COUNCIL AGENDA - August 13, 1979 Before actual negotiations are commenced with the business representative from the Union and the union steward, the Council may want to set up a meeting with the City Administrator and the committee members appointed by the Council to go over the union demands. This would give the Council committee a chance to review the items demanded for the next contract prior to the first meeting with the union. POSSIBLEZC 10': Consideration of appointing members of the Council to (I . \{'1 union committee to negotiate a new contract with the ~I~J 't Local 49 members, and also, consideration of setting up IV ~ ~j! initial meeting date and consideration of hiring Mr. Mike , , ~ f, O'Connor as consultant in the negotiations. , ~ REFERENCES: Enclosed copy of union demands for 1980 through 1981. 3. Consideration of Action to Take Against property Owners Failinq to Hook- Up to sanitary Sewer System by Deadline Date. According to City Ordinance Section 7-2-3-(B), it is necessary that once a parcel of property has sanitary sewer service available from the City, it is necessary to hook up to the system within three years after comple- tion. Property owners abutting the improvement completed in 1975, were originally sent notices and given until October 15, 1978 to hook up to the sanitary sewer. As you will recall, approximately 13 homeowners indicated last fall that they would be unable to hook up in time to meet the deadline due to problems getting contractors to do the work. At the October 10, 1978 Council meeting, the Council granted an extension to July 15, 1979 for mandatory hookup to the sewer system for parcels served by the 1975-1 improvement project. To date, there are 12 property owners who have not yet completed the hook up to the sewer system as required by July 15th, but one individual did request an extension until August 15th to complete it. Since the Council has already granted a 9-month extension, it would appear that the property owners may not intend to hook up to the system unless the City takes some sort of action to require them to do so. One possible suggestion would be to send a letter notifying the property owner that he would have fourteen days to hook up or the matter would be turned over to the City Attorney for prosecution. For the Council's information, it should be noted that the mandatory sewer hook up deadline for the 1976-1 Improvement Project would be August 24, 1979. There are presently a few property owners on this 76 project who have not hooked up and the Council may want to consider any action taken in regards to the 1975-1 project as a precedent for what may happen in the future. POSSIBLE ACTION: Consideration of notifying property owners that legal action may be taken if mandatory hook up is not completed within 14 days. COUNCIL AGENDA - August 13, 1979 4. Consideration of the Award of the Sale of $1,170,000 in General Obliqa- tion Improvement Bonds for the 1979-1 Improvement Project. Commercial Plaza 25 Oakwood Industrial Park The J.R. Culp Property Lauring Lane in Lauring and Industrial Drive Hillside Terrace A representative from Springsted, Inc. will be at Monday night's meeting to open the bids and give his recommendation on the awarding of the sale of the bonds. The net interest rate estimated by King Forness is approxi- mately 5-3/4%, and the bonds would be payable over a ten-year period to coincide with our assessment policy with a final payment being made in 1991. POSSIBLE ACTION: Consideration of awarding sale of general obligation bonds. 5. Consideration of Hirinq Additional Full-Time Employee for the Public Works Department. In the first part of June 1979, the City advertised for a temporary summer employee to work with the Public Works department in the areas of sewer and water. The position at that time was noted to be a temporary position with the possibility that it could turn into a full time position if it was determined necessary by John Simola, Public Works Director. Mr. Matt Thiesen was hired for the position and it is now the recommenda- tion of the Public Works Director that Matt be hired on a full time, permanent basis. As you are probably aware, once the new treatment plant is in full operation, possibly an additional two to four employees will be needed just to operate the treatment plant, and it is anticipated that Mr. Thiesen could be utilized in this capacity. In the meantime, Matt will be gaining experience in the operation of the present treatment plant and will also work with the water department. ) .1\ John Simola, Public Works Director, is preparing a Summary of Mr. Thiesen's background, which is enclosed with the agenda for your review. It should be noted that if Mr. Thiesen is hired under a full time position, his present time the past three months would Count towards the 6-month proba- tionary period as stated in the union contract. Under the present union contract, Mr. Thiesen's starting salary would be at 80% of the top rate, or $5.04 per hour until December 4, 1979, at which time