Adjourn MINUTES REGULAR MEETING - MONTICEL.LO CITY COUNCIL Monday February 25, 2002 - 7 p.m. Members Present: Roger Belsaas, Roger Carlson, Clint Herbst, Brian Stumpf and Bruce Thielen. Members Absent: None 1. Call to Order and Pledge of Allegiance Mayor Belsaas called the meeting to order at 7 p.m. and declared a quorum present. The Pledge of Allegiance was said. 2. Approve minutes of February 11, 2002 regular council meeting. ROGER CARLSON MOVED TO APPROVE THE MINUTES OF THE FEBRUARY 11, 2002 REGULAR COUNCIL MEETING WITH THE CORRECTION THAT CLINT HERBST'S MOTION WAS TO RECOMMEND THE APPOINTMENT OF TOM PERRAULT AS HRA COMMISSIONER. CLINT HERBST SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 3. Consideration of adding items to the agenda. Clint Herbst asked that ATV activity be added to the agenda. Jeff O'Neill requested that the council approve extending the building moratorium by 15 days to allow sufficient time for the residential design standards to be put in place. BRUCE THIELEN MOVED TO ADD THE EXTENSION OF THE BUILDING MORATORIUM TO THE CONSENT AGENDA. CLINT HERBST SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 4. Citizen comments/petitions, requests and complaints. Charles Fradella, 9012 Farmstead Avenue, came before the Council to express his concern about the installation practices of Charter Communications. He submitted pictures to the Council showing the size of the structure that was placed on his property by the cable company. He was not aware that the structure was going to be installed. When he contacted the company he was informed that the company was installing their new fiber optic equipment and that the decision on the placement of any structure was solely the cable company's. Clint Herbst questioned whether the structure the cable company was using had to be that large and if so, couldn't they landscape or screen around it so it would not be quite so obtrusive. John Simola, Public Works Director, stated that the City had concerns with the cable company work extending beyond the right-of-way and beyond what was allowed by permit. He has contacted the cable company and has set up a meeting with thein in approximately two weeks. John Simola added that the City had not been shown the size of the structures that will be installed L Council Minutes - 2/25/02 nor where the structures would be placed. Chuck Fradella questioned if the structure was placed in the right-of-way would the City even allow him to landscape around it since that would be an encroachment into the right-of-way. The Public Works Department was directed to work with Charter Communications to resolve the matter. Dayle Veches, 2219 116' Street came before the Council concerning the weight restrictions on the streets in the Rolling Woods development. He also questioned why garbage trucks and city plow trucks could exceed the load limits when others could not. John Simola and City Engineer, Bret Weiss explained the reason for the weight restrictions noting that the boulevards are retaining water and are not being maintained. The water problems are also undermining the subgrade. Silt fencing is not being put in place so debris is running into the street. Also contractors are driving over the curb and not using the driveway area which further undermines the boulevard area. The concern is not only with the immediate effect on the roads but also whether the life expectancy of the road (20-30 years) can be reached under these conditions. Bret Weiss stated that the building officials were out at the development and were attempting to get the builders to comply with the erosion control requirements of the ordinance. It was suggested that with some work to the boulevard area maybe the weight restrictions could be lifted. Bret Weiss stated that normally the weight restrictions are in place for eight weeks with the City generally following the state in when the restrictions are put in place and when they are lifted. Bret Weiss also suggested that maybe a one day permit could be allowed which would provide builders an opportunity to get materials hauled in but restrict the heavy loads to a limited period of time. The Council directed the City Engineer to work with the Building Department and Public Works to see what could be done to correct the problem. 5. Consent Agenda A. Consideration of ratifying new hires for the Community Center and Liquor Store. Recommendation: Ratify the hiring of employees as identified for the Community Center and Liquor Store. B. Consideration of resolution approving charitable gambling licenses for the Monticello Lions Club. Recommendation: Adopt a resolution authorizing the State Gambling Control Board to renew the charitable gambling license for the Monticello Lions Club for Hawks Sports Bar and Grill, Monticello Country Club and River City Lanes. Res. # 2002-7, 2002-8, 2002-9. C. Consideration of waiving statutory liability limits for City insurance renewals. Recommendation: The Council affirms that the City of Monticello does not waive the monetary limits on tort liability established by Minnesota Statute 466.04. D. Consideration of approving the date for annual Board of Review. Recommendation: Approve setting Wednesday, May 8, 2002 at 7 p.m. at the date for the 2002 Board of Review. 