) feet in width and fourteen (14) feet in height, exclusive of &Lela and maneuvering specs. O (G) NUMBER OF LOADING BERTHS REQUIRED: The number of required oft -street loading bertha shall be as follows: MANUFACTURING, FABRICATION, PROCESSING, WAREHOUSING, STORING, RETAIL SALES, SCHOOLS, AND HOTELS: For such a building five thousand (5,000) to one hundred thousand (100,000) square feet of floor aro, one (1) loading berth fifty-five (55) feet in length and one (1) additional berth for each additional one hundred thousand (100,000) square feet or fraction thereof, plus one (1) berth thirty (30) feet in length for each thirty-five thousand (35,000) square feet of floor area or fraction thereof. 2. AUDITORIUM, CONVENTION HALL, EXHIBITION HALL, SPORTS ARENA, OR STADIUM: Tan thousand (10,000) to one hundred thousand (100,000) square feet of floor area, one (1) loading berth; for each additional one hundred thousand (100,000) square feet of floor area or fraction thereof, one (1) additional loading berth. 0 I Planning Commission Agenda - 4/12/88 4. Public Hearing - A variance request to allow construction of a garage addition within the sideyard setback requirement. Applicant, Harvey Rendall. (G.A.) A. REFERENCE AND BACKGROUND: Mr. Kendall is proposing to construct an addition onto his existing garage. The proposed addition, 6' x 26', would be within the minimum sideyard setback requirement on the front, but on the back would be 4 feet short of the minimum setback requirement, which is 10 feet. On the enclosed site plan you will see the rear portion of the proposed garage addition, which would be within the sideyard setback requirement. With the construction of the houses within this addition and the irregularly shaped lots, some of the houses were constructed with much more than a single car garage, so we do have some problems at later points when people want to add onto their garages to accommodate a full-eized two car garage. B. ALTERNATIVE ACTIONS: 1. Approve the variance request to allow construction of a garage addition within the cideyard setback requirement. 2. Deny the variance request to allow construction of a garage addition within the sideyard setback. C. STAFF RECOMMENDATION: City staff recommends approval of the variance request to allow construction of this garage addition within the sideyard setback requirement. We have ample room between the proposed garage addition and the existing residence to the northeast to accommodate utility work within the utility right-of-way in between this side lot line. D.
