Township officials recently met in a losed session to review our latest offer
for settling the annexation disputes rior to the scheduled hearing March 9.
Contrary to the proposed options we sked them to consider, the Township
Board did prepare another counterp posal that was a modified version of
our two options we had asked them t select from. As you will recall from our
last discussions, the City Attomey w s instructed to offer two options for
Township consideration, and we had requested that the Township not pick
and choose specific items from each roposal but consider each option
separately for a solution.
The third draft of a settlement agree ent modified by the Township is
enclosed for Council review. It is su gested that the Council conduct a closed
meeting starting at 5:30 p.m. on Mo day night for the purpose of reviewing
this proposal prior to our regular Co ncil meeting. The following is a brief
outline of the modifications proposed by the Township in their third draft
compared to the options we had aske them to consider.
1. Township has inserted 6 ft as the common boundary amount
that would be needed to have any parcels considered to be
contiguous. Our propos I in either option indicated 20 ft.
2. As part of our second al ernative proposed to the Township, we
had requested that und r item #5, another paragraph be added
which indicated that an ther exception to the 50% rule would be
if parcels were undevelo able due to a public use, natural
environmental conditio ,or other constraint beyond the City's
control, the 50% rule wo ld not have to be met. This added
language was not includ d in the Township's proposal.

In regard to item #9 in t e proposal, we had indicated under
altemative #2 (the prop sal that would include the Orrin
Thompson parcel) that t e last sentence pertaining to the
penalty for annexing pr perty outside of the OAA boundary or
whatever boundary sho d have been eliminated or otherwise
the City would be requir d under any case to pay all of the
property taxes to the To nship for the remainder of the
agreement. The Towns ip left this taxation penalty clause in
their proposal.

4. Item #11 pertaining to haring of property taxes for annexed
parcels now seems to in lude a requirement that the Township
gets to keep three years real estate property taxes from the
Kjellberg West Mobile orne Park after it's annexed. I believe
our original discussions in the last draft proposals had only
talked about sharing pr perty taxes with the Township for
developed parcels such s the Monte Club and the Ready-Mix
Plant and always exclu ed the Kjellberg West Mobile Home
Park because both parti s understood this is an environmental
problem that the City '11 be solving, and the City would be
incurring costs to do so. The proposal submitted by the
Township now indicates they still want to keep three years of
real estate property tax s on the Kjellberg parcel also.
The above summary covers the majo differences they have modified in their
response to our two alternatives we ave them. Even though we specifically
noted that we did not want the Town hip to pick and choose specific items in
either option, they in effect have con inued to do so in their proposals. While
many of their proposals seem to folIo our second alternative we offered, the
obvious difference is that they contin e to exclude the 40 acres from Orrin
Thompson in any consideration or pr posals.

With the March 9 hearing date fast pproaching, it's obvious that we either
need to come to an agreement quickl or begin preparing for the hearing.
While most of these issues do not ne ssarily become a problem in the
modifications they proposed, I perso ally feel the real estate taxes on the
Kjellberg West Mobile Home Park be omes a hard pill to swallow when the
City is basically taking the Townshi and the County, along with the PCA
and the Attorney General's office, off the hook by resolving an environmental
problem; and as a result, the Towns 'p proposes to keep the real estate taxes
for three years. The City will be inc rring large dollars for city services such
as garbage pickup in addition to bei responsible for providing sewer
service to the property, and I feel the Council should still consider requiring
that all taxes from this parcel go to t e City after the year of annexation as
part of a settlement. In reviewing th 1997 tax rates, I believe the
Township's share of the west mobile orne park taxes amounts to over $2,200
per year.
B. ALTERNATIVE ACTIONS:

1.
The Council should close the eeting in order to continue discussions
on our strategies on the annex tion dispute. Planner Steve Grittman
and City Attorney Dennis Dal n will be in attendance at the meeting.

Re: City of Monticello, Tow ship of Monticello Annexation
Dear Mike:
As I told you earlier today, the City of Monticello met on
Monday, February 9, to consider he most recent draft outline of
the Annexation Agreement. The entire council was given your
outline which you prepared for th February 5, 1998 negotiations.
The council was somewhat di appointed in all the additional
conditions being requested by the township with respect to what is
denominated as "Area A" and " rea B." They were under the
impression that the Hermes prope ty was the major roadblock and
that if they conceded the Hermes roperty, then we pretty much had
an agreement. On the other hand, the council did authorize me to
submit the following proposal to ou. The council was unanimous in
its vote.
The City is proposing that the township elect one of two
options as will be outlined blow. The council unanimously
believes that unless one of these two options is agreed upon, then
the only alternative is to proceed 'with the hearing process.
The first alternative is to follow the concept format as it
existed prior to the revisions co tained in your February 5 draft.
The tax structure would be that et forth in Minnesota Statutes,
and the boundary lines would include what you have denominated as
areas A and B, but would delet the Hermes property which is
presently outside the orderly ann xation area. Contiguity would be
defined as a 20 foot overlap. Roadways would be excluded and
properties on opposite sides of a roadway would be considered as if
the roadway were simply removed. If there were a 20 foot overlap
without the intervening roadway, . t would be considered contiguous.
If the situation were such tha a 20 foot strip would not be
sufficient to accommodate utili ies, then contiguous would be
defined as the amount necessary t accommodate the utilities. The
blanks in paragraphs 7 and 8 ar to be filled in with the same
numbers as set forth in alternat've two. As to paragraph 5, the
50% rule as to the Kjellberg pro erty will apply only to sewer.