2 2 Council Minutes - 2/25/02 E. Consideration of establishing a policy for conference and training expense reimbursements for volunteer firemen. Recommendation: Adopt the following policy for reimbursements for volunteer firemen attending required training courses: 1. $8 per hour of the required training course. 2. Reimbursement of actual meal costs, not to exceed $25/day (receipts required to receive reimbursement). 3. Required overnight accommodations to be reimbursed at the single room rates. 4. Volunteer attendance at non -required training courses would not be eligible for hourly training cost reimbursements. F. Consideration of authorizing replacement of existing cooler doors - Liquor Store Expansion. Recommendation: Accept the quotation from St. Cloud Refrigeration for replacement of 24 cooler doors at a price not to exceed $18,818. G. Consideration of ratifying employees for Water Department positions. - Information for selection was not ready for this meeting. Tabled until next meeting. H. Consideration of mediation settlement agreement - Kean of Monticello, Inc. assessment appeal. Recommendation: The Council approve the mediated settlement agreement in the amount of $31,000 as outlined in the settlement agreement. BRIAN STUMPF MOVED TO APPROVE THE AMENDED CONSENT AGENDA WITH THE ADDITION OF THE EXTENSION OF THE BUILDING MORATORIUM FOR AN ADDITIONAL 15 DAYS. BRUCE THIELEN SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 6. Consideration of items removed from the consent agenda for discussion. None. 7. Consideration of a request by Barry Fluth to build the Landmark Square building with a overhang extending 2' over the street right-of-way. This item was removed at the request of the developer to allow additional time to meet with staff. 8. Consideration of request to reduce the size of a meeting room and reorganize three office cubicles at the Community Center. At the request of staff, this item was tabled to next council meeting. 2 Council Minutes - 2/25/02 9. Consideration of a request to waive certain development fees associated with the Elm Street Crossing Second Addition proiect. Deputy City Administrator, Jeff O'Neill explained that between the development of the first phase and the second phase of this property, the City instituted a policy of charging trunk fees and park dedication fees for all parcels not just newly platted land. Since the developer had been issued a building permit prior to his final plat being approved, the developer was not aware of these charges until the final plat for the second phase was approved. The Council discussed whether allowing a reduction in fees because one of the parcels was an existing lot of record would set a precedent. They did feel in redevelopment areas giving credit on trunk charges for existing lots may be an incentive for redevelopment but they wanted the credit to be given on a case by case basis at the discretion of the Council. BRUCE THIELEN MOVED TO REDUCE THE TRUNK UTILITY AND PARK DEDICATION CHARGES FOR THE ELM STREET CROSSING SECOND ADDITION BY HALF NOTING THAT THIS WAS A ONE TIME REDUCTION. CLINT HERBST SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 10. Consideration of adoption of policy ouidina Citv response to annexation requests. Deputy City Administrator, Jeff O'Neill summarized the recent ruling allowing the City to annex by state statute. Although the City is operating under the provisions of the statutes, it was suggested that a policy be set up that would provide guidelines to be followed when dealing with petitions for annexation. Clint Herbst questioned whether the State Planning Agency allowed the annexation because the township did not contest it. Jeff O'Neill responded that the State Planning Agency was legally compelled to approve the annexation because the City met the requirements of the statute. Jeff O'Neill felt that having a policy in place to serve as a guideline would give some assurance to the township that the City would not be acting capriciously in their consideration of annexation petitions. Roger Carlson stated that he was in favor of having a document in place even though it may not be the final document. BRIAN STUMPF MOVED TO ACCEPT THE PROPOSED POLICY GUIDING CITY RESPONSE TO ANNEXATION REQUESTS WITH THE REALIZATION THAT THIS MAY NOT BE THE FINAL VERSION. BRUCE THIELEN SECONDED THE MOTION. Jeff O'Neill will prepare a formal policy document and a copy of that with accompanying letter will be sent to the County and the township. 