it would go to 90% of the top rate, or $5.67 per hour. POSSIBLE ACTION: Consideration of hiring additional full time employee for the Public Works Sewer and Water Department. ConSideration of Sewer and Water Utilities Petition Received from fur tis HOq1und._ COUNCIL AGENDA - August 13, 1979 A petition was received from CUrtis Hoglund requesting that sewer and water he extended to his property, located at the corner of COunty Road 75 and East County Road 39 (currently Curt's Storage and Sales). Mr. Hoglund Plans to development the northerly POrtion of his property into Townhouse_type dwellings. Although the property has not been subdivided yet, Mr. Hoglund filed the petition in order to get an idea as to wbether or not seWer and water services could be made available to his property. ACCOrding to the proPOsal presented, (see attached plat layout) future plans Would call for approximately five 6-unit townhouse structures with each owner of a townhouse being an OWner of the common ground area. At the present time, the property is zoned R-3 where the tOwnhouses are proPOsed to be developed, and representatives of Mr. Hoglund have indicated that they would probably just be dividing the parcel into two parcels by a certificate of survey. . Mr. Hoglund has heen informed that the deadline for petitions of sUch nature was January 1, 1979 for any constrUction to he Considered during 1979, but Mr. Hoglund is proposing to install his own seWer and water laterals from MissisSiPPi Drive through an easement on Lots abutting MisSisSiPPi Drive. In reviewing this item with City Engineer, John Badalich, Mr. Badalich felt that Serving this parcel is a posSibility by extending seWer and water through an easement up the hill from MisSisSiPPi Drive. The second alternative Would be to extend sewer and water westerly along County Road 39 from its present ending POint on MiSSissiPPi Drive. The second alternative would require a 4/5's Council Vote as less than 35% of the property owners actually petitioned for the improvement. In addition, a feasibility study Would have to he completed and more than likely not be Considered until 1980 along with other petitions as a bond would probably have to be floated to COVer the cost. The first alternative of serv,c'ng the property with Sewer and Water from MississiPPi Drive through an easement on Mr. Hoglund's property could be accomplished similar to what Marvin George did in Balboul Estates. If Mr. Hoglund is Willing to install the improvements himself, it would appear that the City would not have to get involved in any financing, etc., as it would all be done on private property. According to Mr. Badalich, seWer service for proposed townhOUse dwellings would be adequate this way, but there may be a slight water pressure problem because of the higher altitude of the Hoglund Property compared to MiSSisSiPPi Drive. Representatives of Mr. Hoglund were made aWare of this fact and they did indicate they would be willing to install booster pumps in each tOWnhouse unit to provide adequate water pressure. Should the COuncil approve servicing Mr. Hoglund's property from MiSSisSiPPi Drive, some type of plan should be prepared for review by the City Engineer, and also the City Engineer should do the actual inspection of the improvement. If the property owner decided to have the City'S - 4 - . . . . ~ ) y I ~ ~ ~ COUNCIL AGENDA - August 13, 1979 Engineering firm of Orr-Schelen-Mayeron & Associates prepare plans and specifications for the service, some sort of an agreement would have to be worked out whereby the property owner would deposit with the City the estimated amount of the engineering fees. The City then in turn could pay Orr-Schelen-Mayeron for the preparation of any plans and specifications necessary. Additionally, if Mr. Hoglund is allowed to provide his own water and sewer service to his property, it should be pointed out that future plans for this area may include future water and sewer lines along County Road 39 and/or Highway 75, that would abut the balance of Mr. Hoglund's property. As a result, Mr. Hoglund should be made aware that he may possibly have future sewer and water assessments placed against his property and that this service stub coming from Mississippi Drive would not relieve him of future assessments should other improvements be made abutting his property. POSSIBLE ACTION: Consideration of whether or not to allow Mr. Hoglund to construct his own sewer and water improvements from Mississippi Drive to his property, or whether to con- sider a petition for sewer and water as part of next years sewer and water improvements. REFERENCES: Copy of certificate of survey and proposed area to be developed. 