The second alternative the C ty is willing to accept is as
follows. The proposed agreement is based on your draft of February
5, 1998 with some modifications as set forth below. The numbers I
have included correspond with t e numbers in your February 5
outline.
1 . No change
2. No change (including no hange to the 20 foot contiguity
definition) .
3. No change
4 . No change
5. Add a paragraph D IIParce s which are undevelopable due to
public use, natural environmental condition, or other constraint
beyond the city's control.1I Also add a paragraph E which would
require, as the Kjellberg propert , that it only be 50% IIsewerd",
but not IIwatered.1I

6. There should be a clarif'cation added that the review by
the municipal board will be base upon documentary evidence and
written br~efs only, and not upon full blown hearing or even oral
argument.
7. The term should remain f r ten years only and the blanks
should be filled with 50%. The Ci y believes it is imperative that
future generations not be overly restricted and that there be a
review process in a reasonable pe iod of time. We believe a ten
year term meets those objectives.
8. The blank regarding line r feet should be filled with the
number 500.
9. The taxation penalty cl use should be deleted. The City
has committed itself not to supp rt or initiate any proceedings
outside the orderly annexation rea. If the municipal board
decides an area should be annexed despite the City's
nonparticipation and the township's probable objection, then the
municipal board's decision should not be frustrated.
10. This should be left as 't except that the word "City" in
the second line should be changed to IIproperty owner. II
11. This is acceptable ex ept that with respect to the
Kjellberg property, the township should get the tax money in the
year of annexation and the City i any subsequent years. The City
will be providing substantial se vices to the Kjellberg property
once it comes into the City a d needs to generate the funds
necessary to provide those servic s.

D. Annexation in Phase wo may not occur until events
have occurred as follows:
1. Annexation in Subdis rict A of Phase Two may not
occur until 50% of subdistrict 4 of Phase One has been
developed with public util 'ties and urban development (as
defined in paragraph 5) ithin subdistrict 4 of Phase
One; or urban development in Subdistrict 4 is contiguous
with at least 1,320 feet of subdistrict A; after which
time land in subdistrict A may be annexed according to
the terms of paragraphs 6 above.
2. Annexation in Subdi trict B of Phase Two may not
occur until 50% of Subdi trict 3 of Phase One has been
developed with public uti ities and urban development (as
defined in paragraph 5) within Subdistrict 3 of Phase
One; QI urban development in subdistrict 3 is contiguous
with at least 1,320 feet of Subdistrict B; after which
time land in subdistrict B may be annexed according to
the terms of paragraphs above.
3. Annexation of land which straddle the boundary
lines between subdistrict A and Subdistrict 4, or between
subdistrict Band Subdi trict 3, shall be treated as
qualifying for annexatio as complete parcels when that
portion of the parcels within Phase One qualify for
annexation under paragra h 6 above, notwithstanding the
other provisions of this paragraph 12.
4. The Hermes property . n its entirety will be included
within the OAA Boundary, subject to annexation via the
terms in paragraph 6 abo e.
5. The properties to he east of the city currently
within the OAA, and tha . portion of the Franklin Denn
property currently withi the OAA, may remain in or be
taken out, as preferred y the Township.
The City is offering these p oposals on an either/or basis.
It is not acceptable to the City t select items from one proposal
and other items from the other pro osal.

allow property to be sewered withi 3 yr. time period).
B. Cost of installing utilities exceeds 0 150% of the City Engineer's
estimate (same estimate as used for letter of credit?).

6. Annexation procedure:
A. Landowner submits annexation peti ion and preliminary plat requirements
to the City.
B. The City forwards this information t the joint planning board with enough
lead time for the joint planning boar to make a determination and
comment back to the City regarding the proposal's consistency with the
joint planning board land use plan d contiguity of the property to the
City.
C. City grants equivalent of prelimin plat approval (or site plan approval if
platting of the property is not requir d by ordinance) and enters into
development agreement consistent ith the land use plan in the OM. The
developer's agreement will require e developer to agree to install sanitary
sewer and water to the property to b annexed and require developer to put
up a letter of credit or other security uaranteeing payment of installation of
sewer and water utilities. The City ust also make a detennination that the
propeliy is capable of being served ith City sewer and water within a
three year peIiod and must estimate e cost of such service extension.