4 '� Council Minutes - 2/25/02 11. Consideration of requesting appraisal on industrial portion of Gold Nugget property for potential purchase by the City. The Council discussed a proposal to have an appraisal done on the industrial portion of the Gold Nugget property with the possibility of the City acquiring the land. The value of land would be determined by two separate appraisers, one selected by the City and one selected by the developer. Clint Herbst clarified that the City was only committing to the cost of the appraisal at this time. ROGER CARLSON MOVED TO AUTHORIZE THE CITY STAFF TO OBTAIN AN APPRAISAL ON THE VALUE OF AN APPROXIMATE 70 ACRE PORTION OF THE GOLD NUGGET PROPERTY. BRIAN STUMPF SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. Added Items: Mayor Belsaas asked if anyone would be interested in serving on the Wright County Drug Task Force Advisory Board. Staff will get additional information on time and frequency of meetings and it was suggested that perhaps somebody on the Police Commission would be willing to serve. Clint Herbst noted that he had received some calls regarding the activities of four wheelers within City of right-of-way. The Council discussed the problem and directed that the existing ordinances should be reviewed and research be done to on provisions that could be added to the existing ordinance to curb the problem. Bruce Thielen felt this was an item that should be reviewed by the Parks Commission and then brought back to the Council. Consideration of ratifviniz emplovees for Water Department positions. (JS) A. REFERENCIA ANIS BACKGROUND: This item was carried over from the last meeting. Of the candidates selected none, thus far have accepted the positions that are open in the Water Department. Council Agenda - 3/11/2002 5 n Consideration of renewal of garbage disposal contract with Elk River Landfill, Inc. (J. S.) - - - A. REFERENCE AND BACKGROUND: Our current three year contract with the Elk River Landfill, Inc. a Waste Management Company expires on April 1St of this year. Our current costs of disposal are $33.30 per ton which includes the Elk River City surcharge at $3.33 per ton, the Sherburne County surcharge of $0.60 per ton, and the Minnesota Landfill Cleanup fee of $6.66 per ton. It does not, however, include the State of Minnesota Waste Assessment and sales tax of 9.75%. The new contract proposes to go to $34.21 per ton including all taxes and surcharges except the state sales tax. This is about a 2.7% increase. Each of the following years also result in a total cost increase of about 2.7% to 2.8% per year, which again includes all the surcharges and taxes except the Minnesota Waste Assessment sales tax (landfill without fees is a 4% increase). The cost of the end of the contract, the third year, would be $36.13 per ton. B. ALTERNATIVE ACTIONS: 1. The first alternative is to authorize City staff to enter into a contract with the Elk River Landfill, Inc. based upon their proposal as outlined above for the next three years. A copy of their proposal is included for your review. 2. The second alternative would be to further negotiate the contract or not enter into a contract with the Elk River Landfill for disposal of our garbage. C. STAFF RECOMMENDATION: It is the recommendation of the Public Works Director that the City approve a new three year agreement with Elk River Landfill based upon alternative #1 and authorize staff to develop the contracts for the mayor's signature. Thank you, for the opportunity to quote the continuation of disposal services. It has been a pleasure for all of us at Elk River Landfill to serve the citizens of Monticello during the current agreement. The current contract expires on April 1, 2002. At this time we would like to offer a 3 -year agreement, with the following cost provisions. DISPOSAL PRICE: Elk River Landfill, Inc. proposal to the City of Monticello. The price for disposal of Municipal Solid Waste shall be $34.21 per ton including all taxes, surcharges and fees, except sales tax and State of Minnesota assessment. (State of Minnesota waste assessment and sales tax is currently 9.75%) Currently Elk River Landfill, Inc. pays the following taxes and surcharges on Generator's wastes: Elk River City surcharge of $3.33 per ton, Sherburne County surcharge of $0.60 per ton, and Minnesota Landfill Cleanup fee of $6.66 per ton. After thirty (30) days prior notice to Generator, the disposal price shall be adjusted by any change in or addition to these taxes and surcharges. SECOND AND THIRD YEAR PRICE INCREASE 4% OF BASE COST. REFERENCE AND BACKGROUND.: Change Orders numbered 2, 3, and 4 for the liquor store addition are attached. They originate from contract deductions/value engineering, from additions to the contract necessary to improve the functionality of the store and from unforseen conditions in the existing liquor store building, contingency items typical to remodeling. The following summarizes the additions to the original project: Items added by Change Order 92 include: 1. Ouarry tile flooring in the area of the check-out counters [as opposed to carpet to reduce ongoing maintenance & replacement]. 2. Move the main trunk duct to the back roorn and eliminate the soffit that would be built into the retail space. 