City Council Resolution 2018-47CITY OF MONTICELLO WRIGHT COUNTY, MINNESOTA RESOLUTION NO. 2018-47 ORDERING IMPROVEMENTS AND APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR 2018 PEDESTRIAN IMPROVEMENT PROJECT, CITY PROJECT 18CO01 WHEREAS, a resolution was adopted by the City Council on May 14, 2018, accepting the Feasibility Report; and WHEREAS, a resolution was adopted by the City Council on May 14, 2018 calling for a public hearing on June 11, 2018, where the Council shall consider the proposed improvements in accordance with the feasibility report and the assessment of abutting properties for all or a portion of the cost of the improvements pursuant to Minnesota Statutes, Chapter 429; and WHEREAS, on May 30, 2018 and June 7, 2018, the city published notice of a public hearing to be held on June 11, 2018, to consider ordering improvements for said project; and WHEREAS, on May 30, 2018, affected property owners were mailed a notice of the public hearing to be held June 11, 2018; and WHEREAS, at said hearing there was available a reasonable estimate of the amount to be assessed and description of the methodology was presented; and WHEREAS, pursuant to the resolution approved by the City Council on May 14 2018, the City Engineer has prepared plans and specifications for the 2018 Pedestrian Improvement Project, City Project No. 18CO01 as described as construction of pedestrian improvements in the areas listed below, including sidewalks, trails, signage; and other necessary appurtenant work: • South side of 6t" Street between Walnut Street and TH 25 • South side of 7t" Street from Cedar Street to the east • North side of Oakwood Drive between TH 25 and Cedar Street • South side of Bakken Street between Garvey Court and Rolling Woods Park • CSAH 39 between Mississippi Drive and Broadway Street WHEREAS, the City Engineer has presented such plans and specifications to the Council for approval; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MONTICELLO, MINNESOTA: 1. Such plans and specifications, a copy of which is on file in the office of the City Clerk, are hereby approved. 2. Said improvements are necessary, cost-effective and feasible as detailed in the Feasibility Report at an estimated cost of $278,485. It is advisable, expedient and necessary that said improvements as described in the Notice of Hearing theron be constructed, and the same are hereby ordered made. 3. The City Council shall let the contract for all or part of the work for said improvements or order all or part of the work done by day labor or otherwise as authorized by Minnesota Statutes, Section 429.041, Subdivision 2 within one year of the date of this resolution ordering said improvements. 4. The designated authority shall prepare and cause to be inserted in the official paper and in the Star Tribune and/or Construction Bulletin or Finance & Commerce paper an advertisement for bid upon the making of such improvement under such approved plans and specifications. The advertisement shall be published no less than three weeks before the last day for submission of bids, once in the City's legal publication and at least once in either a newspaper published in a city of the first class or a trade paper. To be eligible as a trade paper, a publication shall have all the qualifications of a legal newspaper except that, instead of the requirement that it shall contain general and local news, such trade paper shall contain building and construction news of interest to contractors in this state, among whom it shall have a general circulation. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the City for 5% of the amount of such bid.