7. Consideration of Final Payment on SealCoating Project - 79-1SC. Batzer Construction Company, contractor on the 79 SealCoating project, requested that the final payment in the amount of $1,298.46 be approved by the City of Monticello. The sealcoating project was completed in approximately two days time, but 10% of the total contract was withheld until the City could complete the sweeping of the excess rocks off of ~the streets. V 'The street sweeping process has been completed by City personnel and the project was inspected on Friday, August 10. It is the recommendation of the Public Works Director, John Simola, that the project be accepted and that final payment be made to Batzer Construction Company. The total project cost for sealcoating would total $12,984.64. POSSIBLE ACTION: Consideration of approval of final payment. 8. Consideration of City Accepting utilities Installed under 1978-2 Improve- mentProject~BalboulEstates. As you will recall, Marvin George Builders of Princeton, Minnesota, developer of Balboul Estates plat, entered into a development agreement with the City of Monticello to allow him to install his own sewer and water and street improvements in Balboul Estates. Part of the - 5 - . . COUNCIL AGENDA - August 13, 1979 agreement between Marvin George Builders and the City required that all improvements were inspected by the City's conSUlting engineers. In addition, the developer agreed that the City of Monticello woUld not accept the improvements until they Were apProved by the City Council by resolution. Mr. Marvin George has requested that the City Engineer do a final inspec_ tion on the improvement project and requested that the City accept the improvements, etc., So that he can start to occupy homes in the develop_ ment. The sewer and water utilities Were inspected by OSM and apProved last fall, but the street improvement and cUrb and gutter are just being completed this Week. Final blaCktoPPing is scheduled to be com- Pleted by Friday, August 10,1919, at which time the final inspection of the project will be completed. Although the seWer and water improvements were insPected by OSM in the fall of 191B, the sewer lines Would have to be reinspected to insure that they are free and open from any debris that may have fallen in while the street Was being paved. John Badalich, City Engineer, indicated that he should have a final recommendation on Whether the City shoUld accept the project on Monday night. It WOUld appear that before the City of Monticello finally accepts the improvements in Balboul Estates, lien waivers shoUld be Obtained from Marvin George's COntractor Who installed the improvements to protect the City from any future liability. 'Ne arc currently waiting for disbursement of our riscal year IV Funds, which is scheduled for July 15th, 1979. I have contscted Minnesota Housing Finance Agency in St. Paul and they have confirmed this date. . Mr. Daniels is the tWenty-fifth perSon on our waiting list for funds in Wright County. However, due to the urgency involved in his situation, I have placed his name at the head of the list and will be giving him top priority. Unfortunately, Our regulations prOVide that no work may commence Until final approval of the grant package by ro,FA have been received at our office. The applica- tion thru approval process usually involves a period of two to three weeks. Accord- ingly, we should be able to install Mr. Daniel's hook-up in the first half of August. It is common knowledge that our new disposal plant will be much larger and require more man hours and skilled personnel to operate it efficiently. In addition, as an interim facility, a chemical feed system has been ins~Qlled at Our plant to assist us in obtaining our allowable limits on BOD and S. S. discharge into the Mississippi River. OSM, in the design of the chemical feed system, has recOmmended another employee to assist in its operation. Currently, the system requires 15 man hours per week, excluding supervision adjustments and samples. These man hours are now supplied by seasonal help. It is my opinion that we should be planning ahead so that when the disposal plant is completed we have skilled personnel to operate it. There is no better way to learn about a plant than to be there during its construction. . At present we have sufficient workload to require at least one more full time employee. We have a seasonal employee, Mr. Matt Thiesen, whom I believe could be trained as a plant operator. Mr. Thiesen has been with the city since June 4th and has been working in the sewer and water depart- ment. He has exhibited excellent qualities such as good attitude, attendance, quality of work, responsibility and initiative which lead me to believe he would become a valued employee. He has already grasped a general knowledge of the workings of both the water and sewer department. Mr. Thiesen has shown a desire to make his home here in our city (he and his family now reside in Princeton), and become a permanent employee. I have checked his previous employers and found no reason to believe he would not fit in well with our present staff. I recommend that Mr. Thiesen become a permanent employee of the city and further recommend that the time he has worked since June 4th be credited to his length of service toward his probationary period. He would start at 80% of cUrrent union wage or $5.04 per hour. s .