3. Installation of a pedestrian floor mat in the vestibule., reducing ongoing maintenance costs. The sum of additions and deducts from change order #2 is $8,136.00. Items added by Change Order #3 include: 1. Concrete sidewalk and curb work outside of five feet away from the building [cost effective and necessary in the fall of 2001 to enable access to the building over the winter - an expense that would have been included in our civil work in the spring anyway]. 2. Sink in break room. 3. Framing and drvwall unforseen changes necessary to deal with existing conditions in the old store area. 4. Electrical additions to correct existing electrical problems and additions to enable better interior advertising and functionality in the old portion of the store. 5. Installation of an acoustical ceiling in the existing store., This provided an architectural solution to a lighting problem and unified the interior architecture of the entire store. 2. As you may know, the attorney representing Ruff Auto has objected to the City's efforts to vacate the right-of-way and sell all of it to Mike Cyr in conjunction with the Vine Street project. It is hoped that with the initiation of this action, the City will be in position to provide the right-of-way to Cyr in time to meet his project schedule. Please note that legal action taken by Ruff could serve to delay the ability of the City to provide clear title to the land at the time of transaction which could delay the project. While we have not seen title work to support the City's assertion that it is the fee owner to that portion of Vine Street located between Sixth and Seventh Streets, we are of the opinion that the City is not free to convey this property for the following reasons: 1. If, as you assert, the property was given to the Town of Monticello as part of a larger parcel pursuant to the Townsite Act of Congress of May 23, 1844, then the property was acquired "in trust, for the several use and benefit of the occupants, according to their respective interests" and any conveyance thereof is to be in accordance with existing statutes and laws. The Act also states that it "shall include only such land as is actually occupied by the town ... and shall not in the whole exceed three hundred and twenty acres". 2. It is our assumption that the Plat of the Townsite of Monticello designated the streets for public use as shown thereon. Pursuant to Minnesota Statutes Section 505.01, the recording of a plat operates to convey the fee of all such land (i.e., the streets) to the public for the uses and purposes named or intended as though such land were conveyed by warranty deed ... and is, therefore, held in trust for the purposes intended. 3. Ruff Auto Parts, Inc. has been using up to the centerline of Vine Street for over fifty (50) years. Their use of this property creates rights of adverse possession. Even though it is commonly held that there can be no adverse possession against the state or its subdivisions, if a i municipality permits a long time encroachment into a dedicated right-of-way and acquiesces in the encroachment, it will be estopped from ejecting the encroacher, its successors, or assigns. See, City of Rochester v. The subject property was annexed to the City of Monticello in 1974, at which time the total acreage for the City would have exceeded the 320 acres allowed by the Act. Ruff Auto Parts had been using up to the centerline of Vine Street for approximately 28 years when it was annexed to the City of Monticello. It is our understanding that the property was grandfathered in as to its present use at the time of annexation and would remain that way indefinitely. 5. In order to vacate Vine Street pursuant to existing statutes and case law, a vacation proceeding must be commenced and notice given to the adjacent property owners and Ruff Auto Parts as an occupant of the land an.d as an affected party to the proposed vacation. To the best of our knowledge, this action has not been commenced. In the event the City is determined to be the underlying fee owner in the vacation proceeding, the City again, holds the property in trust for the public and as such, must (a) offer it for sale to the adjoining property owners—each owner accruing from the centerline of Vine Street; or (b) offer it for sale to the public to the highest bidder. 