City Council Resolution 2017-41CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2017-41 APPROVING A FINAL STAGE PLANNED UNIT DEVELOPMENT FOR CONSTRUCTION OF A MULTI -LOT INDUSTRIAL PARK FOR SPAETH INDSUTRIAL PARK WHEREAS, the applicant has submitted an application for approval of a final stage PUD and a request for rezoning to PUD, Planned Unit Development District; and WHEREAS, the applicant has submitted a request to rezone its property to PUD, subdivide it into eight parcels, and develop it as a common industrial project; and WHEREAS, the site is guided for industrial uses under the label "Places to Work" in the City's Comprehensive Plan; and WHEREAS, the subject property is currently zoned I-2, Heavy Industrial, according to the official Monticello Zoning Map and ordinance, and WHEREAS, the proposed PUD zoning will accommodate the flexibility from the otherwise application regulations to allow a development project consistent with the required on the Monticello Comprehensive Plan; and WHEREAS, the Planning Commission held a public hearing on June 6, 2016 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the applicant has revised and submitted Final Stage PUD plans in accordance with the Development Stage PUD, and WHEREAS, the City Council has considered all of the comments and the staff report for the Final Stage PUD, which are incorporated by reference into the resolution; and WHEREAS, the City Council of the City of Monticello makes the following Findings of Fact in relation to the recommendation of approval: 1. The PUD provides an appropriate means of furthering the intent of the Comprehensive Plan for the site by putting the existing and proposed buildings to industrial use. 2. The proposed improvements on the site under the Development Stage PUD are consistent with the needs of the PUD in this location as an industrial area. 3. The improvements will have expected impacts on public services, including sewer, water, stormwater treatment, and traffic which have been planned to serve the property for the development as proposed. CITY OF MONTICELLO WRIGHT COUNTY, MINNNESOTA RESOLUTION NO. 2017-41 4.. The PUD flexibility for the project, including parcels without public street frontage, are consistent with the intent of the City's economic development objectives, as well as with the intent of the PUD zoning regulations. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Monticello, Minnesota, The Monticello City Council hereby approves the Rezoning and Final Stage PUD for the Spaeth Industrial Park, subject to the conditions listed in Exhibit Z as follows: The applicant shall revise plans to address the remaining comments of the City Engineer per the letter dated July 19"', 2017. 2. The applicant shall execute and record the stonnwater facilities maintenance agreement. 3. The applicant shall provide additional language related to the stormwater maintenance system within the required cross -access and parking easements and maintenance covenants supporting the planned unit development per the City Attorney's recommendations and shall execute and record the covenants. 4. Outdoor storage shall be prohibited within the planned unit development. 5. Building or business signage shall be limited to entry and service doors only at this time. 6. Continue to coordinate addressing and mailbox installations with City Building and Streets departments. 7. The applicant shall execute and record the development contract with the City specifying and securing all relevant aspects of the project.