6. It is our understanding the project proposed by Michael Cyr requires that not only the land currently designated as Vine Street be vacated, but that additional property situated directly west of Vine Street also is needed by Michael Cyr to accommodate the townhomes he proposes be built at this site. His proposed site plan shows a relocation of Vine Street to accommodate his development. The acquisition of this additional land will result in one adjacent landowner being left with an unbuildable lot due to a lot split. It would seem to the undersigned that Mr. Cyr needs to acquire the property he needs in the same fashion any other developer acquires property—that is to purchase it at fair market value from the owners and affected parties. Please be advised that until this matter is resolved, any attempt to move the existing fenceline or personal property of Ruff Auto Parts, Inc. will result in a claim for damages for the taking of Ruff Auto Parts' rights of possession, enjoyment and use of the property, interference with their business and personal property, as well as claim for a taking in violation of the United States and State of Minnesota Constitutions. Consideration of development stage planned unit development and preliminary plat for Vine Place town homes (previously named West Village Town homes of Monticello) Applicant: Mike Cyr/Front Porch Associates. (JO) This attached information will be reviewed by the Planning Commission a special meeting taking place just prior to the City Council meeting. A summary of that meeting and motion to be given at the meeting. In the meantime, City Council is being provided the same information and alternatives as provided to the Planning Commission. Planning Commission Agenda - 03/12/02 2. Public Hearing: Consideration of a request for a Development Stage Planned Unit Development and Preliminary Plat for Vine Place, a 26 unit townhouse proiect. Applicant: Front Porch Associates,. (NAC) A. Reference and Backiaround. Front Porch Associates have applied for Preliminary Plat approval and Development Stage PUD approval for Vine Place, a 26 unit townhouse project at Minnesota Street and West 6" Street. The project includes the replacement of the Vine Street right-of-way with a private central street, and the relocation of old 7"' Street along a new public street alignment, now proposed to be called 6 '/2 Street. A portion of Minnesota Street is also proposed to be vacated to conform its alignment with the constructed part of the roadway. The plan for the project relies on a rear garage access from a private alley. The buildings are moved close to the street to create a more urban environment. At concept level, the alleys functioned as a part of a series of one-way loops, including the use of the central private street. The private street was designed to be one-way, with one -side parking serving the visitor parking needs of the project. The proposed plan has changed the circulation concept, and the unit designs appear to have resulted in additional departures from the concept drawings. As currently proposed, the internal private street would have just 20 feet of width from back of curb to back of curb - less than 18 feet of driving surface. This is not adequate to accommodate both circulation and parking on one side. The building locations are shown to be 15 from the curb line on the private street portion, and approximately 20 feet from the sidewalk on the public street portion of the project. Staff has encouraged the applicant to pursue the narrow front setbacks as a part of the concept that would result in a more urban feel. However, staff is concerned that the dimensions of this project design have been reduced below reasonably functional levels. The alley side of the buildings shows a rear parking depth of 20 feet, with a 16 foot wide alley. As noted above, the concept plan included the narrow alleys as a part of a one-way circulation loop. However, the alleys no longer loop all the way back to the street, resulting in the need for two-way circulation in all areas. Staff has supported this design in some areas where the layout was no more than a few units deep. However, this project utilizes the 16 foot alley design for clusters of 2, 4, 6, 6, and 8 units - 380 feet in length on the south part of the project. While it is acknowledged that traffic levels would be very low on most of these alleys, they are also problematic from the standpoint of garage and driveway access. A full Planning Commission Agenda - 03/12/02 dimension parking stall is at least 20 feet in depth. Staff encourages more than this in front of garage doors since most people park to leave room between the front bumper and the garage. To accommodate a backing -out movement, the minimum space required for standard vehicles would be an additional 20 feet. The preferred dimension would be 44 feet total (plus a couple of feet from the garage door), and a minimum functional dimension of 40 feet. The illustrated dimension barely meets the minimum even at the deepest point, and is as shallow as 36 feet on the north part of the project. Complicating this issue even further is the fact that the alley setbacks on the east and west boundaries are just 3.5 feet. The City uses a typical 5 foot setback in most areas to accommodate planting and screening. The submission package does not include building plans or landscape plans. These plans would be typical requirements of a Development Stage PUD approval. Because the project departs so greatly from the typical standards (even from those of most other PUD projects), architecture and site treatments would be important factors in considering whether the project meets the objectives of PUD - superior design and amenities not otherwise possible under standard zoning regulations. In summary, there are a number issues raised by this plan that the City should consider closely. The PUD process is sought to permit departure from typical zoning requirements in the following ways: 1. Private street access. 2. Front building line and building separation. 3. Side building separation. 4. Private street width. 5. Visitor parking supply 6. Alley (private street) width, and long, one-way alley design. 7. Turning movements from garages. 8. Setbacks from public streets 9. Curb separation from adjoining property. Some of these departures may be justifiable based on design considerations, however as noted, the submission packet does not include architecture or landscaping to help with this consideration. Other departures raise functional issues. The lack of visitor parking and the difficulty with turning movements out of the garages onto the alleys would cause operational problems that could not be overcome later, and would be more than mere "inconvenience". Although some of the design ideas were generated at a concept level, the changes from the concept plan to this stage have negated many of the advantages that staff believed to be a part of the project. These include building sizes, circulation changes, 2 Planning Commission Agenda - 03/12/02 and a number of dimensional issues. B. Alternative Actions. Decision 1: 1. Motion to recommend approval of the Development Stage PUD, based on findings that project takes advantage of design flexibility and is a creative use of the property. 2. Motion to recommend denial of the Development Stage PUD, based on findings that the departures from general zoning standards are not offset by superior design and amenities, as required by the PUD ordinance. Decision 2: 1. Motion to recommend approval of the Preliminary Plat, based on findings that the project layout is consistent with the Comprehensive Plan and the City's housing objectives. 2. Motion to recommend denial of the Preliminary Plat, based on findings that the project's departure from basic zoning and engineering standards result in C. Staff Recommendation. Staff does not recommend the PUD as currently designed. As noted above, the changes between concept level and this stage have resulted in losing many of the advantages of the project that the concept plans had envisioned. This has risen to the point of creating a number of dimensional and functional issues that staff believes would have significant impacts on the operation of the project. Planned Unit Development is not intended merely to waive zoning standards or to increase density. The PUD concept is to allow flexibility that results in improvements not possible under basic zoning. When a project creates problems, rather than solves them, planning staff does not believe that the PUD tool is being applied appropriately. D. Supporting Data. Consideration of establishing comparison price of Citv sale of Vine and 7"' Street right-of-Nvay. At a previous meeting, the City Council vacated a portion of the right-of-way of Vine Street and 7"' Street as part of a PUD for a townhome development. The Council did not at that time set a price for the sale of the vacated right-of-way. Prior practice has been for the City to sell the vacated property at fair market value. The HRA will be considering a request for TIF assistance for this project at their November 14"' meeting. The developer wants to know if there is a cost for the property and if so what is the amount. Based on cost information supplied, sale of property in the area ranged from $1.75 to $4.00/sq ft. It was noted that the price of/the units was $165,900 which was less than the $169,00 that was used in the HRA's initial approval of the concept plan. 011ie Koropchak, Economic Development Director indicated that the HRA had allowed $105,000 to cover acquisition of the property with the house, demolition of the house and a reduction of $5,500 deposit. The Council discussed whether the land cost for the right-of-way could be included in the TIF assistance. 011ie Koropchak indicated that this land cost could be included but it would mean more units would be in the TIF district. The level of TIF assistance the HRA would provide would be determined at their November 14"' meeting. Mike Cyr, developer,, stated the development would create a tax base of $35,000 when fully developed. The developer was asked if the marketability of the units would be affected by its location to an auto body site. Mike Cyr noted there would be screening and vegetation planted to buffer the area and none of the units are facing in the direction of the auto body site. REFERENCE AND BACKGROUND: Some of the old sanitary sewer in the downtown area is made out of clay, is of large diameter of 12" 18", and was dug In by hand in 1924. This sewer originally served as a dual storm sewer and sanitary sewer line that went directly to the Mississippi River. In 1960, the storm sewer catch basins were disconnected and plugged at the pipe and the clay tile was used after that for sanitary sewer purposes only. Portions of the pipes have cracked over age and show some signs of settlement, especially those portions on Broadway from Walnut Street east to Cedar Street, and From the intersection of Broadway and TH 25 south to Third Street. City staff and the engineer would like to repair or replace these portions of the sanitary sewer prior to the start of our road project this summer. To dig this portion of our sanitary sewer system would be costly and have a significant impact on the interruption of traffic in the area. Additionally, the heavy construction and pounding of equipment, especially the vibratory compaction equipment above the surface could cause some further destruction of the sanitary sewer. We would rather take a proactive approach and line this section using a fiberglass type of cured in place liner. We are anticipating a cost of $50,000 or less for this work. With your approval we would hope to place an advertisement in the local paper on March 15, 2002, finish the quote/bid documents by March 25, 2002, and have a bid submittal date of April 5, 2002, and an award of April 8, 2002, at our regularly scheduled council meeting. We are expecting the work to be completed in June prior to the start of our major construction project. During the time we are also investigating the remaining portions of the sanitary sewer on the project to look at other realigning or replacement areas. B. ALTERNATIVE ACT➢ONS: 1. Consideration of request by Barry Fluth to build the Landmark Square building with an overhang extendinv- 2' over the street ri4ht-of-way. (JO) REFERENCE AND BACKGROUND At the previous meeting of the City Council, this item was removed from the agenda by the developer to allow for further discussions between the developer and City staff. As you recall, the developer requests easements necessary to allow a portion of the structure to extend over the Locust Street right-of-way. After further review, the concerns mentioned by staff in the previous report have been satisfied and staff is now in full support of the architectural design. The main reasons why staff supports establishment of an easement allowing this encroachment are as follows: The encroachment over the right-of-way is at a height that will not likely ever impair maintenance of the right-of-way or utilities. The encroachment enables use of interesting architectural features (turrets) that add significant value to the building and thus support the goals of the redevelopment plan. The design is strongly supported by the Design Advisory Committee. The area of encroachment along the wall represents a small fraction of the total wall area and is essentially an architectural element and is not an effort to increase building size or living area. Staff believes that granting the easement based on reasons noted above will not set a poor precedent because the easement is intended solely to encourage positive architectural elements. Granting of this "air rights" easement on a limited basis can not be used as a precedent by others who would propose building cantilevered floors to simply increase building size. ALTERNATIVE ACTIONS 1. Motion to grant easements necessary to allow extension of architectural features over the Locust Street right-of-way and lend support to developers similar request to Wright County for easement needed over CSAH 75 (Broadway). Consideration of request to reduce the size of the West Prairie Conference Room to reorganize four office cubicles at the Communitv Center., (KB) A. REFERENCE AND BACKGROUND: The Community Center Program / Operations Coordinator, Amy Dean, Event Coordinator, Tricia Menth, and Aquatic Director, Corinne Mitchell, are currently sharing an office space designed to comfortably accommodate one person that is located a distance away from the main desk and the operations area of the Community Center. We are looking to develop additional office space immediately adjacent to my office and near the main desk of the community center. While our main goal is to provide adequate office/work space for each employee, the bonus benefit would be to provide increased administrative support to the main desk and the guests of the Community Center. This proposal calls for using a portion of the West Prairie Conference Room and MCC hallway for needed office space. The West Prairie Conference room is an important part of City Hall's work environment, however the space can be reduced and continue to function well as a meeting room. With the Community Center taking over a portion of the conference room, we can continue to provide conference room space for City employees and also for organizations and add the needed office space thereby using available space more effectively. To accomplish this feat we would propose that we would remove some of the walls that make up my office to open the space up and move my community center hallway door out further into the hallway, again to gain more space. Walls would be erected to divide the conference room with the MCC offices and walls and a door would be built to provide office space for me. We would need to review the lights, ventilation, electrical and the telephone needs of putting three more people into this space and possibly make additions to some of those systems. The other part of this remodeling request would be to enclose the Fireplace room with a door and ventilation appropriate for an enclosed room. We would then be able to rent this space as a conference room to businesses and organizations. The space as is, is underutilized. We would expect this remodeling project to alleviate four pressing problems. Number one would be the need for adequate office space for the Community Center administrative staff. As I mentioned, three employees are literally working on top of each other. They each work constantly with the public, either on the phone, in the office or at the main desk. The noise level of three busy people, along with the inability to provide customer relations within their work space makes this an ineffective working environment and hinders productivity. The second problem that would be remedied is the need for staff to have a close working relationship with and at the main desk. To provide the best customer service it is important that we meet and greet our customers, assist them with questions or problems that Guest Service staff might be unable to handle, and develop a relationship with our customers. The third problem that would be resolved would be to provide a break room area for the Community Center employees. Because the busiest hours at the Community Center are outside of the City Hall office hours, we don't have access to an employee break area. Unfortunately this means that staff will naturally attempt to congregate at the main desk, which is against our employee policies. The fourth problem that would be resolved is the need for additional meeting space for the public. By enclosing the Fireplace room, which is infrequently used, and converting it into a conference room we would be able to increase rental revenues. The Boom Island Meeting Room generated just under $3,600 in rental income in 2001. Tricia Menth, our Event Coordinator, often has to turn away businesses or organizations looking for meeting space because we are already fully reserved. We also find that the younger population like the Fireplace room as a hideaway and we have to continually police that area. Enclosing this room would eliminate "hiding" spaces down that front hallway. This has been a team effort in trying to determine the most efficient use of space at the least cost with the most benefit. Rick Wolfsteller, Jeff O'Neill, Fred Patch and myself have attempted to review all possible options to resolving this problem. The Community Center Advisory Board voted unanimously to recommend that the City Council move forward with the remodeling plans as proposed. Though we have not gone out formally for proposals on cost, Fred Patch anticipates that the cost should not exceed $40,000. The money for this project is not in the budget for the Community Center, however, in their capital improvements budget $5,000 was allocated for overhead fans for the main hallway and $2,000 for office furniture and equipment. This $7,000 could be directed towards this project. B. ALTERNATIVE ACTIONS: 1. To approve the remodeling as proposed, with the final cost not to exceed $40,000, funds to be drawn from the MCC capital improvements budget in the amount of $7,000 with the balance to come from the general fund reserves. 2. The purpose is "retain industrial business."' The BRE Plan. as «written. is as follows: Members of the Monticello Industrial Development Committee (IDC) working in cooperation with the Director of Economic Development will meet with the industrial business leaders of Monticello. The meeting known as Business Retention and Expansion Visits must instill a sense of value to the business. As a public relations visit, it is an opportunity for an exchange of information between the industrial business and the community. The business will be briefed on current community activities, be provided a package of resource information, and be asked to suggest ways the community and the city can better serve the needs of their- business and employees. The goal is to visit at least two industries per month. The suggested length of time for visit is approximately one-half hour. Information gathered will be reported at the following monthly IDC meeting and forwarded to the City Council. I made the second BRE visit on February 19. 2002, to Remmele Engineerin11 g. Inc.. Attached is a summary of the visit and a letter dated March 7. 2002, to Remmele outlinino the follow-through to their questions or concerns. No Council direction is necessary following the visit to Remmele Engineering. Has the City Engineer Consultant looked into the safety hazard concern identified at the intersection of East Chelsea/Cedar and HighNvay 25 and responded to rainbow Enterprises?
